Re: Nine on Park Quality of Works Unacceptable (Mock-Up Villa 2 only)

We refer to notification mails from TDA Consult Ltd sent on 12.04.16 (Re: NOP - Quality of Work and
attitude to the project), mail sent on 22.01.16 (Re: NOP - Attitude towards the project), Photographic report
1 sent on 22.04.16 and recurrent minutes of site meeting sent on a fortnight basis from start of project till
now whereby the Project Manager (TDA Consult Ltd) and client (Verbena Ltd) have expressed their
dissatisfaction with quality of works and organization chart for all site activities effected till date.

Refer to Fidic; Staff and Labour Clause 6.9 & Contract Doc Bill 1 General Requirements and Preliminaries
Site Management Cost- Section F whereby you are requested to send us an organization chart showing
the full and detailed list of site supervisory staff (with required skills) for the project for approval. Such list
shall include all relevant details of each staff member including function and position. This list has been
repetitively asked on a fortnight basis for now nearly 4 months and still not submitted.
Refer to Fidic; Progress Reports Clause 4.21 & Contract Doc Bill 1 General Requirements and
Preliminaries Contractors Report- Section E whereby you are requested to submit us a planned monthly
progress as per program of works and completed stages of construction. You were also requested to send
us a weekly schedule of labor and plant resources to be employed which have as to date not been
submitted.
Refer to Fidic; Contractors General Obligations Clause 4.1 & Contract Doc Bill 1 General Requirements
and Preliminaries Obligations and Restrictions imposed by the employer- Site to be tidy - Section C
whereby you are requested to maintain the site in a neat, tidy and healthy condition and the contractor
shall remove all surplus soil, unwanted debris and litter from the site. Storage of plant, machinery,
scaffolding and trusses to be neatly arranged. This list has been repetitively asked on a fortnight basis for
now nearly 4 months and still not submitted.

Refer to Fidic; Quality Assurance Clause 4.9 & Contract Doc Bill 1 General Requirements and
Preliminaries Quality Control and Quality Assurance Procedures - Section B whereby in compliance with
Clause 4.9 of the General Conditions, the Contractor shall be required to implement strict quality control
and quality assurance procedures for the works. Referring to photographic report no. 1 and e-mail from
Circa Ltd (referred to as structural engineer) dated 29.10.15 (Re: NOP Floor Slab), quality control on this
project is a concern and as to date, no adequate attendance to this problem has been put forward by
main contractor.

Refer to Fidic; Safety Procedures Clause 4.8 & Contract Doc Bill 1 General Requirements and
Preliminaries Contractors administrative arrangements- Safety on Site - Section F whereby the
contractor is expected to take all necessary steps to ensure that the site is run in an orderly manner and
that safety precautions are enforced to avoid accidents t personnel. As mentioned during site meetings,
mails and minutes, no reasonable effort has been put forward on the site to tackle this safety issue. Safety
helmets and safety shoes are not worn on site. No safety officer report has been circulated yet.
Refer to Fidic; Nominated Subcontractors Clause 5.1 & Contract Doc Bill 1 General Requirements and
Preliminaries Checking Drawings/Discrepencies- Section A, Builders Work- Section D, Co-ordination
Section E whereby the contractor is expected to perform all recesses, chases, sleeves, etc. required so that
they may be correctly built in the first place. If the contractor fails to do this, the cost of any alterations or
cutting will fall upon him. Based on photographic report, a number of walls have been plastered without
M&E services been placed.
With reference to the above mentioned points, you are requested to cease all progress activities as from
26.04.16 and complete all necessary repairs to the satisfaction of the Engineer within a delay not
exceeding 3 working days; failing which you will receive a stop order until further notice.
