COMPLAINT AFFIDAVIT
Ako, si ZALDY B. ESCASINAS, 53 taong gulang, Filipino,
hiwalay sa asawa, at kasalukuyang naninirahan sa Purok
Matahimik, Brgy. New Guinlo, Bayan ng Taytay, Lalawigan ng
Palawan, pagkatapos makapanumpa ng naaayon sa batas, ay
malayang nagsasaysay na:
1.
Noong taong 2010 2013, ako ay nahalal at nagsilbing
Punong Barangay ng Brgy. New Guinlo sa Bayan ng Taytay,
Palawan;
2.
Noong 2013 si Ginoong Ricky C. Abes ay nahalal bilang
bagong Punong Barangay ng Brgy. New Guinlo, Taytay, Palawan.
Hanggang sa kasalukuyan si Brgy. Chairman Abes ay nagsisilbing
punong barangay ng nasabing barangay;

Sa kasalukuyan din, si Erliza O. Prudente ay miyembro
ng Sangguniang Barangay Member ng Brgy. New Guinlo at siya rin
ay nagsisilbing Chairman of Committee on Appropriations ng
nasabing barangay;
4.
Sa kasalukuyang termino ni Brgy. Chairman Abes
hinirang niya si Raciel M. Marquez bilang Barangay Treasurer ng
Bgry. Guinlo, Taytay, Palawan;
Kalakip dito bilang Exhibit A ay kopya ng Certification
galing sa DILG MIMAROPA Region na nagpapatunay ng
kasalukuyang posisyon nila Barangay Chairman Ricky C. Abes,
Sangguniang Barangay Member Erliza O. Prudente at Barangay
Treasurer Raciel M. Marquez;

isang liham na may petsang July 19, 2106 upang humiling sa

Office of the Municipal Accountant ng Munisipyo ng Taytay na

pinamumunuan ni Ms. Ruby M. Socrates na magsagawa ng
audit/inspection or investigation ng mga proyekto ng aming
barangay na pawang mga ghosts projects na diumanoy
naisakatuparan noong mga taong 2014, 2015 at 2016. Kalakip
dito ay kopya ng nasabing liham at ito ay may markang Exhibit
B;

Alisunod sa aming liham kay Municipal Accountant Ms.
Ruby M. Socrates, siya ay nagsagawa ng imbestigasyon at
pasusuri ng mga nabanggit na proyekto. Isang kaukulang New
Guinlo Project Inspection Report na may petsang August 15, 2016
ay ginawa ni Ms. Ruby M. Socrates. Kalakip dito ay kopya ng
nasabing inspection report at may marka bilang Exhibit C;

Ayon sa nasabing inspection report ang sumusunod
ay ang mga iregularidad na natuklasan:
8.1. Proyekto:

subalit ayon sa inspekyon na isinagawa ng Municipal

Accountant no improvement or repair was made on the

said water system. Kalakip din dito ay kopya ng
Liquidation Report1 na ginawa at nilagdaan ni Brgy.
Treasurer Reciel M. Marquez at aprubado ni Brgy.
Chairman Ricky Abes na diumanoy mayroong binili na
131 bags ng semento para sa pagpapagawa ng Yakal
Water System.
8.1.b

Noong Mayo 19, 2015, may ginastos ang barangay na

halagang P25,000.00 para diumanoy pagpapagawa ng
nasabing water system. Subalit ayon sa inspection
report:
The fund was used to purchase a lot through Labor
Payroll. Xxx No Deed of Sale in Barangay File, but
according to Kap. Abis the owner borrowed it to have
him duplicate copy (sic).
No realignment or
reprogramming was found on Barangay file.
8.1.c. Noong September 30, 2015, may ginastos ang
barangay na halagang P86,265.002 na diumanoy
ipinangbili ng mga materyales at pinangbayad sa mga
trabahador sa pagpapagawa ng Yakal Water System.
Dito makikitang mayroon diumanoy mga materyales
na binili subalit ayon sa inspection report ng Municipal
Accountant walang improvement o di kaya ay
repair sa nasabing Yakal Water System.

8.1.d. Kaugnay pa din sa proyektong ito, ayon sa labor payroll 3 na

nakalakip sa liquidation report (Exhibit E) may

halagang P17,655.00 na diumanoy ibinayad sa mga

trabahador ng Yakal Water System. Unang-una, ang
liquidation report ay may petsang September 19, 2015
subalit ang petsa ng labor payroll ay para sa petsang
January 3 18, 2016.
Dito pa lamang ay may
irregularidad at anomalya na sa paggastos ng pondo ng
barangay.
Ito ay tahasang falsification of public
document.
Pangalawa, si Eddie Custodio ay
itinatangging siya ay naging laborer sa proyektong ito
at nakatanggap ng halagang P3,250.00 sa payroll na
ito. Tahasan niya rin itinatanggi na ang pirma 4 sa
nasabing payroll ay kanya.
Kalakip dito ay ang
Malayang Sinumpaang Salasay5 ni Eddie Custodio at
ang sample ng kanyang lagda.
8.1.d.

Ang mga materyales na nagkakahalaga ng P26,210.00

na gagamitin sa Yakal Water Systme ay natagpuan sa
tinitirhang bahay ni Brgy. Chairman Ricky Abes;

8.2. Proyekto: Steel Gate (Item No. 2 of Exhibit C):

8.2.a. Noong December 10, 2014, may ginastos ang
barangay na halagang P15,198.00 na diumanoy para sa
pagpapagawa ng Steel Gate ng barangay hall. Subalit
ayon sa inspection report ng Municipal Accountant:
No Steel Gate Project. The fund was used in the
construction of Barangay Flagpole xxx located in front
of the Barangay Hall.
No Resolution on (for)
realignment or reprogramming was found in Barangay
file.
Kalakip sa complaint-affidavit na ito mga larawan 6 ng
barangay flagpole na ang pondong ginamit sa
pagpapatayo nito ay galing sa fund/appropriation na
nakalaan para sa Barangay Steel Gate Project.

8.3. Proyekto: Yakal Open Canal (Item No. 3 of Exhibit C):

8.3.a. Ang pondong nakalaan na nagkakahalagang
P10,000.00 na para pangbili ng mga gagamiting
materyales sa Yakal Open Canal ay ipinangpbayad
lamang sa payroll ng mga laborer sa paghukay ng
nasabing canal. Ang pondo ay ginamit sa gastusin na
hindi naaayon sa program of works ng proyekto at
walang kaukulang realignment or reprgoramming.
8.4. Proyekto: Material Recovery Facility (MRF) (Item
No. 4 of Exhibit C):
8.4.a.
Ang pondo na nakalaan sa proyektong ito ay
nagkakahalaga ng P30,000.00.
Subalit ayon sa
Inspection Report ng Municipal Accountant:
No Material Recovery Facilities or MRF project in
Barangay. The fund was used to purchase fuel
excavation of the dumpsite but no resolution
realignment or reprogramming was found on file in
barangay. No approved program of works.

Ito ay isa ring halimbawa ng mga proyekto ng Barangay

8.5. Proyekto: Multi-purpose Hall Fence (Item No. 5 of
Exhibit C):
8.5.a.
Ayon sa Liquidation Reports7 na isinumite ni
Brgy. Treasurer Reciel M. Marquez na aprubado ni Brgy.
Chairman Ricky Abes may pondong ginastos na

nagkakahalaga ng P90,650.00 na diumanoy ibinili ng

mga materyales para sa pagpapatayo ng Multi-purpose
hall fence. Subalit, ayon sa inspection report walang
nakatayong multi-purpose hall fence. Sabi sa inspection
report:
The fund was used for the improvement of old multipurpose hall8 but no resolution on realignment or
reprogramming was found on file.
8.5.b.
Ayon sa Recomputation of Expenses na ginawa ni
Engr. Dale G. Garcellano9 ng Municipal Engineering
Office, ang pagsasaayos ng old multi-purpose hall ay
nagkakahalaga lamang ng P81,467.00 at hindi
P90,650.00. Base sa mga nasabing documento ang
proyektong ito ay over-priced ng P9,183.00. Dahil dito
ang Barangay Guinlo nawalan ng halaga na P9,183.00
na nagdulot ng kapahamakan at pinsala dito.
8.6. Proyekto: Matahimik Open Canal (Item No. 8 of Exhibit
C):
8.6.a.
Ang pondo na nagkakahalaga ng P20,000.00
na nakalaan para sa pagpapagawa ng Matahimik Open
Canal ay ipinangbili ng tatlong pirasong steel tube para
sa footbridge. Dalawa sa nasabing steel tubes ay
natagpuan sa bahay ni Brgy. Chairman Ricky Abes at
ang isa naman at ay siyang ginamit sa pagpapatayo ng
flagpole. Ang mga larawan ng nasabing steel tubes ay
kasama sa mga larawan na makikita sa Exhibit G.
8.6.b.

Ayon sa Inpection Report:

Non-existent project. Xxx

8.6.c. Makikita na ang pondong ginamit sa pagpapatayo

ng Barangay flagpole ay galing sa pondo ng proyekto
para sa steel gate (Par. 8.2 of this Complaint-Affidavit)
at pondo para sa proyektong Matahimik Open Canal.
Una, ang barangay flagpole ay walang appropriation
kayat anumang pagkakagastos ditto ay iligal at hindi
naaayon sa batas. At pangalawa, ang pondo para sa
Steel Gate at Matahimik Open Canal ay ginamit na hindi
naaayon sa barangay appropriation ordinance kaya ito
ay iligal at walang basehan sa batas.
8.7. Proyekto: Pagkakaisa Pathway (Item No. 9 of
Exhibit C):
8.7.a Ang proyektong Pagkakaisa Pathaway ay may
halagang P15,030.00. Ang halagang ito ay ginastos
ayon sa Inspection Report subalit ang proyektong ito ay
hindi naisakatuparan. Sabi sa inspection report:
Materials stated in the liquidation (report) about 31
bags of cement amount to P9,430 was not found.
P5,000 labor was used to pay the hauling cost of 10
cu.m. boulders, but only 3 cu.m. of boulders were found
on the project site10 while the remaining 7cu.m. were
missing.
8.8. Proyekto: Yakal Day Care Center-Trust Fund (Item No.
10 of Exhibit C):
8.8.a. Ang proyektong Yakal Day Care Center ay may
halagang P15,000.00. Ang halagang ito ay ginamit
upang ibili ng mga materyales para improvement and
beautification of Yakal Day Care Center. 11 Subalit ang
mga nasabing materyales ay ginamit sa pagpapatayo
ng Feeding Center at hindi sa proyekto na kung saan

ang pondo ay nakalaan. Ayon sa Brgy. Kagawad na si

Henry Jarabejo ang naturang pondo ay nakalaan para
sa feeding center subalit diumanoy nagkamali lamang
sila sa paglagay sa liquidation report at ito ay
naipangalan lamang sa Day Care Center.
8.8.b.
Ang sinasabing nagkamali lamang sila sa
paglagay ng pangalan ng proyekto sa liquidation report
ay pawang walang katotohanan. Makikita sa Labor
Payroll12 para sa petsang December 1-8, 2015 ang
tinutukoy na proyekto sa nasabing payroll ay for labor
on: Improvement/Rehabilitation of Yakal Day Care
Center.
Ito ay magpapatunay na ang pondong
P15,000.00 na galing sa trust fund ay para talaga sa
proyektong Yakal Day Care Center at hindi para sa
Feeding Center.13
8.8.b. Katulad din ng nabangit sa Par. 8.1.d ng ComplaintAffidavit na ito. Si Eddie Custodio ay itinatangging siya
ay nakatanggap ng halagang P1,200.00 sa payroll na
ito. Tahasan niya rin itinatanggi na ang pirma 14 sa
nasabing payroll ay kanya.
Kalakip dito ay ang

na magpapatotoo na mayroong actual disbursements

para sa mga nabanggit na proyekto ng Barangay
Guinlo.
9.Dahil sa mga kahinahinala at iregularidad na paggastos ng
pondo ng barangay para sa mga nabanggit ng proyekto, ako ay
dumulog sa Provincial Legal Office, Province of Palawan upang
isangguni at humingi ng opiniyon sa kung anong aksyon ang
nararapat naming gawin. Ang rekomendasyon ng Provincial Legal
Office ay:
Therefore, since the documents presented attached herewith
appears to be sufficient in facts and in law, a verified complaint
may be brought to the Office of the Ombudsman for criminal and
administrative charges.17
10.Base sa mga nakasaad sa taas at base na rin sa
rekomendasyon ng Provincial Legal Office ng Palawan, ako, bilang
mamamayan ng Brgy. Guinlo, Taytay, Palawan, ay nagsasampa ng
kriminal at administratibong reklamo laban sa mga sumusunod na
opisyal ng nasabing barangay:

10.1 Criminal Complaint for violation of Section 3,

paragraphs (e) and (f) of RA 3019, as amended otherwise
known as The Anti-Graft and Corrupt Practices Act; violation
of Section 4 paragraphs (a) and (c) of RA 6713 otherwise
known as the "Code of Conduct and Ethical Standards for
Public Officials and Employees; Malversation of public funds
or property provided under Art. 217 of the Revised Penal
Code (RPC); Illegal use of public funds or property under Art.
220 of the RPC; and Falsification of public documents under
Art. 171 of RPC.

10.2. Administrative Complaint for the acts or omissions

of the above barangay officials constituting: Dishonesty;
Neglect of duty; Misconduct; Falsification of public
documents; and Conduct prejudicial to the best interest of
public service which are provided under Section 46, Book V,
Title I, Chapter 7 of Executive Order No. 292 otherwise
known as the Administrative Code of 1987.
11. Na iba pang mga tulong na makatarungan at pantay-pantay
sa ilalim ng batas ay siya rin hinihiling.
