KEY MESSAGE TO UK GOVERNMENT

PUTTING VICTIMS
FIRST
The UK Government has
produced a white paper on
reforming the criminal justice
system.
This document sets out briefly
the views of Crocelss Chief
Executive Officer Jonathan
Bishop as information to the
UK Government and Crocels
Members, including of
Crocels CMG CYF and the
Pluralist Party.

The direction of the UK Government towards a civil law based framework fits
with the direction of Crocels research in relation to de-criminalising society
through making better use of torts and other civil remedies. This will mean
that justice can be seen to be done without damaging career prospects and
therefore the economy and society as a whole.

Important considerations for the UK Government


Crocels supports the simplification of the legal system, which builds on
rather than damages the good work done on ASBOs since 1998.
Creation of new torts
The Protection from Harassment Act 1997, started under the Conservatives
and completed under New Labour strikes the balance between criminal
action and tortuous obligations. The new orders created in the legislation
should have a civil remedy for victims where statutory agencies refuse to act.
The need for Registrars and Preliminary hearings
Civil courts like the county court and employment tribunals have procedures
in place to vet the suitability of cases. As it is simpler to bring and win cases
in the civil courts Registrars or Judges should be given the power to decide
whether a case including one brought by the police has merit and is in
the public interest.

The Impartiality of the judiciary is a


fundamental human right. These orders should
make use of that and not seek to by-pass them

The current policy makes a lot of reference to community and youths.


Crocels currently works with young offenders and young achievers equally
on community regeration projects that have an electronic dimension.
The orders should make no reference to age or frontier. They should be
applicable to people of all ages and all frontiers (including the Internet).
Clear guidance should be used to differentiate between groups.
