We have reviewed Mr. Cassino’s scttlement “offer” from May of 2016 and described our subsequent conversations from June of 2016 to our client Please be advised that JPMorgan Chase Bank, N.A. rejects the settlement offer made by Mr. Cassino. Please be further advised that, as previously deseribed to you, Mr. Cassino has failed to abide by the terms of the Settlement Agreement filed in the Jefferson County District Court Case 4858 on March 13, 2013. Specifically, Mr. Cassino has failed to file a Subdivision Application with Jefferson County, Colorado as required by section 2() of the Settlement Agreement. JPMorgan Chase Bank, N.A. will exercise its tights to file a breach of contract action based on the Settlement Agreement as well as bring any other claims it may have related to the property. JPMorgan Chase Bank, N.A. will seck its attorneys’ fees and costs as contemplated by section 14 of the Settlement Agreement and as allowed by Colorado Law.
