OceanGoingVesselsWithinCaliforniaWatersand24NauticalMilesoftheCaliforniaBaseline.

(a)Purpose.
Thepurposeofthissectionistorequiretheuseoflowsulfurmarinedistillatefuelsinordertoreduceemissionsof
particulatematter(PM),dieselparticulatematter,nitrogenoxides,andsulfuroxidesfromtheuseofauxiliarydieseland
dieselelectricengines,mainpropulsiondieselengines,andauxiliaryboilersonoceangoingvesselswithinanyofthe
waterssubjecttothisregulation(RegulatedCaliforniaWaters).
(b)Applicability.
(1)Exceptasprovidedinsubsection(c),thissectionappliestoanypersonwhoowns,operates,charters,rents,or
leasesanyoceangoingvesselthatoperatesinanyoftheRegulatedCaliforniaWaters,whichincludeallofthe
following:
(A)allCaliforniainternalwaters
(B)allCaliforniaestuarinewaters
(C)allCaliforniaports,roadsteads,andterminalfacilities(collectivelyports)
(D)allwaterswithin3nauticalmilesoftheCaliforniabaseline,startingattheCaliforniaOregonborderandendingat
theCaliforniaMexicoborderatthePacificOcean,inclusive
(E)allwaterswithin12nauticalmilesoftheCaliforniabaseline,startingattheCaliforniaOregonborderandending
attheCaliforniaMexicoborderatthePacificOcean,inclusiveand
(F)allwaterswithin24nauticalmilesoftheCaliforniabaseline,startingattheCaliforniaOregonborderandending
attheCaliforniaMexicoborderatthePacificOcean,inclusive,exceptfortheregionwithintheareadefinedby34.8
degreesNorth,121.14degreesWest,thenceto34.46degreesNorth,120.82degreesWest,thenceto34.36degrees
North,120.82degreesWest,thenceto34.29degreesNorth,120.99degreesWest,andfollowingtheboundary24

(2)Exceptasprovidedinsubsection(c),thissectionappliestooceangoingvesselsthatareflaggedin,registeredin,
entitledtoflytheflagof,orotherwiseoperatingundertheauthorityoftheUnitedStates(U.S.flagged)oranyother
country(foreignflagged).
(3)Nothinginthissectionshallbeconstruedtoamend,repeal,modify,orchangeinanywayanyapplicableU.S.
CoastGuardrequirements.Anypersonsubjecttothissectionshallberesponsibleforensuringcompliancewithboth
U.S.CoastGuardregulationsandtherequirementsofthissection,includingbutnotlimitedto,obtainingany
necessaryapprovals,exemptions,orordersfromtheU.S.CoastGuard.
(c)Exemptions.
(1)Therequirementsofthissectiondonotapplytooceangoingvesselvoyagesthatarecomprisedofcontinuous
andexpeditiousnavigationthroughanyRegulatedCaliforniaWatersforthepurposeoftraversingsuchbodiesof
waterwithoutenteringCaliforniainternalorestuarinewatersorcallingataport,roadstead,orterminalfacility.
Continuousandexpeditiousnavigationincludesstoppingandanchoringonlytotheextentsuchstoppingand
anchoringarerequiredbytheU.S.CoastGuardrenderednecessarybyforcemajeureordistressormadeforthe
purposeofrenderingassistancetopersons,ships,oraircraftindangerordistress.Thisexemptiondoesnotapplyto
thepassageofanoceangoingvesselthatengagesinanyoftheprejudicialactivitiesspecifiedinUnitedNations

ConventionontheLawoftheSeas(UNCLOS)1982,Article19,subpart2.Further,notwithstandinganyCoastGuard
mandatedstopsorstopsduetoforcemajeureortherenderingofassistance,thisexemptiondoesnotapplytoa
vesselthatwasotherwisescheduledorintendedtoenterCaliforniainternalorestuarinewatersorcallataport,
roadsteadorterminalfacility.
(2)Therequirementsofthissectiondonotapplytoemergencygenerators.
(3)Therequirementsofthissectiondonotapplytoauxiliaryengines,mainenginesorauxiliaryboilersonboard
oceangoingvesselsownedoroperatedbyanybranchoflocal,state,orfederalgovernment,orbyaforeign
government,whensuchvesselsareoperatedwithinRegulatedCaliforniaWatersongovernmentnoncommercial
service.However,suchvesselsareencouragedtoactinamannerconsistent,sofarasisreasonableand
practicable,withthissection.
(4)Therequirementsofthissectiondonotapplytoauxiliaryengines,mainengines,andauxiliaryboilerswhilesuch
enginesandboilersareoperatingonalternativefuelinRegulatedCaliforniaWaters.
(5)Therequirementsofthissection,includingthepaymentofNoncomplianceFeesasprovidedinsubsection(h),do
notapplyifthemasterreasonablyandactuallydeterminesthatcompliancewiththissectionwouldendangerthe
safetyofthevessel,itscrew,itscargooritspassengersbecauseofsevereweatherconditions,equipmentfailure,
fuelcontamination,orotherextraordinaryreasonsbeyondthemaster'sreasonablecontrol.Thisexemptionapplies
onlyaslongasandtotheextentnecessarytosecurethesafetyofthevessel,itscrew,itscargo,oritspassengers
andprovidedthat
(A)themastertakesallreasonableprecautionsaftertheconditionsnecessitatingtheexemptionhaveendedtoavoid
orminimizerepeatedclaimsofexemptionunderthissubsection
(B)themasternotifiestheExecutiveOfficerofasafetyexemptionclaimwithin24hoursaftertheendofeachsuch
episode(i.e.,theperiodoftimeduringwhichtheemergencyconditionsexistthatnecessitatethesafetyexemption
claim,asprovidedinparagraph(5)above)and
(C)themastersubmitstotheExecutiveOfficer,within4workingdaysafterthenotificationinparagraph(B)above,all
documentationnecessarytoestablishtheconditionsnecessitatingthesafetyexemptionandthedate(s),localtime,
andpositionofthevessel(longitudeandlatitude)inRegulatedCaliforniaWatersatthebeginningandendofthetime
periodduringwhichasafetyexemptionisclaimedunderthissubsection.Alldocumentationrequiredunderthis
paragraphshallbeprovidedinEnglish.
(6)TemporaryExperimentalorResearchExemption.Asprovidedinthisparagraph,therequirementsofthissection
donotapplytovesselsthathavebeengrantedatemporaryexperimentalexemptionbytheExecutiveOfficerforthe
durationoftheapprovedexemption.AtemporaryexperimentalexemptionmaybegrantedbytheExecutiveOfficer
forexperimentalpurposesforuptothreeyearswithoneextensionforuptothreeadditionalyears.Theexemption
willbelimitedindurationasspecifiedbytheExecutiveOfficerintheExecutiveOrdergrantingsuchanexemptionor
extension.Alldocumentationandinformationsubmittedinsupportofanapplicationforatemporaryexperimental
exemptionorextensionshallbedeemednonconfidentialandavailableforpublicreviewunderthePublicRecords
Act.
(A)Pursuanttothisparagraph,apersonmayoperateanauxiliaryengine,mainengineorauxiliaryboilerwithfuel
thatdoesnotmeettheprovisionsof(e)(1),providedthepersonmeetsallofthefollowingrequirements:
1.thepersonobtainswrittenapprovalforthisexemptionorextension,intheformofanExecutiveOrder
fromtheExecutiveOfficer,beforethevesselentersRegulatedCaliforniaWaters
2.thepersonormasterofthevesseltakesallmeasuresavailabletominimizeemissionsofdieselPM,NOx,
andSOxtotheextentfeasibleduringtheperiodinwhichthetemporaryexperimentalexemptionisineffect
3.therequestforanexemptionorextensionisprovidedinwriting,submittedtotheExecutiveOfficerat
least30daysbeforethevesselentersRegulatedCaliforniaWaters,andcontainsthefollowing:
a.specificationsforthenoncompliantfuelthatthepersonisproposingtousepursuanttothis
paragraph,includingbutnotlimitedto,sulfurcontent(expressedtothenearesttenthweightpercent)
whetherthefuelmeetsASTMspecificationsformarinedieseloil(MDO),marinegasoil(MGO),or
someotherfuel(identifywhichASTMspecificationsthefuelmeets,ifany)and
b.aclearandconvincingdemonstrationthattheuseoftheproposednoncompliantfuelwillgenerate
dataaspartofresearchthatadvancesthestateofknowledgeofexhaustcontroltechnologyor
characterizationofemissions.Forpurposesofthisparagraph,theExecutiveOfficer'sdeterminationthat
thepersonhasprovidedaclearandconvincingdemonstrationshallbebasedonwhetherthe
person'suseoftheproposednoncompliantfuelisanexpresspartofaformal,executedresearch
contractorprojectadoctoraldissertationoramaster'sthesis.Ademonstrationofthestateof
knowledgeincludesspecificcitationstoscientific,academic,industryorregulatoryliteratureexistingor

inprogressatthetimeoftherequest
c.identificationofthepurpose,goals,andobjectivesoftheproject,measurestakentominimize
emissionofaircontaminants,andtestingproceduresandtestingschedules
(B)Apersonwithanexemptiongrantedpursuanttothisprovisionshall:
1.bringthevesselintofullcompliancewiththerequirementsofthissection,includingsubsection(e)(1),
priortotheexpirationofthetemporaryexperimentalexemptionasspecifiedand
2.provideaprogressreportannuallyfromthedateoftheexecutiveorder,totheExecutiveOfficerproviding
interimtestdataorotherinterimresults,descriptionofvesselmodificationsorretrofittingdoneaspartofthe
projectsorotherinformationgeneratedfromthedateofthepriorprogressreport.
3.provideallofficialtestdataandallotherresults,data,orotherinformationgeneratedduringthe
exemptionperiodtotheExecutiveOfficer,inwritingandfinalform,nomorethan90daysaftertheexpiration
ofthetemporaryexperimentalexemptionorextension.
(C)Nomodificationstothetermsandconditionsofanapprovedtemporaryexperimentalexemptionshallbevalid
unlessinwritingandagreedtobyboththeExecutiveOfficerandtheperson.Anyvariance,deviance,or
nonconformancewiththetermsandconditionsofanapprovedtemporaryexperimentalexemptionorextensionshall
bedeemedaseparateviolationofthissection.
(d)Definitions.
Forpurposesofthissection,thefollowingdefinitionsapply:
(1)Alternativefuelmeansnaturalgas,propane,ethanol,methanol,hydrogen,electricity,orfuelcells.Alternative
fuelalsomeansanymixturethatonlycontainsthesefuels.
(2)ASTMmeansASTMInternational.
(3)Auxiliaryboilermeansanyfuelfiredcombustionequipmentdesignedprimarilytoproducesteamforusesother
thanpropulsion,including,butnotlimitedto,heatingofresidualfuelandliquidcargo,heatingofwaterforcrewand
passengers,poweringsteamturbinedischargepumps,freshwatergeneration,andspaceheatingofcabins.Exhaust
gaseconomizersthatexclusivelyusedieselengineexhaustasaheatsourcetoproducesteamarenotauxiliary
boilers.
(4)Auxiliaryenginemeansadieselengineonanoceangoingvesseldesignedprimarilytoprovidepowerforuses
otherthanpropulsionoremergencies,exceptthatalldieselelectricenginesshallbeconsideredauxiliarydiesel
enginesforpurposesofthissection.
(5)BaselinemeansthemeanlowerlowwaterlinealongtheCaliforniacoast,asshownonthefollowingNational
OceanicandAtmosphericAdministration(NOAA)NauticalChartsasauthoredbytheNOAAOfficeofCoastSurvey,
whichareincorporatedhereinbyreference:
(A)Chart18600,TrinidadHeadtoCapeBlanco(January2002)

(6)DieselEnginemeansaninternalcombustion,compressionignition(CI)enginewithoperatingcharacteristics
significantlysimilartothetheoreticaldieselcombustioncycle.Theregulationofpowerbycontrollingfuelsupplyin
lieuofathrottleisindicativeofacompressionignitionengine.
(7)DieselParticulateMattermeanstheparticlesfoundintheexhaustofdieselengines,whichmayagglomerate
andadsorbotherspeciestoformstructuresofcomplexphysicalandchemicalproperties.
(8)Dieselelectricenginemeansadieselengineconnectedtoageneratorthatisusedasasourceofelectricityfor
propulsionorotheruses.
(9)EmergencyGeneratormeansadieselelectricengineoperatedonlyduringemergenciesortoperform

maintenanceandtestingnecessarytoensurereadinessforemergencies.
(10)EssentialModificationmeanstheadditionofnewequipment,orthereplacementofexistingcomponentswith
modifiedcomponents,thatcanbedemonstratedtobenecessarytocomplywiththisregulation.Essential
modificationsdonotinclude:(1)changesthataremadeforconvenienceorautomationoffuelswitchingor(2)
replacementofcomponentsthatwouldbereplacedintheabsenceofthisregulation,basedonmeasuredcomponent
wear,visualinspection,orexpectedservicelife,evenifacceleratedduetothefuelrequirements.Additionaltankage
isconsideredessentialonlyifexistingavailabletankagehaslessthanthecapacityrequiredforacompletevoyage
withinRegulatedCaliforniaWaters.
(11)EstuarineWatersmeansanarmoftheseaoroceanthatextendsinlandtomeetthemouthofariver.
(12)ExecutiveOfficermeanstheexecutiveofficeroftheAirResourcesBoard(ARB),orhisorherdesignee.
(13)Hydrocarbon(HC)meansthesumofallhydrocarbonairpollutants.
(14)InternalWatersmeansanynavigableriverorwaterwaywithintheStateofCalifornia.
(15)IMOmeanstheInternationalMaritimeOrganization.
(16)ISOmeanstheInternationalOrganizationforStandardization.
(17)MainEnginemeansadieselengineonanoceangoingvesseldesignedprimarilytoprovidepropulsion,except
thatdieselelectricenginesshallnotbeconsideredmainenginesforpurposesofthissection.
(18)MarineDieselOil(MDO)meansanyfuelthatmeetsallthespecificationsforDMBgradesasdefinedinTableI
ofInternationalStandardISO8217,asrevisedin2005,whichisincorporatedhereinbyreference,orDMBgradesas
definedinTableIofInternationalStandardISO8217,asrevisedonJune15,2010,whichisincorporatedhereinby
reference.
(19)MarineGasOil(MGO)meansanyfuelthatmeetsallthespecificationsforDMXorDMAgradesasdefinedin
TableIofInternationalStandardISO8217,asrevisedin2005,whichisincorporatedhereinbyreference,orDMX,
DMA,orDMZgradesasdefinedinTableIofInternationalStandardISO8217,asrevisedonJune15,2010,whichis
incorporatedhereinbyreference.
(20)Mastermeansthepersonwhooperatesavesselorisotherwiseinchargeofthevessel'soperations.
(21)MilitaryVesselmeansanyship,boat,watercraft,orothercontrivanceusedforanypurposeonwater,and
ownedoroperatedbythearmedservices.
(22)NitrogenOxides(NOx)meanscompoundsofnitricoxide(NO),nitrogendioxide(NO2),andotheroxidesof
nitrogen,whicharetypicallycreatedduringcombustionprocessesandaremajorcontributorstosmogformationand
aciddeposition.
(23)NonMethaneHydrocarbons(NMHC)meansthesumofallhydrocarbonairpollutantsexceptmethane.
(24)OceangoingVessel(OGV)meansacommercial,government,ormilitaryvesselmeetinganyoneofthe
followingcriteria:
(A)anontankervesselgreaterthanorequalto400feetinlengthoverall(LOA)asdefinedin50CFR679.2,as
adoptedJune19,1996
(B)anontankervesselgreaterthanorequalto10,000grosstons(GTITC)pertheconventionmeasurement
(internationalsystem)asdefinedin46CFR69.51.61,asadoptedSeptember12,1989
(C)anontankervesselpropelledbyamarinecompressionignitionenginewithapercylinderdisplacementof
greaterthanorequalto30litersor
(D)atankerthatmeetsanyoneofthecriteriainsubsections(A)(C).
Forpurposesofthissection,oceangoingvesseldoesnotincludetugboats,towboats,orpushboats.
(25)Operatemeanssteeringorotherwiserunningthevesseloritsfunctionswhilethevesselisunderway,moored,
anchored,oratdock.
(26)Ownmeanshavingalltheincidentsofownership,includingthelegaltitle,ofavesselwhetherornotthat
personlends,rents,orpledgesthevesselhavingorbeingentitledtothepossessionofavesselasthepurchaser
underaconditionalsalecontractorbeingthemortgagorofavessel.
(27)ParticulateMattermeansanyairbornefinelydividedmaterial,exceptuncombinedwater,whichexistsasa
liquidorsolidatstandardconditions(e.g.,dust,smoke,mist,fumesorsmog).

RegulatedCaliforniaWatersthatresultsinthevesselstopping,docking,mooring,orotherwisedroppinganchor
(collectivelystopping)attheport.Theportvisitcontinuesifthevesselmovestoadifferentberthwithinthesame
port,buttheportvisitendswhenthevesselleavesfororisotherwisemovedtoanotherportwithinthesamebayor
anyotherport
(B)exceptasprovidedinparagraph(C)below,eachseparateanddistinctentryofavesselintoanoffshorelocation
inRegulatedCaliforniaWatersawayfromaportthatresultsinthevesselstoppingatthatoffshorelocation(e.g.,
CatalinaIslandoroffMonterey).Theportvisitendswhenthevesselleavesfororisotherwisemovedtoaportor
anotheroffshorelocationor
(C)eachseparateanddistinctentryofavesselintoanoffshorelocationinRegulatedCaliforniaWatersawayfroma
portthatresultsinthevesselstopping,followedbyentryintothatport,shallconstituteoneportvisit,providedthe
offshorestopwasconductedsolelybecausetheportcouldnotacceptthevesselasscheduledduetoreasons
beyondthereasonablecontrolofthevesseloperatorormaster.

(34)SulfurOxidesmeanscompoundsofsulfurdioxide(SO2),andotheroxidesofsulfur,whicharetypicallycreated
duringcombustionofsulfurcontainingfuels.
(35)Tankermeansaselfpropelledvesselconstructedoradaptedprimarilytocarry,orthatcarries,oilorhazardous
materialinbulkascargoorcargoresidue.
(36)TwostrokeEnginemeansaninternalcombustionenginewhichoperatesonatwostrokecyclewherethecycle
ofoperationcompletesinonerevolutionofthecrankshaft.
(37)Vesselmeansanytugboat,tanker,freighter,passengership,barge,orotherboat,ship,orwatercraft,except
thoseusedprimarilyforrecreationandanyofthefollowing:
(A)aseaplaneonthewater
(B)awatercraftspecificallydesignedtooperateonapermanentlyfixedcourse,themovementofwhichisrestricted

(38)VoyagemeanseachseparateanddistinctjourneythatbeginswhenavesselreachesRegulatedCalifornia
WatersfromapointbeyondRegulatedCaliforniaWaters,includesatleastoneportvisit,andendswhenthevessel
departsfromRegulatedCaliforniaWaters.
(e)OperationalRequirements.
(1)FuelSulfurContentLimits.
(A)AuxiliaryDieselEngines:
1.Exceptasprovidedinsubsections(c)and(h),beginningJune28,2009,apersonsubjecttothissection
shalloperateanyauxiliarydieselengine,whilethevesselisoperatinginRegulatedCaliforniaWaters,with
eithermarinegasoil(MGO),withamaximumof1.5percentsulfurbyweight,ormarinedieseloil(MDO),
withamaximumof0.5percentsulfurbyweight,roundedasspecifiedinsubsection(i)(3)
2.Exceptasprovidedinsubsections(c)and(h),beginningAugust1,2012,apersonsubjecttothissection
shalloperateanyauxiliarydieselengine,whilethevesselisoperatinginRegulatedCaliforniaWaters,with
eithermarinegasoil(MGO),withamaximumof1.0percentsulfurbyweight,ormarinedieseloil(MDO),
withamaximumof0.5percentsulfurbyweight,roundedasspecifiedinsubsection(i)(3)
3.Exceptasprovidedinsubsections(c)and(h),beginningJanuary1,2014,apersonsubjecttothissection

processingequipment,valves,andassociatedpiping.Thediagramorotherdocumentationshalllistthefuel
tankcapacitiesandlocations,andthenominalfuelconsumptionrateofthemachineryatratedpower
2.Descriptionofthefuelswitchoverprocedurewithdetailedinstructionsandclearidentificationof
responsibilitiesand
3.Themake,model,ratedpower,andserialnumbersofallmainengines,andauxiliaryenginesandmake,
model,ratedoutput,andserialnumbersofallauxiliaryboilerssubjecttosubsection(e)(1).
(C)ReportingandMonitoring.
1.Anypersonsubjecttothissectionshallprovideinwritingtheinformationspecifiedinsubsection(e)(2)(A)
and(e)(2)(B)totheExecutiveOfficeruponrequest,eitherwithin24hoursorbyalaterdateapprovedbythe
ExecutiveOfficer.Totheextentthepersonalreadycollectstheinformationspecifiedinsubsections(e)(2)(A)

(1)Anypersonwhoissubjecttothissectionandcommitsaviolationofanyprovision,criteriaorrequirementinthis
sectionissubjecttothepenalties,injunctiverelief,andotherremediesspecifiedinHealthandSafetyCode,sections
3967439675and42400etseq.otherapplicablesectionsintheHealthandSafetyCodeandotherapplicable
provisionsasprovidedunderCalifornialawforeachviolation.Nothinginthissectionshallbeconstruedtolimitor
otherwiseaffectanyapplicablepenaltiesorotherremediesavailableunderFederallaw.
(2)Anyfailuretomeetanyprovision,criteriaorrequirementinthissection,includingbutnotlimitedtotheapplicable
fuelsulfurcontentlimitsrecordkeepingrequirementsandNoncomplianceFeeprovisionshallconstituteasingle,
separateviolationofthissectionforeachhourthatapersonoperatesanoceangoingvesselinRegulatedCalifornia
Watersuntilsuchprovision,criteriaorrequirementhasbeenmet.
(3)Anypersonwhoissubjecttothissectionisliableformeetingtherequirementsofthissection,notwithstanding
anycontractualarrangementthatpersonmayhavewithanythirdparties.
(g)NoncomplianceforVesselsBasedontheNeedforEssentialModifications.
Ifapersoncannotmeettherequirementsofsubsection(e)(1)withoutessentialmodifications,asdefinedinsubsection
(d),theExecutiveOfficerwillgrantthepersonanexemptioninwholeorinparttosubsection(e)(1).Forthisprovisionto
apply,thepersonshallmeetallofthefollowingcriteria:
(1)NotificationRequirements.
Foreachvoyagebeforetheperson'svesselentersRegulatedCaliforniaWatersfromwatersoutsideRegulatedCalifornia
Waters,apersonwhohasdemonstratedneedundersubsection(g)(2)mustnotifytheExecutiveOfficerthattheperson
willnotmeettherequirementsofsubsection(e)(1)whileoperatingwithinRegulatedCaliforniaWaters,butthepersonwill
insteadmeettherequirementsofthissubsection(g).IftheExecutiveOfficerhasnotreceivedsuchnoticeandtheperson
entersRegulatedCaliforniaWaters,thepersonwillbeinviolationofthissection.
(2)DemonstrationofNeed.
Atleast45dayspriortoavessel'sfirstrelianceonsubsection(g)whenenteringRegulatedCaliforniaWaters,orat
theearliestpracticabledatepriortoentryintoRegulatedCaliforniaWatersiffirstrelianceonsubsection(g)isless
than45daysaftertheeffectivedateofthissection,thepersonshallprovide,inwriting,theExecutiveOfficerwithan
EssentialModificationReportattestedtounderthepenaltyofperjurybytheChiefEngineeroftheperson'svessel.
TheExecutiveOfficerhas30daystoactontheEssentialModificationReport.Additionalinformationmaybe
providedbytheapplicantorrequestedbytheExecutiveofficeraftersubmittaloftheoriginalEssentialModification
Report.TheExecutiveOfficerwillhaveanadditional15daystoreviewtheadditionalsubmittalandactonthe

Thepersonshall,throughadequatedocumentation,demonstratetotheExecutiveOfficer'ssatisfactionthattheperson's
noncompliancewiththerequirementsofsubsection(e)(1)isbeyondtheperson'sreasonablecontrol.Forthepurposesof
thisparagraph,beyondtheperson'sreasonablecontrolappliesonlywhenoneormoreofthefollowingsetsof
circumstances(1,2,or3)applies:
1.UnplannedRedirection.
Thisprovisionappliesonlywhenallofthefollowingcriteriaaremet:
a.afterleavingthelastportofcall,theperson'svesselwasredirectedfromhis/heroriginal,officially
logged,nonCaliforniadestinationtoaCaliforniaport,roadstead,orterminalfacility(collectivelyport)
and
b.thevesseldoesnotcontainaquantityoffuelsufficientfortheauxiliaryengines,mainengines,and
auxiliaryboilerstomeettherequirementsofsubsection(e)(1).
2.InadequateFuelSupply.
Thisprovisionappliesonlywhenallofthefollowingcriteriaaremet:
a.thepersonmadegoodfaitheffortstoacquireaquantityoffuelsufficientfortheauxiliaryengines,
mainengines,andauxiliaryboilerstomeettherequirementsofsubsection(e)(1)and
b.thepersonwasunabletoacquirefuelsufficientforauxiliaryengines,mainengines,andauxiliary
boilerstomeettherequirementsofsubsection(e)(1).
3.InadvertentPurchaseofDefectiveFuel.
Thisprovisionappliesonlywhenallofthefollowingcriteriaaremet:
a.basedonthefuelsupplier'scertificationofthefuelspecifications,thepersonreasonablybelieved,
andreliedonsuchbelief,thatthefuelthepersonpurchasedontheroutefromthevessel'shomeportto
Californiawouldenabletheauxiliaryengines,mainengines,andauxiliaryboilerstomeetthe
requirementsofsubsection(e)(1)
b.thepersondeterminedthattheauxiliaryengines,mainengines,andauxiliaryboilersinfactwillnot

wherefuelcanbepurchasedsufficienttomeettherequirementsofsubsection(e)(1).
(B)PaymentofFees.
Uponmeetingtherequirementsofparagraph(A)inthissubsection(h)(2),thepersonshallpaythefeesforeveryport
visit,asspecifiedinsubsection(h)(5)below.
(C)ExecutiveOfficerReview.
Forthepurposesofverifyingthedemonstrationofneedasspecifiedinparagraph(A)above,theExecutiveOfficermay
considerandrelyonanyfactsorcircumstancestheExecutiveOfficerbelievesareappropriate,includingbutnotlimited
to:thefuelsupplier'sabilityorfailuretoprovideadequatefuelorderedbythepersonanymaterialmisrepresentationby
thefuelsupplierconcerningthefuelspecificationsthereasonablenessoftheperson'srelianceonfuelsupplierswitha
historyofsupplyingfuelinadequateformeetingtherequirementsofsubsection(e)(1)andforcemajeure.
(3)NoncomplianceforVesselstoBeTakenOutofServiceforModifications.
Ifapersoncannotmeettherequirementsofsubsection(e)(1)withoutvesselmodifications,andelectsnottocomply
undersection(g),andsuchmodificationscannotbecompletedpriortotheeffectivedateofsubsection(e)(1),the
ExecutiveOfficermaypermitthepersontopaythefeesasspecifiedinthissubsection.Thevesselmustbe
scheduledtocompletethenecessarymodifications(e.g.duringadrydockoperation)assoonaspossible,butno
laterthanDecember31,2014.Forthisprovisiontoapply,thepersonshallmeetallofthefollowingcriteria:
(A)DemonstrationofNeed.
ThepersonshallprovidetheExecutiveOfficeraComplianceReport,signedbytheChiefEngineeroftheperson'svessel,
which:
1.identifiesthespecificvesselmodifications(modifications)(e.g.,installationofadditionalfueltanks,fuel
coolingsystems)thepersonplanstouseformeetingtherequirementsofsubsection(e)(1)
2.identifiesthespecificdatebywhichthemodificationswillbecompleted(i.e.,whilethevesselisindry
dock)and
3.demonstratestothesatisfactionoftheExecutiveOfficerthatthemodificationswillbemadeattheearliest
possibledate(e.g.,thevesselhasbeenscheduledfortheearliestavailabledrydockappointment).
(B)PaymentofFees.
Uponmeetingtherequirementsofparagraph(A)inthissubsection(h)(3),thepersonshallpaythefeesforeveryport
visit,asspecifiedinsubsection(h)(5)below.
(C)ProofofModificationsActuallyPerformed.
Withinten(10)businessdaysafterthescheduledoractualcompletionofthemodifications,whicheveroccursfirst,the
personshallprovidewrittencertificationtotheExecutiveOfficerthatthemodificationsspecifiedunderthissubsection(h)
(3)havebeencompleted.Ifthemodificationshavenotbeencompleted,thepersonshallcertifywhichmodificationshave
beencompleted,whichhavenot,andtheanticipatedcompletiondatefortheremainingmodifications.Thenotification
requirementspecifiedinthisparagraph,thenotificationrequirementsinsubsection(h)(1)above,andthefeeprovisionsin
subsection(h)(5)belowshallapplyuntilallthemodificationshavebeencompleted.
(4)NoncomplianceBasedonInfrequentVisitsandNeedforVesselModifications.
Ifapersoncannotmeettherequirementsofsubsection(e)(1)withoutmodificationsforthevesselatissue,andelects
nottocomplyundersection(g),andthatvesselwillmakenomorethantwoCaliforniavoyagespercalendaryear,
andnomorethan4Californiavoyagesaftertheeffectivedateoftheregulation,duringthelifeofthevessel,the
ExecutiveOfficermaypermitthepersontopaythefeesasspecifiedinthissubsection.Thisprovisionterminateson
December31,2014.
(A)DemonstrationofNeed.
ThepersonshalldemonstratetothesatisfactionoftheExecutiveOfficerthatmodificationstothevesselarenecessaryto
meettherequirementsofsubsection(e)(1),andthatthevesselshallmeetthevisitationlimitsspecifiedinthissubsection
