Registration of the applied-for mark is refused because of a likelihood of confusion with the mark in U.S. Registration Nos. 4325030 and
4325031. Trademark Act Section 2(d), 15 U.S.C. 1052(d); see TMEP 1207.01 et seq. See the attached registrations.
The applied for mark is LAS VEGAS GOLDEN KNIGHTS in standard characters for use in connection with clothing, specifically,
entertainment services, namely, professional ice hockey exhibitions.
The registered mark is GOLDEN KNIGHTS THE COLLEGE OF SAINT ROSE in stylized letters with a design element for, in relevant part,
entertainment services in the form of intercollegiate sports exhibitions.
Trademark Act Section 2(d) bars registration of an applied-for mark that so resembles a registered mark that it is likely a potential consumer
would be confused, mistaken, or deceived as to the source of the goods and/or services of the applicant and registrant. See 15 U.S.C. 1052(d).
A determination of likelihood of confusion under Section 2(d) is made on a case-by case basis and the factors set forth in In re E. I. du Pont de
Nemours & Co., 476 F.2d 1357, 1361, 177 USPQ 563, 567 (C.C.P.A. 1973) aid in this determination. Citigroup Inc. v. Capital City Bank Grp.,
Inc., 637 F.3d 1344, 1349, 98 USPQ2d 1253, 1256 (Fed. Cir. 2011) (citing On-Line Careline, Inc. v. Am. Online, Inc., 229 F.3d 1080, 1085, 56
USPQ2d 1471, 1474 (Fed. Cir. 2000)). Not all the du Pont factors, however, are necessarily relevant or of equal weight, and any one of the
factors may control in a given case, depending upon the evidence of record. Citigroup Inc. v. Capital City Bank Grp., Inc., 637 F.3d at 1355, 98
USPQ2d at 1260; In re Majestic Distilling Co., 315 F.3d 1311, 1315, 65 USPQ2d 1201, 1204 (Fed. Cir. 2003); see In re E. I. du Pont de
Learning LLC, 668 F.3d 1356, 1369, 101 USPQ2d 1713, 1722 (Fed. Cir. 2012) (quoting 7-Eleven Inc. v. Wechsler, 83 USPQ2d 1715, 1724
(TTAB 2007)); TMEP 1207.01(a)(i).
Both the applicant and registrant offer entertainment in the form of sports exhibitions; the applicants exhibitions are limited to professional
hockey, while the registrants are not limited to any particular sport but are instead limited to those at the collegiate-level.
Collegiate sports and professional sports are of a similar nature, both often televised, played at the same large arenas for the entertainment of the
same class of consumers. For example, see the attached screenshots demonstrating:
St. Johns Universitys Red Stormplay many of its mens basketball games at Madison Square Garden, which is also home to the New
York Knicks (professional basketball), New York Liberty (professional basketball) and New York Rangers (professional hockey);
Georgetown Universitys Hoyas play basketball at the Verizon Center, also home to the Washington Wizards (professional
basketball), Washington Mystics (professional basketball), and Washington Capitals (professional hockey);
Connecticut Huskies (the University of Connecticuts mens hockey and womens basketball teams) play at the XL Center, also home
to the Hartford Wolf Pack, a professional hockey team;
Seton Hall Universitys Pirates(mens and womens basketball) and New Jersey Institute of Technologys Highlanders(mens
basketball) play at the Prudential Center, currently home to the New Jersey Devils (professional hockey) and former home of the New
Jersey Nets (professional basketball);
San Diego States Aztec(mens football) play games at Qualcomm Stadium, home to the San Diego Chargers (professional football),
former home of the San Diego Padres (professional baseball), and the venue for three Super Bowl games and two Major League Baseball
All-Star Games
The attached 2014 figures from Statista.com demonstrate that approximately 45% of Americans follow college sports, and that in 2014 about 29
million people attended at least one college sports event. Further, college sports are often televised, attracting more viewers than many
professional sports events. See the attached broadcast schedules and the attached articles from FootballFoundation.org (explaining the top five
cable audiences of all time were college football games) and Forbes.com (the Stanley Cup Final averaged 4 million viewers per game), and
Statistica.com 2015 NCAA basketball tournament television viewership statistics (indicating the semi-finals and finals averaged more than 12
million viewers per game). According to a 2015 Harris Poll, only 5% of surveyed American adults rate professional hockey as their favorite
sport; half of the 10% who rate college football as their favorite, and only marginally higher than the 4% who favor college basketball.
Additionally, college sports players are often drafted by professional teams. See, e.g., the attached evidence from CollegeHockeyInc.com
(listing the NHL draft picks who played college hockey), CBSSports.com (listing the schools from which the 2016 NBA draft picks originated),
and SBNation.com (listing the schools from which the 2016 NFL draft picks originated). Fans of particular athletes are therefore likely to follow
players from their college teams to professional teams.
The evidence suggests the services of both the applicant and registrant are similar in nature; consumers of sports entertainment services enjoy
both professional and collegiate-level sports, and sometimes even prefer the latter over the former. The registrants services are presumed to
include all sports played at the collegiate level, including hockey. See 15 U.S.C. 1057(b); TMEP 1207.01(a)(iii). Therefore, the services of
the applicant and registrant are considered related for the purposes of the likelihood of confusion analysis.
Considering the Factors
The overriding concern is not only to prevent buyer confusion as to the source of the goods and/or services, but to protect the registrant from
adverse commercial impact due to use of a similar mark by a newcomer. See In re Shell Oil Co., 992 F.2d 1204, 1208, 26 USPQ2d 1687, 1690
(Fed. Cir. 1993). Therefore, any doubt regarding a likelihood of confusion determination is resolved in favor of the registrant. TMEP
1207.01(d)(i); see Hewlett-Packard Co. v. Packard Press, Inc., 281 F.3d 1261, 1265, 62 USPQ2d 1001, 1003 (Fed. Cir. 2002); In re Hyper
Shoppes (Ohio), Inc., 837 F.2d 463, 464-65, 6 USPQ2d 1025, 1026 (Fed. Cir. 1988).
In this case, the marks are identical in part, sharing the same dominant wording and overall commercial impression. The nature of the
applicants and registrants services is similar; both offer sports entertainment of a kind available in the same venues, broadcast on television,
and are generally available to the same class of consumers. Accordingly, the examining attorney concludes that there is a likelihood of confusion
between the applicants and registrants marks, and registration is refused under Section 2(d).
Although applicants mark has been refused registration, applicant may respond to the refusal by submitting evidence and arguments in support
of registration. The applicant should also note the following potential ground for refusal, and the requirements which follow.
Prior Pending Applications (Advisory)
The filing dates of pending U.S. Application Serial Nos. 87089922 and 87115966 precede applicants filing date. See attached referenced
applications. If one or more of the marks in the referenced applications register, applicants mark may be refused registration under Trademark
Act Section 2(d) because of a likelihood of confusion with the registered mark(s). See 15 U.S.C. 1052(d); 37 C.F.R. 2.83; TMEP 1208 et
seq. Therefore, upon receipt of applicants response to this Office action, action on this application may be suspended pending final disposition
of the earlier-filed referenced applications.
In response to this Office action, applicant may present arguments in support of registration by addressing the issue of the potential conflict
between applicants mark and the marks in the referenced applications. Applicants election not to submit arguments at this time in no way
limits applicants right to address this issue later if a refusal under Section 2(d) issues.
Regardless of the applicants decision whether to respond to this potential refusal, the applicant must respond to the following requirement.
Disclaimer Required
Applicant must disclaim the wording LAS VEGAS because it is primarily geographically descriptive of the origin of applicants services,
and thus is an unregistrable component of the mark. See 15 U.S.C. 1052(e)(2), 1056(a); In re Societe Generale des Eaux Minerales de Vittel
S.A., 824 F.2d 957, 959, 3 USPQ2d 1450, 1451-52 (Fed. Cir. 1987); In re Joint-Stock Co. Baik, 80 USPQ2d 1305, 1309 (TTAB 2006); TMEP
1210.01(a), 1210.06(a), 1213.03(a).
Las Vegas, Nevada is a major tourist destination; according to the attached figures from the Las Vegas Convention and Tourism Authority,
tourism jobs account for 41% of the workforce for the Southern Nevada region. The Las Vegas Strip, alone, saw more than 29,000,000 visitors
in 2011, and the area saw more than 41,000,000 visitors in 2014. See the attached Wikipedia.org articles. Additionally, the attached article from
the Columbia Gazetteer of the World demonstrates that Las Vegas is the largest city in Nevada, and is one of the fastest growing cities in the
country . . . . Clearly, Las Vegas is a generally known geographic place. See TMEP 1210.02 et seq.
According to the applicants address, t he services for which applicant seeks registration will originate or otherwise be associated with Las
Vegas, and it can be presumed that purchasers are likely to believe that such services will originate there as well. See TMEP 1210.03, 1210.04
et seq.; In re Cal. Pizza Kitchen Inc., 10 USPQ2d 1704, 1706 (TTAB 1988).
An applicant may not claim exclusive rights to terms that others may need to use to describe their goods and/or services, including the
geographic origin thereof, in the marketplace. See Dena Corp. v. Belvedere Intl, Inc. , 950 F.2d 1555, 1560, 21 USPQ2d 1047, 1051 (Fed. Cir.
1991); In re Aug. Storck KG, 218 USPQ 823, 825 (TTAB 1983). A disclaimer of unregistrable matter does not affect the appearance of the
mark; that is, a disclaimer does not physically remove the disclaimed matter from the mark. See Schwarzkopf v. John H. Breck, Inc., 340 F.2d
978, 978, 144 USPQ 433, 433 (C.C.P.A. 1965); TMEP 1213.
If applicant does not provide the required disclaimer, the USPTO may refuse to register the entire mark. See In re Stereotaxis Inc., 429 F.3d
1039, 1040-41, 77 USPQ2d 1087, 1088-89 (Fed. Cir. 2005); TMEP 1213.01(b).
Applicant should submit a disclaimer in the following standardized format:
No claim is made to the exclusive right to use LAS VEGAS apart from the mark as shown.

Response Guidelines
For this application to proceed toward registration, the applicant must explicitly address each refusal and requirement raised in this Office action.
The applicant may provide arguments and/or evidence as to why any refusal should be withdrawn. To respond to requirements, the applicant
should set forth in writing the required changes or statements. If the applicant does not respond to this Office action within six months of
the issue/mailing date, or responds by expressly abandoning the application, the application process will end, the trademark will fail to
register, and the application fee will not be refunded. See 15 U.S.C. 1062(b); 37 C.F.R. 2.65(a), 2.68(a), 2.209(a); TMEP 405.04,
718.01, 718.02.
