PURPOSE 1 1, ELIGIBILITY o1 TI. THE 13" MONTH SALARY PAY-OUT 01 IV. PROCESS o I. PURPOSE To establish the criteria and the quantum for the payment of the 13" month salary to all permanent employees. ‘The 13" month salary bonus is at discretion of the Company, the Company reserves the right to qualify who are entitled to this policy. II, ELIGIBILITY The following Employees are entitled to the 13" month salary: 0 Permanent Employees (with an indefinite term labour contract or a definite term labour contract from full 12 months and more) who are on active service in the Company as of Dec 31st of the preceding year will be qualified for this payment © Permanent Employees who leave the Company before December 31* will be considered as qualification for this payment if they meet all the following conditions: > Have time in service with the Company at least full 12 months, and > Their labour contracts are terminated as a result of organisation retrenchment or as a contract expiry but either of the Parties has no requirement of contract extension. > In the case of voluntary resignation, itis at the discretion of the Company to qualify employees to this scheme on the case-by-case basis. (relied on leaving employee's performance and attitude - in which, the latest performance appraisal given by immediate superior is good with a rating of 3 points and above for both business and people results). © Employees who joined the Company after Jan 1st and have not completed the full year will be paid on a pro-rata basis. ‘© The employee whose contract is unilaterally terminated due to breach of discipline or poor performance shall not be entitled to the 13" month salary. TIT, THE 13®.MONTH SALARY PAY-OUT The quantum of 13" month salary payable each year shall be one-month base salary exclusive of overtime and all allowances based on the employee's current base salary as at 31% December of the respective fiscal year. The 13” month salary shall be pro-rated on calendar days’ basis for new hires having less than 1 full year's service as of 31° December. ‘The rounding calculation of days in odd number of service time is as follows: ‘© From O1 day to 14 days 0 month From 15 days to 31 days 1 month ‘The 13” month salary is subjected to personal income tax but exclusive of deduction of social insurance & health insurance contributions. IV. PROCESS HR Department shall be responsible for administering the 13" month salary computation in consultation with Finance Department on personal income tax and additional contributions (if any). Payment of 13" month salary will be normally made about 2 weeks prior to the Tet holidays Of the incoming year. In the case the qualified employee leaves before December 31 , the 13" month salary will be paid at the same time with severance payment.
