AFFIDAVIT OF UNDERTAKING
I, ELY M. ALBAY, of legal age, married, Filipino and a resident of
Sitio Cogon-Cogon, Brgy. Marangas, Bataraza, Palawan, Philippines,
after having been duly sworn to in accordance with law, depose and
say, to wit:
That I am legal owner of fishing boat described as M/BCA Inday
Lyn-lyn and 40 bundles of fishing nets, all were seized by PNP-Maritime
Operatives on December 5, 2016 at Sitio Aplaya, Brgy. Bono-bono,
Bataraza;
That the said fisihing boat and fishing nets are currently
impounded at the Sitio Aplaya, Brgy. Bono-bono under the custody of
Norberto P. Peria;
That I am hereby declaring my intention to obtain possession of
the said fishing boat and fishing nets above-mentioned and hereby
undertakes to take custody of the same;
That I further undertake to present the same before the court or
prosecuting authorities respecting any proceeding in relation to the
criminal complaint filed against me before the Provincial Prosecutors
Office with Docket No. IV-08-INV-16L-0795;
That Affiant voluntarily and freely executes this Affidavit to attest
to the truth and veracity of the above-mentioned statements for
purposes showing that Affiant shall undertake to show and present the
subject seized when so required by the authorities.
IN WITNESS WHEREOF, I have hereunto set my hand this 8th day
