    beforetheCourtofTaxAppeals(CTA).

    InadecisiondatedAug.16,theCTAenbancupheldthecourtsSecondSpecialDivision
    rulingdismissingthevalueaddedtax(VAT)claimofDeutscheKnowledgeServices,PTELtd.
    forthesecondtofourthquartersof2006.
    DeutscheKnowledgeServices,asubsidiaryoftheDeutscheBankgroupsPhilippineoffice,
    actsasthebankssharedservicescenterforfinance,globalbusinessservicesand
    informationtechnology.Itislicensedtodobusinessasaregionaloperatingheadquartersin
    thePhilippinesbytheSecuritiesandExchangeCommission(SEC).
    DeutscheKnowledgeServicesassertedthatthesalesitmadeduringthatperiod,whichwere
    imposedwithaP22millionVATpaidtotheBureauofInternalRevenue(BIR),issupposedly
    zeroratedforVATsinceitwassoldtononresidentforeigncorporationsdoingbusiness
    outsidethePhilippines.
    Thecompanysubmittedtothetaxcourtanauthenticatedfileshowingitsforeignclientswere
    notregisteredwiththeSECinthePhilippines,aswellasintragroupserviceagreementswith
    theseclients.
    Butthecourtfoundtheevidencelacking,affirmingthedivisionrulingthatthecompanyfailed
    tofullysubstantiatethroughdocumentaryproofitsclaim.
    TheCourtinDivisioncorrectlyruledthatwithoutproofofincorporation,associationor
    registrationinaforeigncountry,theCourtcannotsufficientlydetermineiftheallegednon
    residentforeignclientsareexisting,operatingandregisteredinaforeigncountryin
    satisfactionoftherequisitesofavalidzeroratedsaleofservices,theCTAdecisionread.
    ThetaxcourtalsoruledthatthecompanyfailedtocomplywiththerequisiteforVATrefunds
    thatpaymentsforservicesmustbeinacceptableforeigncurrencyandaccountedforin
    accordancewiththeBSPrules.
