Plaintiffs James "Jas" Prince and Young Empire Music Group LLC (collectively,
"Plaintiffs"), having moved by Notice of Motion dated April 12, 2016 for an Order granting
Plaintiffs partial summary judgment pursuant to CPLR 3212 on their breach of contract cause of
action against defendant Aspire Music Group LLC ("Aspire); and
The Court having read the following papers submitted in support of the motion by
Plaintiffs: (a) Affidavit of Jas Prince sworn to April 11, 2016; (b) Affirmation of Jethro M.
Eisenstein dated April 12, 2016 and the exhibits annexed thereto; (c) Statement of Undisputed
Facts; and (d) Memorandum of Law; and
The Court having read the following papers submitted in opposition to the motion by
Aspire: (a) Opposition Affirmation of Philip R. Hoffman dated May 12, 2016; and (b)
Memorandum of Law in Opposition; and
The Court having read the following reply papers submitted in further support of the
motion by Plaintiffs: (a) Reply Affirmation of Jethro M. Eisenstein dated May 17, 2016 and the
exhibits annexed thereto; and (b) Reply Memorandum of Law; and

The Court having heard oral argument of the motion by counsel on July 11, 2016; and
After due deliberation, it is ORDERED that, for the reasons stated on the record during
the oral argument of the motion, Plaintiffs' motion for partial summary judgment on its breach of
contract cause of action against Aspire is DENIED without prejudice.
