DON'T BOTHER TRYING
TO DODGE CHILD SUPPORT
Youd think a father of three young
children would want to keep supporting
them despite a marriage break-up. But
unfortunately thats not always the case.
In fact, occasionally the courts need to
re-emphasize that only in very limited
circumstances can a parent get out of
paying child support. Our BC appeal
court did so recently.
In 2016, Frank (all names changed)
wanted the appeal court to overturn the
latest of several court orders. This order
confirmed Frank had to pay child sup-
port and had to pay Linda, his ex, unpaid
child support arrears that he owed.
Although he could afford it, Frank ar-
gued that he shouldnt have to pay child
support because he was unemployed.
Linda, on the other hand, had a job as
an administrative assistant and earned
$40,000 to $50,000 a year, on which she
supported herself and their three kids,
aged 7, 9 and 11.
When Frank and Linda split up in early
2011, Frank earned $67,000 as a chemist.
But that job came to an end in October
that year, and Frank hadnt worked since
then. He stopped making child sup-
port payments some time after that, and
hadnt paid any child support since.
After a long trial in 2014, the trial judge
concluded Frank had not tried hard
enough to find employment. The judge
said Frank didnt have to pay child sup-
port arrears up to then. But he started
phasing in child support obligations
to give Frank time to find work. From

child support obligations on an income
of $50,000, which the court concluded
he could earn.
Frank went back to court in 2015,
having made no payments, arguing his
circumstances had changed. He tried
to get the court to cancel his arrears
and discontinue his child support
obligations going forward, as he was
still unemployed. But the court said
no he had not shown that hed made
reasonable efforts to find work, if not
as a chemist or trained scientist, then
at least some other work, even if it paid
less than he used to earn. And it wasnt
grossly unfair that he should have to pay
the outstanding arrears he owed Linda,
said the court.
Then in 2016, Frank tried yet again to
get his arrears cancelled and get out
of future child support payments (this
time, by appealing this latest court order
to the BC Court of Appeal).
But the appeal court observed that
Frank had been in contempt of previous
court orders and couldnt show that the
judge had made any legal mistakes on
the contrary, the judge had properly
explained and applied the rules about
when a child support order could be
changed. (Here, there would have had to
be a change in circumstances to change
the child support order, which Frank
couldnt prove.) The judge had also
properly applied the separate rules about
when outstanding arrears of child sup-
port could be cancelled (only if it would
be grossly unfair not to cancel them,
which wasnt the case here).

 Nelson Commons Project
Is Complete!
With the opening of its new store last December,
the Kootenay Co-ops board of directors is pleased to
announce the completion of its Nelson Commons devel-
opment project. We have been dreaming of this for a
long time, says Co-op board president Abra Brynne.
The Co-op began working on this project 10 years ago,
so it is a huge achievement in the evolution of our co-
operative to have completed the development.
Co-project managers Deirdrie Lang and Russell Pre-
cious, oversaw the project from inception to completion.
Because of Deirdrie and Russell, the Co-op now has a
beautiful new store that gives us great potential for the
future growth of our co-operative, says the Co-ops gen-
eral manager, Allan Broom. Now that the project is com-
plete, all inquiries related to the Nelson Commons and the
Kootenay Co-op should be made with general manager

In its 42nd year of operation, the Kootenay Co-op is
a member-owned grocery store in Nelson, with more
than 14,000 member-owners and 150 staff. Revenues for
2016 exceeded $14-million and donations to community
groups over the same period were close to $125,000. In
early December, the Co-op relocated to its new and larger
location at 777 Baker Street, in the Nelson Commons.
The Nelson Commons is a multi-use development, with
20,000 square feet of commercial space for the Kootenay
Co-op, additional retail spaces and 54 residential units.
The development also includes 101 parking spots and a
downtown public green space. It is the largest develop-
ment in Nelsons downtown core since the construction of
Kutenai Place, a provincial government building, in 1993.

Marjorie Hicks of Castlegar, beloved wife of 60 years to Errol Hicks, passed

away at the Talarico Place on Tuesday, January 10, 2017 at the age of 79 years.
She will be lovingly remembered by her husband Errol, children: Lisa (Terry)
Feuz of Bear Creek, NS, Darrell (Cheryl) of Nelson, BC; grandchildren: Casey
and Dylan as well as by numerous nieces, nephews, extended family and
friends. Marj was predeceased by her daughter Audrey (1963).
