FLOW OF THE CASE

We, the UNDERSIGNED Police Officers, both members of


the Philippine National Police Anti-Drug Unit, presently assigned
at the Police Station 1 of Digos City, do hereby depose and state
that:
1. We are among the members of the Digos City Police Team
who conducted a buy-bust operation at Estrada 3 rd, Digos
City near the Little Ambassadors Child Learning Center
together with the Philippine Drug Enforcement Agency
(PDEA).
2. Said operation stemmed from a report of our confidential
agent/informant Nustradamus Wagapataka for violation of
Section 5, Article II of Republic Act No. 9165 (The
Comprehensive Dangerous Drugs Act of 2002) which was
referred to our office by the informant himself against
Maryaddict Tabuyoc, 27 years of age, single, Filipino and
residing at Estrada 3rd, Digos City in front the Little
Ambassadors Child Learning Center.
3. After conducting a quick surveillance on 4 January 2016 to
ascertain the truthfulness of report made by Nustradamus
Wagapataka about Maryaddict Tabuyocs alleged drugrelated activities, we planned a buy-bust operation.
4. At around 2:45 p.m. on 6 January 2016, the undersigned
together with the informant and the PDEA team proceeded
to Estrada 3rd, Digos City to conduct a buy-bust operation.
5. Upon

reaching

Estrada

3rd,

we

immediately

spotted

Maryaddict Tabuyoc standing in front of her house.


6. The poseur- buyer approached Tabuyoc and convinced the
latter that he wanted to purchase shabu from her and gave
her the prepared buy-bust money - (3) One Hundred (P 100)
bills all marked.

7. Tabuyoc went inside her house and later reappeared with a


plastic sachet containing a white crystalline substance and
handed it to informant Wagapataka.
8. Then poseur buyer gave the pre-arranged signal of lighting
a cigarette to indicate to the rest of the team that the
operation has been consummated.
9. Thus, the rest of the team approached Tabuyoc and
proceeded to arrest her. Likewise the arrested person was
apprised

of

her

rights

as

provided

for

under

the

Constitution.

In view of the arrest, we have recovered the following

items:

a.) Marked

Money, three (3) One Hundred Peso bills all

marked with serial nos. EB10101, EB20202 and


EB30303;

b.) 0.15 grams of shabu sealed in a plastic sachet.

Tabuyoc was immediately brought to Digos City Police

Station 1 together with the recovered evidences for booking


and proper disposition.

The report of the PNP Crime Laboratory Group

Physical Identification Report No. 143-16 dated 8 January


2016

revealed

that

suspect

Maryaddict

Tabuyoc

was

POSITIVE for the presence of Bright Yellow Ultraviolet


Fluorescent powder on both palm and right dorsal portion
of the hands. (Exhibit C)

In the same day, the recovered 0.15 grams of white

crystalline powder was also brought to the Forensic


Chemist of the Philippine National Police Crime Laboratory
to confirm its classification.

14.

On 9 January 2016, the Forensic Chemist of the

Philippine National Police Crime Laboratory issued a report


with Identification No. 14344-16 (Exhibit D), identifying
the 0.15 grams of white crystalline powder as a dangerous
drug known as methamphetamine hydrochloride or shabu.
We executed this joint affidavit to attest the truthfulness of
the foregoing facts and to support the filing of Criminal Case
against Maryaddict Tabuyoc for violation of
RA 9165, Section 5 (The Comprehensive Dangerous Drugs Act of
2002) for possession and selling of illegal drugs.
