Brief Description
Penal provisions. Any person who shall practice or offer to practice
civil engineering in the Philippines without being registered in
accordance with the provisions of this Act or any person presenting
or attempting to use as his own the certificate of registration of a
registered civil engineer, or any person who shall give any false or
forged evidence of any kind to the Board, or any person who shall
impersonate any registrant civil engineer of different name or any
person who shall attempt to use a revoked or suspended certificate
of registration, or any person who shall use in connection with his
name or otherwise assume, use or advertise any title or description
tending to convey the impression that he is a civil engineer, without
holding a valid certificate of registration, or any person who shall
violate any of the provision of this Act, shall be guilty of a
misdemeanor and shall, upon conviction, be sentenced to a fine of
not less than five hundred pesos nor more than two thousand
pesos, or to suffer imprisonment for a period of not less than six
months not more than one year, or both, in the discretion of the
court.
Penalties. Any contractor who, for a price, commission, fee or
wage, submits or attempts to submit a bid to construct, or contracts
to or undertakes to construct, or assumes charge in a supervisory
capacity of a construction work within the purview of this Act,
without first securing a license to engage in the business of
contracting in this country; or who shall present or file the license
certificate of another, give false evidence of any kind to the Board,
or any member thereof in obtaining a certificate or license,
impersonate another, or use an expired or revoked certificate, or
license, shall be deemed guilty of misdemeanor, and shall, upon
conviction, be sentenced to pay a fine of not less than five hundred
pesos but not more than five thousand pesos.
Penalty for Violation. Any person, corporation or partnership found
violating Section 4 of this Decree, or the terms and conditions in the
issuance of the Environmental Compliance Certificate, or of the
standards, rules and regulations issued by the National
Environmental Protection Council pursuant to this Decree shall be
punished by the suspension or cancellation of his/its certificate or
and/or a fine in an amount not to exceed Fifty Thousand Pesos
(P50,000.00) for every violation thereof, at the discretion of the
National Environmental Protection Council.
Funding. The amount of five million pesos (P5,000,000.00) is
hereby authorized to be released from the Special Activities Fund
to cover the operating and capital expenses of the CIAP and its
implementing agencies for CY 1981, subject to Section 40 of P.D.
No. 1177.

. Penal Provision. Any person committing any of the following acts


shall, upon conviction, be sentenced by imprisonment of not less
than six (6) months, nor more than five (5) years, or a fine not less
than two thousand pesos (P2,000.00) nor more than five thousand
pesos (P5,000.00) or both, in the discretion of the Court:
(a) Engaging in the practice of environmental planning in the
Philippines without having been registered or without having
conformed to the provisions of this Decree;
(b) Presenting or attempting to use as his own the certificate of
registration of a registered environmental planner;
(c) Giving any false or forged evidence of any kind to the Board, or

impersonating any registered environmental planner;


(d) Attempting to use a revoked or suspended certificate of
registration;
(e) Using in connection with his name or otherwise assuming, using
or advertising any title or description tending to convey the
impression that he is an environmental planner without holding a
valid certificate of registration; or
(f) Violating any of the provisions of this Decree.
In case the offender is a corporation, partnership or juridical
person, the penalty of imprisonment shall be imposed on the officer
or offices responsible for permitting or causing the violation.
Section 20. Any person who shall engage in plumbing in the
Philippines without being registered in accordance with the
provisions of this Act, or any person presenting or attempting to use
as his own the certificate of registration of a registered master
plumber, or any person who shall give any false or forged evidence
of any kind to the Board, or any person who shall impersonate any
registered master plumber, or any person who shall attempt to use
a revoked or suspended certificate of registration, or any person
who shall use in connection with his name or otherwise assume,
use, or advertise any title or description tending to convey the
impression that he is a registered master plumber, without holding
a valid certificate of registration, or any person who shall violate
any of the provisions of this Act shall be guilty of a misdemeanor
and shall, upon conviction, be sentenced to a fine of not less than
five hundred pesos nor more than two thousand pesos, or to suffer
imprisonment for a period of not less than six months nor more
than one year, or both, in the discretion of the court.
Section 29. Penal Provisions. The following shall be punished by
a fine of not less than two hundred pesos nor more than five
thousand pesos, or by imprisonment for not less than six months
nor more than six years, or both, in the discretion of the Court:
(a) Any person not exempt from registration who shall practice
geodetic engineering in the Philippines within the meaning of this
Act, without holding a valid certificate of registration issued in
accordance with this Act;
(b) Any person who shall give any false or fraudulent statement to
the Board in order to obtain a certificate of registration as geodetic
engineer;
(c) Any person who shall present or use as his own a certificate of
registration issued to another under this Act:
(d) Any person who shall use a revoked or suspended certificate of
registration as geodetic engineer;
(e) Any person who shall assume, use or advertise as geodetic
engineer, or append to his name, letters or words tending to convey
the impression that he is a registered geodetic engineer when in
fact he is not duly registered with the Board as such;
(f) Any geodetic engineer, or any person on his behalf, who shall
stamp or seal any document with his seal after his certificate of
registration has expired or has been suspended or revoked;
(g) Any geodetic engineer who shall sign his name, affix his seal, or
use any other method of signature on plans, technical descriptions,
or other documents prepared by or under another geodetic
engineers supervision, unless the same is prepared in such a
manner as to clearly indicate the part or parts of such work actually
performed by the former;
(h) Any person, except the geodetic engineer in charge, who shall
sign for any branch of the surveying work, or any function or
surveying practice not actually performed by him; and

(i) Any person who shall violate any provision of this Act.
Section 12. Penalties.
(a) ADMINISTRATIVE FINE Any person who violates any provision
of the Fire Code or any of the rules and regulations promulgated
under Section 6 hereof shall be penalized by an administrative fine
of not exceeding twelve thousand (P12,000.00) pesos or in the
proper case, by stoppage of operations or by closure of such
buildings, structures and their premises or facilities which do not
comply with the requirements or by both such administrative fine
and closure/stoppage of operation to be imposed by the Director
General, Provided, That the payment of the fine, stoppage of
operations and/or closure of such buildings, structures, and their
premises or facilities shall not absolve the violator from correcting
the deficiency or abating the fire hazard. The decision of the
Director General, under this subsection, may be appealed to the
Secretary of National Defense, within fifteen (15) days from the
date of receipt of the order imposing the administrative fine,
stopping the operations and/or closure. The decision of the
Secretary of National Defense shall be final and executory.(b)
PUNITIVE In case of willful failure to correct the deficiency or abate
the fire hazard as provided in the preceding subsection, the violator
shall, upon conviction, be punished by imprisonment of not less
than six (6) months nor more than six (6) years, or by a fine of not
more than twenty thousand (P20,000.00) pesos or both such fine
and imprisonment; Provided, however, that in case of a corporation,
firm, partnership or association, the fine and/or imprisonment shall
be imposed upon its officials responsible for such violation, and in
case the guilty party is an alien, in addition to the penalties herein
prescribed, he shall immediately be deported; Provided, finally, that
were the violation is attended by loss of life and/or damage to
property, the violator shall be proceeded against under the
applicable provisions of the Revised Penal Code.

Section 213. Penal Provisions. It shall be unlawful for any person,


firm or corporation, to erect, construct, enlarge, alter, repair, move,
improve, remove, convert, demolish, equip, use, occupy, or
maintain any building or structure or cause the same to be done
contrary to or in violation of any provision of this Code. Any person,
firm or corporation who shall violate any of the provisions of this
Code and/or commit any act hereby declared to be unlawful shall
upon conviction, be punished by a fine of not more than twenty
thousand pesos or by imprisonment of not more than two years or
by both such fine and imprisonment: Provided, that in the case of a
corporation firm, partnership or association, the penalty shall be
imposed upon its officials responsible for such violation and in case
the guilty party is an alien, he shall immediately be deported after
payment of the fine and/or service of his sentence.
