Brief Description
Penal provisions. Any person who shall practice or offer to practice
civil engineering in the Philippines without being registered in
accordance with the provisions of this Act or any person presenting
or attempting to use as his own the certificate of registration of a
registered civil engineer, or any person who shall give any false or
forged evidence of any kind to the Board, or any person who shall
impersonate any registrant civil engineer of different name or any
person who shall attempt to use a revoked or suspended certificate
of registration, or any person who shall use in connection with his
name or otherwise assume, use or advertise any title or description
tending to convey the impression that he is a civil engineer, without
holding a valid certificate of registration, or any person who shall
violate any of the provision of this Act, shall be guilty of a
misdemeanor and shall, upon conviction, be sentenced to a fine of
not less than five hundred pesos nor more than two thousand
pesos, or to suffer imprisonment for a period of not less than six
months not more than one year, or both, in the discretion of the
court.
Penalties. Any contractor who, for a price, commission, fee or
wage, submits or attempts to submit a bid to construct, or contracts
to or undertakes to construct, or assumes charge in a supervisory
capacity of a construction work within the purview of this Act,
without first securing a license to engage in the business of
contracting in this country; or who shall present or file the license
certificate of another, give false evidence of any kind to the Board,
or any member thereof in obtaining a certificate or license,
impersonate another, or use an expired or revoked certificate, or
license, shall be deemed guilty of misdemeanor, and shall, upon
conviction, be sentenced to pay a fine of not less than five hundred
pesos but not more than five thousand pesos.
Penalty for Violation. Any person, corporation or partnership found
violating Section 4 of this Decree, or the terms and conditions in the
issuance of the Environmental Compliance Certificate, or of the
standards, rules and regulations issued by the National
Environmental Protection Council pursuant to this Decree shall be
punished by the suspension or cancellation of his/its certificate or
and/or a fine in an amount not to exceed Fifty Thousand Pesos
(P50,000.00) for every violation thereof, at the discretion of the
National Environmental Protection Council.
Funding. The amount of five million pesos (P5,000,000.00) is
hereby authorized to be released from the Special Activities Fund
to cover the operating and capital expenses of the CIAP and its
implementing agencies for CY 1981, subject to Section 40 of P.D.
No. 1177.

(i) Any person who shall violate any provision of this Act.
Section 12. Penalties.
(a) ADMINISTRATIVE FINE Any person who violates any provision
of the Fire Code or any of the rules and regulations promulgated
under Section 6 hereof shall be penalized by an administrative fine
of not exceeding twelve thousand (P12,000.00) pesos or in the
proper case, by stoppage of operations or by closure of such
buildings, structures and their premises or facilities which do not
comply with the requirements or by both such administrative fine
and closure/stoppage of operation to be imposed by the Director
General, Provided, That the payment of the fine, stoppage of
operations and/or closure of such buildings, structures, and their
premises or facilities shall not absolve the violator from correcting
the deficiency or abating the fire hazard. The decision of the
Director General, under this subsection, may be appealed to the
Secretary of National Defense, within fifteen (15) days from the
date of receipt of the order imposing the administrative fine,
stopping the operations and/or closure. The decision of the
Secretary of National Defense shall be final and executory.(b)
PUNITIVE In case of willful failure to correct the deficiency or abate
the fire hazard as provided in the preceding subsection, the violator
shall, upon conviction, be punished by imprisonment of not less
than six (6) months nor more than six (6) years, or by a fine of not
more than twenty thousand (P20,000.00) pesos or both such fine
and imprisonment; Provided, however, that in case of a corporation,
firm, partnership or association, the fine and/or imprisonment shall
be imposed upon its officials responsible for such violation, and in
case the guilty party is an alien, in addition to the penalties herein
prescribed, he shall immediately be deported; Provided, finally, that
were the violation is attended by loss of life and/or damage to
property, the violator shall be proceeded against under the
applicable provisions of the Revised Penal Code.
