(Mindray) you understand and accept all the terms and
conditions of this Legal
Notice. You agree that this Legal Notice is binding and
enforceable on you at your
sole and free will. If you do not agree, do not download,
install or otherwise use the
relevant product documentation or software. Any violation
of the terms and conditions
contained herein shall result in legal liabilities and
Mindray is entitled to take any
legal action for any compensation resulting from or in
connection with your violation.
Any product documentation and software provided by
Mindray that is made available
solely for software upgrade for Mindray products
purchased by you or authorized by
Mindray according to the terms and conditions herein. No
other use of this product
documentation and software is authorized. As a condition
of use, you agree not to
modify or revise any of the documentation or software in
any manner and to retain all
copyright and other proprietary notices as contained in
the same, and you further

agree to keep record for every software upgrade and

provide such records to Mindray
service engineer upon request. The records shall include
without limitation the
upgraded products serial no, software edition of preupgrade and after upgrade.
Any product documentation and software provided by
Mindray are the intellectual
property of Mindray and is solely owned by Mindray. Any
copy, reproduction,
photocopy, disclosure, resale, conveyance or otherwise
redistribution of the product
documentation and software, and/or any provision of
your personal account number
and passport to any other unauthorized people or any
sharing account with the
unauthorized people without prior written authorization
from Mindray is expressly
prohibited.
Mindray hereby disclaims all warranties and conditions
with regard to the product
documentation and software including all warranties and
conditions of merchantability,
whether express or implied, fitness for a particular
purpose, title and non
infringement. In no event shall Mindray be liable for any
special, indirect or
consequential damages or any damages whatsoever
resulting from loss of use, loss of
profits or expenses suffered whether in an action of
contract, negligence or other
tortuous action, arising out of or in connection with the

use or performance of the

software, documentation, provision of or failure to provide
services, or information
available from the services provided by Mindray.
The Legal Notice shall enter into force upon your
agreement of the terms and
conditions indicated in the first written. Any matters not
stipulated in this Legal
Notice will take as reference the provisions of the state
laws or regulations. If this
Legal Notice contains provisions differing from those
contained in the state laws or
regulations, the provisions of the state laws or regulations
shall apply. All rights to the
Legal Notice, amendment, update and final interpretation
hereof shall be reserved by
Mindray.
