Sroxane, Wastinoron 99201 509.625.6742 Fax 509.625.6748 January 31, 2017 Assistant Chief Lundgren Spokane Police Division 1100 West Mallon Spokane, Washington 99260 RE: Refuse to certify 1A C16-044/OPO #16-16 Dear Assistant Chief Lundgren, Pursuant to SMC §04.32.030(F), the Office of the Police Ombudsman (“OPO”) reviewed Internal Affairs (“IA”) investigation C 16-044/OPO #16-16 for certification. Here, the complaint originated from the OPO against a non-officer employee of the Spokane Police Division (“SPD”). Once the OPO submitted the complaint to IA, it was never returned for certification. Lt. Braun, then head of IA, noted in his BlueTeam comments, “no need for OPO certification due to the accused employee not being within the OPO’s purview.” This case only came to my attention as part of my office’s year-end review. By ordinance, the first function of the OPO is to actively monitor all police department. OPO Involved Investigations. See Spokane Municipal Code §04.32.030. Per the definition of OPO Involved Investigations, OPO’s purview is expanded from not only commissioned members but also include allegations that an SPD employee acted improperly. See SMC §04.32.020(L). Further, the OPO also provides policy makers with recommendations on improvements to SPD on policy-related issues, which includes hiring and training practices. See SMC §04.32.010(A)(3) and §04.32.020(M). Here, the complaint against an SPD employee who is not a commissioned member still falls under OPO's purview. Additionally, the complaint involved the SPD hiring process, which also falls under OPO’s purview. Furthermore, this case originated from the OPO. IA should have sent some type of formal response to notify the OPO on the disposition of the case. However, because | was not provided the opportunity to review this case for certification, | cannot certify it. Lastly, this case was filed more than the 180 day window for discipline; it cannot be reopened for certification.
