EXTRADITION CASE OF NANDANEE SOORNACK ~ PRESS RELEASE MILAN/LONDON, 8 February 2017 - We consider appropriate to make some clarifications / mise au point about the extradition case of our client, Ms. Nandanee Soornack. The Sixth Criminal Division of the italian Supreme Court (Corte di Cassazione) on 3 February 2017 declared the total inadmissibiity of the appea lodged by the Mauritius Goverment against the decision of the Court of Appeal of Bologna. At this time, only the operative part of the judgment is available, so we cannot take a position on the reasons of the decision. Given that itis a judgment of ‘inadmissibilty’, itis reasonable to assume that the Supreme Court had upheld the plea about the lackof the reciprocity between Italy and Mauritius or the plea about the lateness of the intervention of the Mauritius Goverment in the procedure before the Court of Bologna. Inany case, itis also possible that the Supreme Court has ruled on the substance of the matter. ‘We want also to clarify that itis not correct to say —as stated by Professor Saccucci ~that “the legal ‘arguments raised by the Government of Meuritius remained completely unanswered” Itis to be noted that in this mattera judgment was pronouncedin September 2016 by the Court of, Bologna. Considering that the Supreme Court has ruled that the appeal is totaly inadmissible, the judgment of the Court of Bologna isthe final decision. During the proceedings before the Court of Bologna, the Mauritius Government has been able to participate directly (through a legal brief filed by the Attorney-General of the Mauritius Government, Hon. Ravi Yerrigadoo) and through anitalian Lawyer, and submit its arguments to the judges. The Court of Bologna, after having heard and analyzed the arguments raised by the Mauritius Government, entirely rejected them stating «muttiple reasons to deem that the person whose extradition has been requested will be subject to persecutory and discriminatory acts due to her political opinions or personal or social circumstances». The Court of Bologna has highlighted a high risk of ciscrimination against Ms. Soornack considering, that in the "Mauritius 2015 Human Rights Report” published by the State Department of the United ‘States on 13 April 2016, serious violations of human rights are noted specifically concerning cases Subject to this extradition proceeding.
