REPORT OF THE COMMITTEE ON TOURISM, TRADE AND INDUSTRY ON THE COMMON
MARKET FOR EASTERN AND SOUTHERN AFRICA TREATY (IMPLEMENTATION) BILL,
2016.
1.0 Introduction
The Common Market for Eastern and Southern Africa Treaty
(Implementation) Bill, 2016 was read for the first time at the 19th Sitting of
the 1st Meeting of the 1st Session of the 1Qth Parliament held on
Wednesday 24th August, 2016. The Bill was referred to the Committee on
Tourism, Trade and Industry in accordance with Rule 118 ( 1) of the Rules of
Procedure of Parliament for. consideration.
In considering the Bill, the Committee was guided by Rule 118 of the Rules

of Procedure of Parliament .
Methodology
In the process of scrutinizing the Bill, the Committee met and received
memoranda from the following stakeholders:
{i) give the force of law in Uganda to the Treaty Establishing the
Common Market for Eastern and Southern Africa (COMESA)
adopted in Kampala on the 5th day of October, 1993 and ratified
by Uganda in October 1994;

(ii) provide for financial prov1s1ons consequential upon Uganda's
membership of the. Common Market for Eastern and Southern
Africa;
-4.1 The Common Market for Eastern and Southern Africa Treaty
(b) Article 3 of the COMESA Treaty sets out the aims and objectives of the
Common Market as follows:
(i)
(ii)
to attain sustainable growth and development of the Member
States by promoting a more balanced and harmonious
development of its production and marketing structures;
was effected through the Finance Act 2014. The Finance Act, 2014
under Section 3 provides for the removal of import duty on goods
produced or manufactured in a territory of a COMESA Member State
where the goods comply with Article 48 of the COMESA Treaty and the
rules of origin under the Treaty. The removal of import duty however
only applies to a CO MESA Member State that grants the same level of
preference to qualifying Uganda exports.
The Committee was however informed by the Private Sector that in order
for Uganda to take advantage of its membership in COMESA, there is
need for the Government of Uganda to address challenges that affect

Recommendations
In analyzing the Bill, the Committee considered the effect of the clauses of
the Bill on the implementation of the COMESA Treaty.
Definition of "Minister".

Recommendation
The Committee recommends that the Bill clearly provides for Minister
responsible for trade as the responsible Minister for overseeing the
implementation of the CO MESA Treaty (Implementation) Bill.
Clause 9 of the Bill provides that there shall be charged on and paid out
of the Consolidated Fund any payment required to be made by the
Government of Uganda under the Treaty.
Article 166 of the COMESA Treaty provides for the budget of the
Secretariat whose resources are derived from annual contributions of the
Member States and such other resources as may be determined by the
Council.
Recommendation
(c) Competition
Under Article 55 of the COMESA Treaty, Member States agree that any
practice which negates free and liberalized trade shall be prohibited. They
also agree to prohibit any agreement between undertakings or concerted
practices which affect the prevention, restriction or distortion of
competition within the Common Market. In order to achieve this, the
COMESA Competition Regulations were made in 2004 as a legal framework
for the regulation of competition in the Common Market. Consequently, a
COMESA Competition Commission was put in place in 2013.
The Committee observes that Uganda has no law on competition. This has
resulted into de-industrialization, increased trade gaps, market
monopolization by few companies due to anti-competitive practices like
price fixing, market sharing, among others.
Recommendation
(a) by the Cabinet in the case of any treaty other than a treaty referred to
in paragraph (b) of this section; or
