    TheappellatecourtissuedtheTROonMonday,February13.

    ThiswasthesecondtimeDegamowasordereddismissedbytheOfficeof
    theOmbudsmanoverthesamecomplaint:thatheallegedlymisusedP480millionworthof
    calamityfundsin2012.

    SlammingtheOmbudsmanforallegedlybeing"biased,"thegovernorpointedoutthatitwasa
    caseofdoublejeopardyastheCAhadalreadydismissedthesamecomplaint.

    DegamoaddedthattheCAreversedtheOmbudsmanrulingbecausehewascoveredbythe
    socalledAguinaldodoctrine,alegalprinciplewhicheffectivelyabsolvesanelectedofficialof
    anyadministrativeliabilityduringhisprevioustermifhegetsreelectedtohispost.

    ThegovernorstressedthatthedecisionoftheCAshouldprevailbecauseitisthesecond
    highestjudicialcourtaftertheSupremeCourt.

    Degamosaidhewillstayinofficeashewasnotservedwiththedismissalorderbytheinterior
    department.Healsoexpressedconfidencethathewillbeabletosecureapermanentinjunction
    fromtheCAafter60days.

    OnJanuary27,DegamosurrenderedtotheantigraftcourtSandiganbayanafterhisarrest
    orderformalversationandgraftchargescameout.

    HealsopostedabailofP1.115millionaftertheSandiganbayanapprovedhisrequestfor
    reductionofbail.

    ThecourthadsetP200,000baileachforthe11countsofmalversationandP30,000forgraft,or
    atotalofP2.23million.

    ThechargesagainstDegamostemmedfromhisallegedmisuseofthecalamityfundmeantfor
    therehabilitationofinfrastructuredamagedbyTyphoonSendonginDecember2011andthe
    earthquakeinFebruary2012inNegrosOriental.

    ButthebudgetdepartmentlaterwithdrewtheSpecialAllotmentandReleaseOrdersduetonon
    compliancewiththeguidelinesforinfrastructureprojects.TheCommissiononAuditalsoissued
    11noticesofdisallowance.

    Degamo,however,proceededwiththeprojectandawardedP143.2millionworthofcontracts
