AFFIDAVIT

I, Cristina Salvatierra, Filipino, 35 years of age, with residence at Block 1, Lot 3,

Pearl Drive, Cabantian Country Homes, Buhangin, Davao City, after having been
duly sworn in accordance with law, hereby depose and state:

1. That I, Cristina Salvatierra, am the widow of Candido Salvatierra and the

mother of herein complainant, Marilyn Salvatierra and her younger brother,
Mario Salvatierra;

2. That my daughter Marilyn was born on September 26, 2006 in Isabela

Province;

3. That herein respondent Roderick Rody Mesias is my paramour since January

of 2014 and that we have been living together as a family with my daughter
in Block 1, Lot 3, Pearl Drive, Cabantian Country Homes, Buhangin, Davao
City beginning July of 2014 and my children treated him as their stepfather;

4. That on April 8, 2016, I was at my parents house in 31-B Mercury Street,

GSIS, Matina Davao City since I needed to tend to my father who was sick at
that time. I spent two nights at my parents house and only returned to our
house in Buhangin, Davao City on April 10, 2016;

5. That when I returned to our house, I noticed that my daughter Marilyn was
acting strangely and was aloof towards Rody, whereas before I left they were
really close;

6. That I noticed that my son Mario was also behaving oddly and seemed afraid
of Rody, whereas before they were also close;

7. That on April 15, while Rody was out at work, I confronted my children and
asked them why they were suddenly acting strangely and why they seemed
afraid of their stepfather Rody;

8. That my daughter Marilyn, after an initial reluctance, suddenly cried and

narrated the harrowing details of Rodys act of raping her while I was not in
the house, to wit:

a. That on April 8, 2016, she and her brother were soundly sleeping on
the floor when they were awakened by Rodys sudden entrance to the
room at about 10:00 PM;

b. That Rody suddenly pulled her hair and dragged her near the rooms
door while covering her mouth;

c. That Rody started to undress her, while saying wag kang maingay
papatayin ko kapatid mo;
 d. That at this point, Mario started coming to Marilyns aid and started
trying to punch and kick Rody;

e. That Rody got mad and tied a handkerchief upon Marilyns mouth then
proceeded to hogtie Mario with a straw rope in the room and strapped
him on to a post, also tying a handkerchief upon his mouth;

f. That when Mario was already helpless and could not move, he
proceeded to remove Marilyns undergarment and started inserting his
finger into her vagina;

g. That on this point, Marilyn started crying because of the pain she felt
because of the insertion of the object;

h. That Rody also started to remove his pants and undergarment;

i. That there was a sudden sound coming from outside the house which
seemed that there was a person nearby;

j. That at this point, Rody stopped what he was doing and left the room

9. That I asked Mario whether this was true and Mario affirmed the narration of
the events;

10.That on the same day on April 15, 2016, upon finding out what happened and
after recovering from the shock of this news, I immediately went to the Davao
City Medical Center with my children in order to have my daughter tested for
injuries;

11.That the medical certification indeed showed lacerations in my daughters

reproductive organ;

12.That during the night of April 15, 2015, when Rody came home from work I
confronted him regarding the incident and he denied the incident, saying that
he was already sleeping by 11 PM and makulit yang anak mo masyado
pinalo ko yan nung araw na yun dahil napakalikot at napakaingay;

13.That I said that I did not believe him and showed to him the medical
certificate and he threatened to hurt me if I will not stop interrogating him
about the issue;

14.That in order to protect myself and my family, I hurriedly left the house with
my children and we went to stay at my parents house in Matina, Davao City;

15.That on April 16, 2016, we proceeded to the Davao City Police Station to
report the crime and seek assistance to formally file charges of rape against
Roderick Rody Mesias.
