Gordonischairmanofthecommitteeonjusticeandhumanrightswhichisdeliberatingon
pendingbillscallingfortherestorationofdeathpenalty.
Drilonsaidthematterofplunderbeingincludedinthecoveredcrimesunderdeathpenalty
lawshouldnotbeanissueascapitalpunishmentshouldnotberestored.
Formedeathpenaltyshouldnotbeimposed,regardlessofwhethertheplunderisthereor
not,Drilonsaid.
Thisisduetothedefectsofourjusticesystem.Ialsobelievethatthereisnocertaintyofthe
penaltybeingadeterrenttocrime,headded.
Basedontheargumentsofthoseagainstthedeathpenaltybill,theytoldthesenatorsthat
thereisnoprovisionintheSecondOptionalProtocoltotheInternationalCovenantonCivil
andPoliticalRightswhichthePhilippinesratified,thatallowsthecountrytowithdrawfromits
commitment.
ThesaidtreatycommittedthePhilippinesnottoimposethedeathpenalty.
Interminatingorabrogatinganytreatyoranyinternationalagreement,Drilonsaiditshould
havetheconcurrenceoftheSenateandsuchconcurrencewouldrequireavoteofatleast
twothirdsofallthemembersoftheSenate.
ThepowertobindthePhilippinesbyatreatyandinternationalagreementisvestedjointlyby
theConstitutioninthePhilippinesandtheSenate,Drilonsaid.
Enoughtimetoreviewbill
Wehavegiveneveryoneenoughtime.Thisbillhadbeenthoroughlydebateduponasithad
beenfiledsincetheopeningofCongresslastyear,saidAlvarezashelamentedonthe
allegeddelayingtacticsbeingemployedbythoseopposingthemeasure.
Whilewehavesubjectedthebilltoadebatebetweentheproponentsandopponents,we
couldnothelpbutnoticethoseopposingthebillaresimplyemployingdelayingtacticswe
couldnolongerdebateonthemeasure,Alvarezstressed.
AccordingtoAlvarez,theycannotwaittofinishtheinterpellationofabout50lawmakerswho
registeredforinterpellationasthereareotherimportantmeasuresthatneedtobediscussed
intheplenary.
HouseBill4727seekstoreimposethedeathpenaltyonmorethan20heinouscrimes.
Earlier,Alvarezsaidsolonsagreedtosoftenthebillbynotmakingthedeathpenalty
mandatory.
AlvarezhasbeenstressingthatsincethedeathpenaltyisoneoftheprioritiesofMr.Duterte,
administrationalliesareexpectedtosupportit.
HeevenorderedtheremovaloftheDeputySpeakers,committeechairmenandmembersof
thePDPLaban,whoareantideathpenalty,fromallianceshouldtheyvoteagainstthebill.
However,membersoftheindependentblocledbyAlbayRep.EdcelLagmanvowedtheywill
notallowthebilltobeexpedited.
Lagmanslammedtheadministrationforimposingdeadlineandarmtwistingwhichisnotpart
ofthedemocraticprocess.
Thereshouldbenodeadline.Letthedebategoon,Lagmansaid.

Legislatorswhoexcludedplunderfromthecrimespunishablebythependingdeathpenalty
billarejustafraidonitsconsequenceamongthemselves,aseniorPalaceofficialsaid
yesterday.
ChiefPresidentialLegalCounselSalvadorPanelotoldreportersinachanceinterviewatthe
Palacethatifhestobeconsulted,plundershouldbeincludedinthecrimespunishableby
deathsayingthatitsaheinoustostealmoneyfromthepeople.

theyareopentosettledifferenceswiththePresidentwhohasbeenfiringverbaltirades
againstChurchleaderswhoweresaidtobefullofshitasfarasMr.Duterteisconcerned.

TheCBCP,moreover,willbeleadingaprotestactioncalledwalkforlifeonSaturdaythat

AmusementandGamingCorporation(Pagcor)andVanderwoodManagementCorp.

ThediscoveryoftheallegedlyanomalousdealpromptedtheSpeakertoproposethe
restorationofthecrimeofplunderasamongthosetobeincludedinthecrimeslistedunder
theproposedDeathPenaltyBill.
Inresponsetotheinquiryonwhatlegislationshouldwepropose,now,Mr.Chairman,with
morereasonthatIwillpursuethattheoffenseofplunderbeincludedinthedeathpenalty,
Alvarezsaid.
HetaggedformerPagcorchairmanCristinoNaguiatandmembersoftheboard,aswellas
formerGovernmentCorporateCounselRaoulCreenciawhogavethegosignaltothedeal.
Alvarezalsourgedthecommitteetosubpoenaofficialsoftheoriginallesseeoftheproperty
OceanvilleHotelandSpaCorporation,namelySimonPaz,CornelioAldonandMario
Leabres,whosnubbedyesterdayshearingoftheHousecommittee.
Amongothers,AlvarezwantstofindoutwhyOceanvillesubleasedthepropertyto
VanderwoodforonlyP300,000amonth,thesameamountitpaystotheCityofManilawhich
ownstheproperty.
HesaidcurrentPAGCORofficials,headedbyChairmanAndreaDomingo,willalsolikelybe
liableforplunderiftheypushedthroughwiththeVanderwooddealdespitetheCOA
disallowance.
Withtheamountofgovernmentmoneytheyhavewasted,itsdefinitelyplunder,Alvarez
said.
Duringthehearing,AlvareznotedthatPagcoragreedtopayP13millionpermonthto
Vanderwood,whichpaysOceanvilleP300,000amonthleaseforapropertyintendedfor

P13millionamonthrentalforanonexistentfacility?Youaremakingthegovernmentpay

government,AlvareztoldNaguiatduringthehearing.
Forhisdefense,NaguiatsaidtheyaskedfirsttheopinionoftheOGCC(Officeofthe
GovernmentCorporateCounsel)beforepushingthroughwiththedeal.Inturn,Creenciasaid
hegavePagcorthediscretiontogoaheadwiththecaveatthattheyshouldensurethereare
nolegalimpedimentsagainstit.
Alvarez,inaninterviewafterahearingbythegoodgovernmentpanelsaidthatwhenthe
factsareclearlyestablishedthemembersofthepanelshouldfileacomplaintagainstformer
PAGCORofficials.
Afterallthehearings,ifitwouldbepossible,thatmembersofthepanelshouldfilea
complaintagainstPAGCORofficials,Alvarezsaid.
