Official Information Act request
Thank you for your email of 16 Octaber 2014 requesting, under the Official
Information Act 1962 (the Act), information about the Prime Minister, the Rt Hon
John Key.
You have asked whether Mr Key holds duel citizenship and is also a citizen of the
United States of America. | am aware that Tania Warburton's previous respanse
to the same request by Ms Anita Bocchino has been posted online.
As per Ms Warburton's response, | am refusing your request under section 18(a)
of the Act on the basis that the Ministry does not hald this information and we
have no grounds for believing itis held by another agency or Minister in its! his or
her official capacity,
As thore appears to have been some confusion regarding the previous respanse,
| will elaborate on the reasoning behind it.
in compiling the previous response, we consulted the Department of Internal
Affairs (DIA) and the Department of the Prime Minister and Cabinet (DPMC). DIA
advised that it did not generally hold information about New Zealand born
citizens’ immigration status in other countries. DPMC also advised that it did not
hold the information requested.
Mr Key will obviously know whether he is also a citizen of the United States of
America. However, he does not hold this information in his capacity as the Prime
Minister or in relation to any of his other portfolios. Consequently, he does not
hold it for the purposes of the Act.
You have right, under section 28(3) of the Act, to ask the Ombudsman to
investigate and review my decision to refuse your request
