RE: Five-Day Report on February 15, 2017 Officer-Involved Shooting

An officer-involved shooting occurred on February 15, 2017 on Glenbrook Drive.


The North Carolina State Bureau of Investigation is currently conducting an
independent investigation into any potential violations of law by the involved
officers, which is standard procedure in such cases. Upon the conclusion of their
investigation, the SBI will present their findings to the Durham County District
Attorneys Office. The Durham Police Departments Professional Standards Division
is conducting an administrative investigation to ensure that all departmental policies
and procedures were followed. The investigations are ongoing and, as they develop,
are expected to uncover details which have yet to be determined such as how the
encounter evolved, the number of shots fired and autopsy findings. Based upon initial
statements from responding officers and reports from the Durham 911 Center, a
preliminary review of this incident indicates the following:

Cpl. J.E. Lloyd, Officer T.M. Greathouse and Officer A.G. DMeza, who are assigned
to the Durham Police Departments Selective Enforcement Team (SET), went to 2512
Glenbrook Drive around 2:15 p.m. to attempt to serve an order for arrest on 24-year-
old Kenneth Lee Bailey Jr., which had been issued earlier that day through the
Durham County Criminal Justice Resource Center, based on Bailey violating his
pretrial release conditions. He was awaiting trial on August 2016 charges of robbery
with a dangerous weapon and felony conspiracy in which he was accused of pointing
a gun at the victims chest during robbery.

According to initial reports, the officers, who were wearing tactical raid vests with the
word POLICE on the front and back, knocked on the front door of 2512 Glenbrook
Drive, where they believed Bailey was at the time. There were four people, including
Kenneth Bailey Jr., inside the house. Bailey ran out a side door and crossed the street
with the officers in pursuit.

A SET officer told 911 dispatchers they were in a foot chase. Based on 911 radio
traffic, approximately 20 seconds later, the officer said, Ive got shots fired. Ive got
a man down. The officer immediately requested EMS. The initial police report
indicated, The man that was running pulled a handgun and was shot by a police
officer.

The SET officer radioed for additional units and again for EMS. He also said officers
were starting to perform CPR on the man. One of the first responding patrol officers
reported that he saw Officers Greathouse and DMeza performing CPR. An EMS
crew arrived on the scene within four minutes. Bailey was pronounced dead at the
scene.

DPDs Victim Services Unit and chaplains from the Emergency Chaplains
organization responded to the scene to provide community support.

After the incident, officers canvassed the neighborhood and spoke with residents to
gather additional information. According to police reports, one person told officers he
heard three shots and another person told officers he saw Mr. Bailey throw a black
gun back toward the street. A third person told officers that the officers had asked
the suspect to drop his weapon several times before the officers fired their weapons.
This person also told officers he heard three shots.

The gun, a .45-caliber handgun, which was reported stolen in Durham in December
2016, was found near the body.

Officer Greathouse joined the DPD on September 8, 2003. Officer DMeza joined the
DPD on August 21, 2006 and Cpl. Lloyd joined the DPD on August 17, 2005. All
three officers have been placed on administrative leave with pay, which is standard
following an officer-involved shooting.
