With today expected to be
this summer’s hottest day so
far, heat exhaustion and heat
stroke are a concern. Though
the forecast calls for a high
temperature in the mid-90s,
the world does not stop; many
work outside and others may
work in buildings that are not
air-conditioned.
Delphos Fire and Rescue
Chief Dave McNeal says one
should do as much as pos-
sible to remain cool and well-
hydrated. That could range
from staying inside to staying
in the shade but everyone
should drink water through-
out the day.
“People need to stay inside
if they can. Stay cool and
drink plenty of fluids — pref-
erably water. If you have to
do yard work, do it early in
the morning and if you work
in a factory that isn’t air-con-
ditioned, you may need extra
breaks if you can. People
should stay out of the mid-
day sun from 10 a.m. to 2
p.m. because that’s when the
sun is the hottest,” he said.

glass of water and take it

“There are signs of heat
exhaustion from weakness
and vomiting to heavy sweat-
ing and heavy thirst — it’s
normal activity that becomes
exaggerated. Heat stroke is
more serious. The system
starts to shut down; the ther-
mal regulator in the body
says ‘oops, we’ve thrown a
circuit breaker here and we’re
shutting down.’ That’s when
sweating stops and the body
gets extra-hot. These are peo-
ple who need medical atten-
tion because they have to be
cooled down in a prescribed
way,” he said.
Heat stroke can be fatal;
the body can no longer dis-
sipate heat when the person
becomes dehydrated. Infants,
the elderly and people work-
ing in the heat are most sus-
ceptible. Precautions must be
taken.

tion, five students from St.
John’s High School made a
10-day visit to Europe.

Though the “Buckeye
State” is uncomfortably hot
and humid, the Eastern cor-
ridor is in the nation’s worst

Their tour through Italy
involved seeing the Leaning
Tower of Pisa, sightseeing
in Florence and touring the
Coliseum and the Roman
Forum. One of the highlights
in Rome was visiting Vatican
City.
“It was wonderful to be
able to take my students
to the seat of the Catholic
Church. Going through the
massive St. Peter’s Basilica
and witnessing the genius of
Michelangelo in the Sistine
Chapel was a dream of mine.

also liked meeting new peo-
ple and being able to share
the experience with every-
one,” Mohler said.
While traveling, the stu-
dents not only saw important
landmarks of the world but
were able to learn from their
experiences with different
cultures.
“It made me realize that
not everyone in the world
is the same and we all have
our own way of living. If
anyone has the opportunity to
go to Europe, don’t hesitate
because it is the experience
of a lifetime and you won’t
regret it,” Kline said.

Oil trouble for
Lake Pontchartrain

NEW ORLEANS — Oil
from the ruptured well in the
Gulf of Mexico is seeping
into Lake Pontchartrain north
of New Orleans, threatening
another environmental disas-
ter for the huge body of water
that was rescued from pollu-
tion in the 1990s.
The lake rebounded then
to once again become a boun-
tiful fishing ground and a
popular spot for boating and
swimming.
“Even the people involved
in the restoration didn’t
believe it could be restored.
It was completely written
off. It was thought to be an
impossible task,” said John
Lopez, a scientist with the
Lake Pontchartrain Basin
Foundation, which led the
restoration effort. “It has been
a dramatic turnabout.”
It is threatened again after
a weekend when tar balls
and an oil sheen pushed by
strong winds from faraway
Hurricane Alex slipped past
lines of barges that were sup-
posed to block the passes con-
necting the Gulf of Mexico to
the lake.
“Our universe is get-
ting very small,” said Pete
Gerica, president of the Lake
Pontchartrain Fishermen’s
Association.
The oil could be the sec-
ond setback in five years.
Hurricane Katrina knocked
out seafood docks and lake-
side restaurants in 2005. The
lake’s water quality also took
a hit when the Army Corps
of Engineers drained New
Orleans’ contaminated flood-
waters into the lake.
“So far, this stuff has been
offshore for the majority of the
population in the southeastern
portion of Louisiana,” Anne
Rheams, executive director of
the Lake Pontchartrain Basin
Foundation, said of the oil
spill. “This is bringing it clos-
er to home.”
State authorities closed
the lake’s eastern reaches to
fishing Monday, though most
of it remained open. Barges
were lined up at bayous and
passes to stop the oil from

Tuesday used nets to collect
tar balls from marinas and
docks.
They also planned to lay
9,000 feet of special perme-
able booms, but the lake was
too choppy for skimmer ves-
sels to operate.
About 1,700 pounds of
oily waste has been col-
lected, said Suzanne Parsons
Stymiest, a spokeswoman for
St. Tammany Parish.
The amount of oil infil-
trating 600-square-mile Lake
Pontchartrain (pronounced
PAHN-chuh-trayn) appears
small so far. And tests on sea-
food have not turned up any
oil contamination, said Brian
Lezina, a state biologist. But
the pollution is distressing to
the many people in Louisiana
who have a deep attachment
to the lake.
“You won’t hear songs
about a lot of the marshes
in south Louisiana, but you
will hear songs about Lake
Pontchartrain,” Lezina said.
Out in the Gulf, mean-
while, stormy weather kept
skimmers from working off-
shore Tuesday for yet another
day and delayed the hookup
of a big new ship intended
to suck more crude from the
gushing blown-out well a mile
underwater. Also, the arrival
of a Navy blimp intended to
hover above the relief effort
was delayed until Friday.
Tar balls from the spill also
washed up on Texas beaches
over the holiday weekend,
meaning the disaster now
touches all five Gulf Coast
states, spanning more than
500 miles of coastline.
Lake Pontchartrain,
named for the French count
of Pontchartrain during the
reign of Louis XIV, is on the
northern edge of the city. It
is connected to the Gulf of
Mexico by two main passes:
the Rigolets, a winding pas-
sage of about 10 miles, and
the Chef Menteur, around
nine miles long.
For centuries, it has been a
playground, a source of sea-
food and a backdoor route
to New Orleans for invading

— Thousands of daredevils
dashed through Pamplona’s
historic old quarter today for a
goring-free first bull run at the
San Fermin fiesta, a raucous
event that ushers in Spain’s
summer party season.
The thrillseekers raced to
keep ahead of six fighting bulls
and six bell-tinkling steers
tasked with trying to keep the
beasts together along the 930-
yard (850-meter) course from a
holding pen to the bull ring in
this northern city.
Several runners were
knocked to the ground and
some were trampled on by the
animals weighing more than
1,100 pounds (500 kilograms)
but there were no gorings or
life-threatening injuries.
An 18-year-old man from
Melbourne, Australia, suffered
an eye injury and a 20-year
old Spaniard suffered multiple
contusions, Navarra state gov-
ernment said on its web site.
Both were hospitalized but
their injuries were not consid-
ered serious. They were identi-
fied only by their initials.
The 8 a.m. daily run is the
highlight of the nine-day street
drinking festival, and comes
after a full day and night of
hard partying.

Judge sends Lindsay Lohan to jail

— A judge sentenced Lindsay
Lohan on Tuesday to 90 days
in jail and an inpatient rehab
program after finding the
actress had violated her proba-
tion in a 2007 drug case by fail-
ing to attend alcohol education
classes.
The actress burst into tears
after the ruling.
Superior Court Judge
Marsha Revel issued the sen-
tence after listening to testi-
mony from employees of an
alcohol treatment program that
Lohan had been ordered to
attend.
Lohan missed seven classes
since December, which led
to the judge’s harsh rebuke
moments after the “Mean
Girls” star offered a tearful
apology.
“I did do everything I was
told to do and did the best
I could to balance jobs and
showing up,” Lohan told the
judge. “It wasn’t vacation, it
wasn’t some sort of a joke.”
Revel said she found
Lohan’s apology insincere,
comparing it to “somebody
who cheats and thinks it isn’t
cheating if she doesn’t get
caught.”
Lohan was not immediately
taken into custody and will
be permitted to surrender on
July 20. She will have to wear
an ankle alcohol monitor until
then.

Waiting on a corner was
retired American pilot Peter
Rostow, who then dashed
about 35 yards (meters) along-
side the bulls on a cobblestoned
street before taking cover in
a doorway, his heart pump-
ing with adrenaline. He drank
only water the day before to
prepare.
“I know bulls, but they came
about a hundred times faster
than I thought they would,”
said Rostow, 58, of Austin,
Texas. “I wasn’t prepared for
that, and the intensity of the
senses was overwhelming, the
smell of the bulls, the sound of
them running, and the fear.”
The run, broadcast live
on national television, lasted
2 minutes and 45 seconds, a
relatively fast sprint that saw
the bulls staying together and
paying little attention to the
runners.
The bulls that ran this morn-
ing will be killed in the evening
in the bull ring, and their meat
served up in Pamplona’s res-
taurants.
After the run, people packed
the bull ring to chase and taunt
young calves while others
resumed partying around the
monthlong jail sentence pros-
ecutors had sought for Lohan.
It was unclear how much
time Lohan will actually spend
in jail. Los Angeles Sheriff’s
Department spokesman Steve
Whitmore said female inmates
convicted of nonviolent mis-
demeanors serve about a quar-
ter of their sentence but that
can be further reduced by state
credits.
Whitmore said Lohan might
be released on house arrest, but
it would depend on the specif-
ics of Revel’s order.
Lohan could be returning
to the suburban Lynwood jail
where she spent 84 minutes
in 2007 after pleading guilty
to two misdemeanor counts
of being under the influence
of cocaine, and no contest to
two counts of driving with a
blood-alcohol level above
0.08 percent and one count of
reckless driving. She had been
sentenced to four days behind
bars.
The same jail housed Paris
Hilton for 23 days in 2007 after
she was found guilty of driving
on a suspended license while
on probation in an alcohol-
related, reckless-driving case.
Whitmore said then that
budget problems meant non-
violent female inmates were
only serving about 10 percent
of their sentences. The depart-
ment still faces overcrowding
and budget issues, he said.
Judge Revel spent sever-
al minutes Tuesday detailing
Lohan’s conduct since 2007,
noting the actress had repeat-
edly deflected blame and made
excuses.
There were “a number of
instances that would show her
not taking things seriously,”
said Revel, who imposed a
series of strict, new conditions
on the actress.

and to dine at restaurants that
cooked up the lake’s crabs and
other seafood. They played in
penny arcades and rode the
Zephyr roller coaster at the
Pontchartrain Beach amuse-
ment park.
But pollution shut down the
swimming and chased away
marine life, and the amuse-
ment park closed in the early
1980s.
Slowly, the lake revived.
In recent years, sightings of
dolphins and manatees have
delighted locals, and commer-
cial and recreational fishing is
thriving.

said it has been a struggle to
stay open. Katrina swamped
his restaurant at Bucktown, a
lakeside community in New
Orleans that has the feel of a

for sure, but not now,”

the bar showed an ad for a law
firm suing BP.

the capitol with Indians in
ceremonial regalia. Lots of
music! “Rain Song,” a group
from Fort Wayne, Ind., was
part of the entertainment.
Unfortunately, stormy weath-
er moved in Sunday evening
so Beth didn’t see any of the
Indian Dances.
Rita Bear-Gray, from
Auburn, Wash., flew in to
take part in the festivities.
Rita camped at the church
with the Glory Riders. I had
the pleasure of interviewing
Rita on the phone. She is a
54-year-old widow, with two
grown daughters. Rita was
originally from Canada, a
member of the Cree Tribe, the
largest tribe in Canada. There
are five dialects of Cree.
They are Plains Indians. Rita
makes her own regalia from
buckskin, complete with all
the beautiful bead work. She
wears many hats, one being
an ordained minister with
Messengers International.
She also works as a counsel-
or in an Addiction Recovery
House. Rita’s other activities
or occupations include mak-
ing Indian regalia (including
traditional wedding regalia),
making jewelry and interior
decorating. She makes the
Indian regalia from buckskin
(deer, elk, cow & moose). Rita
lives in a Victorian House,
with English Gardens. Her
husband was a horticulturalist
of English – Irish ancestry.
Rita rode with the ladies
around the State Capitol on
Monday. The women also
rode around the Federal
Building later in the week.
One day Beth went to get
16 bales of alfalfa hay for
their horses. She drove 40
miles west because they had
good quality hay. The 16
bales should last the horses
until they get to Ohio.
Upon her arrival back at
camp, some of the “locals”
helped unload the hay and
invited Beth, Joy, Rita and
Christian into their home
across the road. They were
fascinated with Becky, the
evangelical goat. Beth took
them some goat milk. Their
hosts then served them rice
milk and a tasty soup made
of hominy, tomatoes, cab-
bage and meat. What great
hospitality!
The Glory Rider caravan
left Oklahoma Wednesday,
heading north-east into
Missouri. They got as far as
Carthage (near Joplin), where
they set up camp at a Wal-
Mart. The horses had a nice
grassy area. Several big rigs
and motor homes were also
camped at Wal-Mart. Then
it was on to Dixon, Missouri,
where they set up camp at the
home of Berchett’s nephew
for a night.
When I talked to Beth
Friday they were nearing
Jefferson City, the Missouri
capitol. They had a three
hour delay because Beth had
to have some wheel bearing
repair on the horse trailer.
Their plans called for making
a prayer ride around the state
capitol in Jefferson City yet
on Friday evening.
Beth quoted her thought of

for this year’s Crossroads
Festival which will be held
Aug. 5 – 7.
This weekend celebrates
multiple events bringing
thousands of people to the
community.

the area as a result of the
exposure Van Wert received
in the recent American Profile
issue which covered the topic
of multi-state yard sales.
“Since the release of that
article our office has received
numerous requests for infor-
mation from yard sale enthu-
siasts from all parts of the
country,” he said.
The Crossroads Festival
takes its name from the fact
that our community is the
only place where two large
multi-state yard sales take
place. The “world’s lon-
gest yard sale,” now in its
19th year, follows Highway
127 from Gadsden, Alab.,
to Hudson, Mich., while
the “world’s fastest grow-
ing yard sale,” following the
historic Lincoln Highway,
this year stretches from New
Jersey to Iowa. Last year,
there were more than 200
yard sale locations within
Van Wert County which
attracted shoppers from
across the United States and
Canada. Lee said additional
information and tips about
having a successful yard sale
will be forthcoming.
“We are hoping we can
entice shoppers to use Van
Wert as an over-night stop-
ping off point,” Lee contin-
ued. “If we can keep them
in town, it will be beneficial
to our local businesses like
motels and restaurants. There
is a Fountain Park concert
already scheduled on Friday
evening with the Van Wert
Area Concert Band perform-
ing, and maybe we can figure
out something downtown for
Thursday evening as well.”
The weekend will also
include the 4th annual Rib
Cook-Off at the fairground
on Saturday. This year’s rib
vendors will be Just Smok’n
Q-4-U from Defiance, Pork
Brothers BBQ from Lima,
Red Pig Inn from Ottawa,
Smoke Shack BBQ from
Columbus and newcomer

Fort Wayne, will be provid-
ing the evening entertainment
this year. He also is encourag-
ing people to get their teams
ready and registered for the
wiffle ball and corn hole
tournaments this year. The
wiffle ball tournament will
begin Saturday morning with
both youth and adult teams.
Entry fee for youth teams
is $60 and $100 for adult
teams. Proceeds from the
tournament will go to the Van
Wert Pride, a 5th grade girls
fastpitch softball team. The
team will use the money to
purchase equipment, tourna-
ment entry fees and insurance
costs for the girls.
The corn hole tournament
carries with it a guaranteed
first-place prize of $500. The
entry fee is $40 per team.

wants to increase the price of
first-class stamps by 2 cents
— to 46 cents — starting in
January. Other postage costs
would rise as well.
The agency’s persisting
problem: ever-declining mail
volume as people and busi-
nesses shift to the Internet
and the declining economy
reduces advertising mail.
“The Postal Service faces a
serious risk of financial insol-
vency,” postal vice president
Stephen M. Kearney said, an
indication that without sig-
nificant changes a time could
come when the agency would
be unable to pay its bills.
The post office lost $3.8
billion last year, despite cut-
ting 40,000 full-time posi-
tions and making other reduc-
tions, and Kearney said it is
facing a $7 billion loss for
this year and the same for
fiscal 2011, which begins in
October. The rate increase
would bring in $2.5 billion,
meaning there still would be
a large loss for next year.
Clean-air rule would overturn Bush plan

posing a new rule to tighten
restrictions on pollution from
coal-burning power plants in
the eastern half of the coun-
try, a key step to cut emis-
sions that cause smog.
The Environmental
Protection Agency said
Tuesday the new rule repre-
sented its most consequential
effort yet to tackle deadly
pollution that contributes to
smog and soot that hangs over
more than half the country.
The rule would cost nearly
$3 billion a year and those
costs are likely to be passed
along to consumers, although
the rule’s effect on specific
companies and on consumers
was not clear.
“We believe that today is
marking a large and impor-
tant step in EPA’s effort to
protect public health,” said
the agency’s top air pollution
official, Gina McCarthy.
The rule, to be finalized
next year, aims to cut sul-
fur dioxide emissions by 71
percent from 2005 levels
by 2014 and nitrogen oxide

consigned to tangible and tac-
tically rewarding paper more
likely to register in our minds
than those that float on hard
tablets subject to the blinker-
ing life span of a battery or
extinguishable by a bolt of
lightning?

next week. Those rains sure
helped the garden grow, but
along with that comes all
of those unwanted weeds.
It seems we have had our
share of storms these past
couple of weeks. One night
recently when a storm came
up it was thundering and
lightning really badly. It
scared some of the children
so they went down to the
basement where they feel
safer. Four-year-old Kevin
told the children to “let go
and let God.” We thought
that sounded so cute. We
need reminders like that
sometimes

She gets tired really easily

am so thankful

thank all the readers who
sent cards, gifts and nice
notes. She enjoys receiving
them and reading all the
good wishes. She has physi-
cal therapy only once this
week and we hope she will
soon be able to do most of it
here at home. The therapist
says she still shows a bit of
weakness on her one side.

that elusive first title
— is still one game
away. But this was such a
moment to savor that most
of the squad made a curtain
call nearly an hour after the
biggest Netherlands victory in
decades, leading about 1,000
orange-clad fans in cheers that
figure to last until Sunday.
That’s when the Dutch play
the winner of today’s Spain-
Germany matchup for the
championship of the world.
Long wasteful with its soc-
cer talent, the Netherlands sure
has found the right touch in
this tournament.

the look of champions
— with an Oranje hue,
of course.
Sneijder is now tied
with Spain’s David
Villa for top scorer at
the tournament (five

Besides the loss
to Argentina in ’78, the
Netherlands fell in its only
other appearance in the final,
to West Germany in 1974.
Both of those title-game
defeats came during the golden
period of Dutch soccer and
in the opposition’s homeland.
No such worries this time; no
country outside of Africa has
had as much fan support as the
Netherlands.
Inside Green Point Stadium
it looked like a Florida orange
grove. Outside, a Netherlands
fan in a blue and white body-
second half. His left-footed
shot from just inside the penal-
ty area barely ticked the leg of
defender Maximiliano Pereira
and, with Robin van Persie
almost deflecting it again, the
ball skidded past goalkeeper
Fernando Muslera.
Then Robben sent a cross
from Dirk Kuyt past a flat-footed
Muslera with a brilliant header.
His teammates piled on in an
Oranje Crush celebration and
Robben came up from it mud-
died and merry — and with the
knowledge that, ahead 3-1, the
Netherlands was likely headed
to the championship match.
Uruguay was without dan-
gerous striker Luis Suarez,
whose handball on the goal line
in the final seconds of extra time
against Ghana saved his team in
the quarterfinals. He drew a red
card for that and spent his sus-
pension on the bench watching
his undermanned teammates
come up just short.
Pereira made the
team the lead in the 18th min-
ute and the Oranje pressed for
more, but when they let up
slightly on defense, the superb
Diego Forlan pounced. He was
given far too much open space
in the middle of the field and,
from just under 30 yards, his
left-footed drive went off goal-
keeper Maarten Stekelenburg’s
hand and into the net.
Stekelenburg was screened
just enough by defender John
Heitinga and didn’t get a good
view of the ball until it was
too late.
Forlan celebrated his fourth
goal of the tournament with a
suave wave. Suarez leaped off
the bench in jubilation.
Forlan left in the 85th min-
ute and coach Oscar Tabarez
revealed after the match that his
star played with a painful thigh
but noted the better team won.
Van Bronckhorst, who is
retiring after Sunday’s match,
was in his accustomed role
early in the second half when

Reds’ fans can hold their heads up

The Reds are in first place in the National
League Central Division, with the third-best
record.
Is it really a surprise?
I know, I know; they seemingly haven’t
had a winning record since Moses was
pitching; they’re in a small market and can’t
afford the big names; etc.
However, if they had not had a rash of
injuries last season, they would have been in
contention for the playoffs.
This is a team with many of its top stars
entering the beginning phases of their primes
and the patience is paying off.
They have — for once after all these years
of being in a perpetual state of “rebuilding”
— drafted, signed free agents and traded
well. It took this franchise time to overhaul
its system and undo the damage former
owner Marge Schott did in depleting the
scouting staff and such.
I wrote last year that I thought the Scott
Rolen trade for Edwin Encarnacion was a
steal and that proved right.
You have Joey Votto — if he is NOT
on the All-Star team, it is a sham with his
stats — and Jay Bruce and Johnny Cueto
and Drew Stubbs, etc., putting together solid
seasons. You have some old pros — like
Corky Miller and Orlando Cabrera — that
seem to be rejuvenated.
Plus the pitching staff — while not the
old Atlanta Braves of Maddux, Glavine and
Company or the Baltimore Orioles staff of
Palmer, Cuellar, McNally and Dobson —
has been relatively solid, especially consid-
ering that Great American is a hitter’s park.
Now I know I just issued the “kiss of
death” to the beloved Redlegs — watch the
injuries and slumps happen galore!!! — but
for us Reds’ fans, it’s finally a season where
we don’t have to bury our heads in shame as
they fall apart from the beginning.
In fact, they might actually be in the
market to make a trading-deadline trade or
pickup — Cliff Lee has been mentioned —
instead of conducting their usual fire sale.
Of course, you could be fans of Ohio’s

“other” team — Cleveland, who has had
more success over the last two decades than
the Reds but right now seem to be heading
quickly in the other direction.
Their biggest problem the last few sea-
sons has been their inability to keep some
top-notch free agents in town. No team —
unless you’re talking about the Yankees or
Red Sox — can overcome the loss of so
many stars (Lee, CC Sabathia, Jim Thome,
Manny Ramirez) and not pay a price with
its personnel. That is the story with small-
market teams.
They built up a strong farm system years
ago but the nature of the beast is that some-
times, prospects just don’t work out. When
you think of how many — or few — play-
ers actually make it to the Big Show, it’s a
gamble to begin with.
Hey, the Reds are going to have to deal
with this issues in a couple of years with
guys like Bruce becoming eligible for arbi-
tration (that word should be banned from
baseball and not to be used in polite com-
pany!!!!) and then free agency.

Niemann pitched six strong innings and
Tampa Bay’s bullpen shut down Boston
for the second day in a row in a 3-2
victory.
Niemann (7-2) limited the Red Sox
to four hits and an unearned run. He
walked three and struck out five. Daniel
Nava drove in Boston’s first run with a
single off Niemann in the fourth. Four
relievers held the Red Sox to one hit
until Bill Hall walked and scored on
Eric Patterson’s 2-out triple in the ninth
off Rafel Soriano, who earned his 23rd
save.
Jason Bartlett drove in Tampa Bay’s
first run with a single off Felix Doubront
(1-1) in the third. Sean Rodriguez tri-
pled and scored on John Jaso’s RBI
grounder, giving the Rays a 2-1 lead in

Feds vs. state again in suit against Arizona law

PHOENIX — The federal lawsuit against
Arizona’s tough new immigration law focuses
heavily on a question that has been in the spot-
light repeatedly the past decade and dates back
to the Founding Fathers: The right of the govern-
ment to keep states from enacting laws that usurp
federal authority.
The lawsuit filed in Phoenix federal court on
Tuesday sidestepped concerns about the poten-
tial for racial profiling and civil rights violations
most often raised by immigration advocates.
Experts said those are weaker arguments that
don’t belong in a legal challenge brought by the
White House to get the measure struck down.
Instead, the suit lays out why the govern-
ment believes that immigration laws passed by
Congress and enforced by a range of federal
agencies must take precedence to any passed by
a state Legislature.
The Arizona law requires officers, while
enforcing other laws, to question a person’s
immigration status if there’s a reasonable suspi-
cion that they are here illegally, such as speaking
poor English, traveling in an overcrowded vehi-
cle or hanging out in an area where immigrants
typically congregate.
The law also makes it a state crime for legal
immigrants to not carry their immigration docu-
ments.
Backers of the law say the crackdown is a
necessary tool to keep illegal immigrants out of
Arizona and combat problems such as drug traf-
ficking, murders and violent kidnappings that have
become so common in a state that is home to an
estimated 460,000 undocumented residents.
The federal government will ask a judge to
grant an injunction to block the law from taking
effect on July 29.
The arguments will focus on a core constitu-
tional concern — balancing power between the
states and the federal government. More specifi-
cally, the issue centers on the long-running “pre-
emption” legal argument that says federal law
trumps state law.
“The nation’s immigration laws reflect a
careful and considered balance of national law
enforcement, foreign relations, and humanitarian
interests,” the suit says.
The lawsuit goes on to say that a “state may
not establish its own immigration policy or
enforce state laws in a manner that interferes with
the federal immigration laws. The Constitution
and the federal immigration laws do not permit
the development of a patchwork of state and local
immigration policies throughout the country.”
Backers of the law say that Arizona will have
some strong arguments in its favor in fighting
the lawsuit.
Kris Kobach, the University of Missouri-
Kansas City law professor who helped draft
the Arizona law, has said the state law is only
prohibiting conduct already illegal under federal
law. And Harvard Law School professor Gerald
Neuman believes Arizona could make a com-
pelling legal argument that it has overlapping
authority to protect its residents.
But courts have ruled that under the Supremacy
Clause of the Constitution, any state law that con-
flicts with a federal law is pre-empted. Federal
law, the framers said, “shall be the supreme law
of the land.”
The pre-emption tactic has been success-
fully used by the federal government on several
occasions over the years, including by the Bush
administration to limit product liability lawsuits.
The government also used it to overturn bans on
military recruiters passed by liberal California
towns.
Federal courts have invoked the Supremacy
Clause on immigration issues as well. For example,
a federal judge in 2008 struck down a Dallas sub-
urb’s ordinance that banned apartment rentals to
illegal immigrants, saying the U.S. government has
the ultimate authority to enforce immigration laws.
Within months of taking office, the Obama
White House directed department heads to
undertake pre-emption of state law only with
full consideration of the legitimate prerogatives
of the states. The 2009 directive was aimed at
reversing Bush administration policy which had
aggressively employed pre-emption in an effort
to undermine a wide range of state health, safety
and environmental laws.
Despite the precedent, that doesn’t mean the
lawsuit is a sure winner, or that state officials
don’t believe they can pass laws that head into
federal turf.
In fact, efforts by many states trying to block
the nation’s new health care law run headlong
into the Constitution’s Supremacy Clause. But
immigration is one area where federal authority
has generally been upheld.
“Immigration has traditionally and constitu-
tionally been the historic preserve of the federal
government, and there are cases going back to
the late 19th century that say as much,” said Peter
Spiro, a constitutional law professor at Temple
University who has studied immigration law
extensively. “So the Obama Administration has
a lot to work with in filing this claim, and the fact
that the claim is filed by the administration adds
credibility ... and increases the chances that law
will be struck down on pre-emption grounds.

The ensuing scandal energized skeptics and destabilized
the Copenhagen talks. The research center’s chief, Phil Jones,
stepped down while Russell, a former vice-chancellor of the
University of Glasgow in Scotland, investigated.
While Russell’s report said there was no evidence to show
Jones or any other scientist had subverted the peer-review pro-
cess, it did revisit the now infamous e-mail exchange between
Jones and a colleague in which the climatologist refers to a a
“trick” used to “hide the decline” in a variable used to track
global temperatures.
Some skeptics took that as proof that scientists were fak-
ing global temperature trends. Russell’s report rejected that
conclusion, but did say the resulting graph was “misleading”
— although not intentionally so.
Russell also criticized the university for being “unhelpful”
in dealing with Freedom of Information requests — something
Britain’s data-protection watchdog has already scolded the
university for.

FLORISSANT, Mo. — Gail Rehme knows she’ll never shake
the memory of that June night in 1984 — the late-night knock on
the door, the hushed talk in the living room. Odd, the 10-year-old
girl thought, that the pastor would come over so late.
The next morning, Gail’s father called the family together. Her
big brother, David, had been killed by a drunken driver on his way
home from a Cardinals baseball game.
Last month, after years of urging by Rehme, Missouri joined a
growing list of states offering roadside signs to both honor victims
of drunken driving crashes and to encourage safe driving. The
first sign installed under what has been dubbed “David’s Law” is
along Interstate 270 in St. Louis County and honors 19-year-old
David Poenicke — Rehme’s brother.
“If somebody sees it and realizes somebody died because of
a drunk driver, and if it deters just one person from drinking and
driving, the job’s done,” said Rehme, now 36.
Federal statistics show that nearly 12,000 people died in
drunken driving crashes across the country in 2008 — or nearly
one-third of all traffic fatalities.
Across America, makeshift memorials dot two-lane roads,
highways and interstates, sad tributes to people killed in crashes.
Some feature crosses, teddy bears or flowers. Others have Bibles
or pictures of the victim.
Highway departments worry people will be hit while putting
up or tending the homemade memorials or that they will distract
drivers rubbernecking to get a look. They are illegal in many
states, though experts say those laws are rarely enforced out of
sympathy and support for victims’ families.
Missouri and at least five other states — California, Illinois,
Wisconsin, New Hampshire and Texas — now offer something
of a compromise with state-sanctioned signs. Most contain simple
messages aimed at both honoring the victim and delivering a mes-
sage of safety.
In both Texas and Illinois, the signs read “Please Don’t Drink and
Drive,” and list the name of the deceased with the date of the crash.
Missouri’s sign reads, “Drunk Driving Victim” and includes
the victim’s initials, the month and year he or she was killed and
the phrase, “Think About It.”
Relatives typically have to pay for the signs. California charges
$1,000 and signs stay in place for seven years. In Texas, signs cost
$300 and are given to the victim’s family after one year. Illinois
signs cost $150 for the safe driving message alone or $200 to
include the victim’s name and date of the crash.
Missouri charges $600 for signs that stay up for 10 years.
Rehme operates a nonprofit called “Who’s Next?” that raises
money to help families pay for the signs.
Other states are taking different approaches to honor crash
victims, including those killed in drunken driving wrecks. Some,
including Illinois, have begun tree-planting programs. Delaware
has drawn praise for a memorial garden at a roadside rest area that
includes bricks with the names of nearly 600 accident victims.
He said he felt heat coming from the front pocket and real-
ized the firecrackers were about to explode. He managed to
push a 2-year-old girl out of the way before the blast, put his
left hand over his pocket and fall to the ground.
“At first, I didn’t think I lost my hand. I thought I just took
a pretty bad blow. But then I ended up looking, and I was like,
yeah, I saw it. My hand was gone,” Myers said.
The blast seriously injured the girl’s leg. Witnesses said the
damage could have been a lot worse if Myers had pulled the
firecrackers out of his pocket near a crowd of people.
“The 2-year-old baby, she got a chunk blown out of her
leg,” said Demetrios Paxinos, who attended the east Oakland
party. “She had stitches inside and outside of her leg. But it
would have been a lot worse.”
The teenager, who had planned to join the military in
September, is recovering in an Oakland hospital.
“It took away my dream, which was to join the United
States Marine Corps and defend my country, but the thought
that just keeps going through my head is it’s better me than that
little girl,” he said.
Governor nixes marriage equality

HONOLULU — Hawaii’s governor ended months of specu-
lation by vetoing contentious civil unions legislation that would
have granted gay, lesbian and opposite-sex couples the same
rights and benefits that the state provides to married couples.
Republican Gov. Linda Lingle’s action on Tuesday came on
the final day she had to either sign or veto the bill, which was
approved by the Legislature in late April.
The measure would have made Hawaii one of six states that
essentially grant the rights of marriage to same-sex couples with-
out authorizing marriage itself. Five other states and the District
of Columbia permit same-sex marriage.
Lingle said voters should decide the fate of civil unions, not
politicians.
“The subject of this legislation has touched the hearts and
minds of our citizens as no other social issue of our day,” she said.
“It would be a mistake to allow a decision of this magnitude to be
made by one individual or a small group of elected officials.”
For weeks, Lingle heard emotional statements from both sup-
porters and opponents of the bill. On Tuesday, she invited leaders
from both sides to her standing-room only news conference.
Opponents of the measure, including many religious groups,
erupted in cheers and hugs when the announcement was made.
“What she did was very just, and I’m very happy about it,” said
Jay Amina, 50, of Waianae. “It sends a good message throughout
the state of Hawaii — that our people here on the islands are
standing for traditional marriage.”
Supporters of civil unions shouted, “We’ll keep fighting!” and
“Let’s go!” The group of about 100 joined in singing “We Shall
Overcome.”
“We had hoped the governor would do the right thing for civil
rights and equality,” Lee Yarbrough of Honolulu said while stand-
ing arm-in-arm with his partner. “This battle is far from over.”

The two nations clearly felt that was necessary. The meeting
came five weeks after Israel’s deadly raid on a flotilla that was
trying to break the Israeli blockade of the Hamas-controlled
Gaza Strip. That raid brought international outrage and tested
U.S. support for Israel’s security steps.
But the optics and words of Tuesday’s visit all sent one mes-
sage: unshaken cooperation.
Netanyahu emerged with a pile of promises from Obama that
the U.S. is both committed to Israel’s security and a believer that
the prime minister wants peace with Palestinians. For his part,
Netanyahu showed the urgency that Obama wants in boosting
peace efforts, though he didn’t say in public just what he might
have planned.
The last time Netanyahu visited in March, amid a moment
of deep tension over Israeli settlements in disputed territory,
reporters were not even invited to see the leaders shake hands.
This time, the two men were in front of the cameras plenty. The
media got to see them talking, smiling — even Obama escorting
Netanyahu off to his waiting limo.
Where there was agreement, such as on Iran’s nuclear ambitions
or the promise of Mideast peace, Obama and Netanyahu empha-
sized it. Where tensions remain, such as on Israeli settlements or the
attack on the aid flotilla, there was little public mention.
