BRIEF STATEMENT OF SUBJECT MATTER, ACTION TAKEN AND RELEVANT


INFORMATION GATHERED:

Last Tuesday, 14 February 17 the Committee on Health and Sanitation had a


Committee Meeting to review the proposed draft ordinance entitled AN ORDINANCE
REGULATING THE ESTABLISHMENT AND OPERATION OF PRIVATE BIRTHING
CENTERS IN THE CITY OF ORMOC

Quorum was declared for the Committee on Health and Sanitation with all members
present.

The Chairman explained to the Committee that one of the purpose of the passage of the
ordinance is to have a long term control of mortality and morbidity among our mother
and neonates, the local government must ensure quality services and rapid risk
assessments in these target group for both public and private health facilities in the City
of Ormoc. In connection thereto the local government, as instrumentality of the state
has a constitutional duty to protect and promote the peoples right to health (Article II,
Section 15, 1987 Constitution) and has the power to serve the general welfare through
the protection and promotion of the peoples health(Section 16, R.A. 7160).
The Committee went through the reading of the provisions of the draft by section,
members and the guest who were given draft copies and were consulted beforehand
manifested their suggestions during the meeting. The first to manifest is Dr. Navales
on her suggestion that the term Birthing Center shall not only be limited to the Birthing
Center but must also include birthing home since there were establishments who were
granted License to Operate as Birthing Home. SP Member Pongos suggested with
respect to the procedure for securing a business permit to operate a private birthing
home center that the term city Licensing office be replaced with BPLO or Business
Permit Licensing Office and the same shall be incorporated in the definition of terms.
SP Member Yrastorza and SP Member Penserga manifest their suggestion and
modification on Section 6 of the draft to simplify the procedures , thus the procedures
for securing a business permit to operate a private birthing home center shall be the
following : First , Applicant secures and fills up application form from the CHD; Second ,
Applicant submits filled-up application form and other requirements to the designated
desk under the CHD; Third, Applicant shall submit for actual inspection on the birthing
facility; Forth, Applicant secures CHD Clearance Certificate and shall submit the same
together with all other requirements to the BPLO for issuance of Mayors Permit; and
Fifth Applicant secures Mayors Permit from the BPLO.

The Committee also tackled that the midwife and the clinical assistant of the privately
operated Birthing Center/Home must obtain an annual medical certificate from CHD
which includes chest X-ray, blood examination, urinalysis and stool exams. In
connection thereto the Midwife and the Nurse must have an updated PRC Licence for
competency of skills. The members of the Committee agreed that there must be a 4
wheeler patient transport vehicle which shall be contracted out by the birthing center as
evidenced by a certification for the transport tie-up provided that said vehicle should be
in the facility whenever there is a patient on labor, the same shall during inspection. SP
Member Penserga manifested that in order to secure mothers health there must be a
generator set in the facility in cases of a temporary reduction of electric power in
an area. Dr. Navales and Dr. Lampong raised there motion that a section granting
visitorial and enforcement power of the CHD shall be incorporated in the ordinance
which sjhall include the following powers 1. The City Health Officer of his/her
representative shall have authority to make inspections of the interior and exterior of all
dwellings , buildings ,structures ,premises , facilities and maintenance of private birthing
homes; 2. Whenever it shall be determined that a private birthing home is in violation of
this ordinance , a notice of violation shall be issued by the City Health Officer or his/her
representative setting the alleged violations and advising the owner, operator , occupant
or agent of the birthing center /home that such violation must be corrected. The time
period for the correction of said violations shall be stated as well as the necessary
methods or manner to be employed in the correction; 3.Whenever said violations shall
fail to be corrected within the time set forth and an extension of this time is not deemed
to be necessary or corrective methods employed are not in accordance with what is
stated in the notice of violation , the City Health Officer or his/her representative may
proceed to abate the said violations in the manner provided by law. The members of the
Committee have also agreed that there must be a transitory provision which will provide
that all existing Private Birthing Center/Home are required to comply with the provisions
of this ordinance within thirty (30) days from the effectivity of this ordinance otherwise
their license will be revoked.

FINDINGS AND CONCLUSIONS:

1. It was decided that a transitory provision shall be incorporated in the ordinance


which provides that all existing Private Birthing Center/Home are required to
comply with the provisions of this ordinance within thirty (30) days from the
effectivity of this ordinance otherwise their license will be revoked.
2. A section granting visitorial and enforcement power of the CHD shall be
incorporated in the ordinance.

The Committee, after careful and thorough review of the draft ordinance submitted,
concluded that there is a need to submit the said ordinance ORDINANCE
REGULATING THE ESTABLISHMENT AND OPERATION OF PRIVATE BIRTHING
CENTERS IN THE CITY OF ORMOC which provides comprehensive guidelines
towards safety and enhancement of maternal health care while eliminating inefficiency
of operations of private birthing centers/homes in the city , the Committee manifests its
prompt and full support for the passage of this ordinance.

RECOMMENDATION :

It was recommended to present the draft ordinance for its approval to the plenary
session with the amendments and additional inputs by the CHO and members during
the committee meeting .

I now move for the adoption of this Committee report by this August body. Thank you.
