Dear Public Records Request Officer:
Under the Nevada Open Records Act § 239 er seg., I write to request a copy of a publicly-
reported recording of a meeting between Gaming Control Board Chairman A.G. Burnett and
Attomey General Adam Laxalt in April of 2016, regarding a then-ongoing wrongfial termination
lawsuit against the Las Vegas Sands Corporation. According to news sources, Chairman Burnett
recorded this conversation and subsequently turned the recording over to the Federal Bureau of
Investigations based on the content of the conversation.’
As a recording made by the head of a state agency that was preserved as evidence due to the
information contained therein, this recording falls squarely within the definition of “official state
record” under Nevada public records law. The Nevada Independent also requested a copy of this
recording on February 16, 2017, explaining that “[bJecause the recording was made in the
furtherance of Chairman A.G. Burnett's public duties, the recording is ipso facto a public
record.”
