When entering the Jameson St. Patricks competition, (hereinafter referred to as
the Competition), you agree to be bound by these terms and conditions (hereinafter referred to as the Terms and Conditions). All promotional materials relating to this Competition, including all information regarding how to enter this Competition, are also part of these Terms and Conditions. In the event of any conflict between any terms of promotional materials and these Terms and Conditions, these Terms and Conditions shall prevail. Article 1 Promoter of the Competition The promoter of this Competition is Nexty SARL, a company incorporated in Lebanon having its registered office at Clemenceau, Justinien Street, P.O Box: 113-62 62, Beirut (Lebanon) (hereinafter referred to as the Promoter). Article 2 Modification to the Terms and Conditions These Terms and Conditions may be updated at any time throughout the Competition. The Promoter reserves the right to change, modify, add or remove any provision of these Terms and Conditions, or cancel, stop, extend the Competition, with or without prior notice, according to its reasonable discretion. Any update of these Terms and Conditions shall obligate all participants in the Competition as of the date of their publication. Article 3 Participation requirements This Competition is only open to residents of Lebanon who have legally reached the age of 18 years old as of the date of their participation in the Competition, and who will be able to attend to the St. Patricks event to be held in Beirut on the 16th of March 2017, should they win the Competition. Employees, managers, partners and agents of the Promoter (including any of their subsidiaries or affiliated companies), their immediate families and members of their households and anyone otherwise connected to the fulfillment of the Competition are not eligible to take part to the Competition. The Promoter reserves the right to require from participant that they prove they are eligible in any reasonable manner. Should a winner be found ineligible or be suspected of being ineligible by the Promoter on reasonable grounds, the Promoter will remain the owner of the prize and reserves the right to award the prize to another participant and to require the return of any prize already awarded. The Promoter can decide to dismiss any participant from the Competition at any time and for any reason. Article 4 Conduct of the Competition Entries start on 02/03/2017 2017 at 12.00 am (Lebanon time) and close on the 15th of March 2017 at midnight (Lebanon time). The Competition will be promoted on: - the Jameson Facebook Page at the following URL address https://www.facebook.com/JamesonLebanon/? brand_redir=1164853883539933 - the Jameson Instagram Page at the following URL address @jamesonleb; and at - the key Jameson on-trade outlets in Mar Mkhayel, Badaro, Jounieh, Hamra. Each participant must have a valid and active Facebook account or a valid and active Instagram Account (hereinafter referred to individually as an Account, and collectively as the Accounts). If you do not have an Account, you can register at www.facebook.com or www.instagram.com, subject to the terms and conditions which appear on these websites. Registering and using the Accounts are each participants responsibility. The Promoter shall not be liable for any damages that may be caused to the participants in connection with the opening and the use of the Accounts. To enter the Competition, participants must: 1. Take a picture of a Jameson moment with their friends; 2. Upload it on their Accounts and tag one friend as well as the hashtag #JamesonLebanon. Fake profiles as well as buying likes and/or shares is strictly forbidden and will forfeit participation. The picture cannot include any other brand than Jameson. Article 5 Winners and Prize There will be two (2) winners, who will be those with the first and second most liked and shared pictures. They will each be awarded with a 3-day trip to Ireland for two persons, the winner and his/her tagged friend (hereinafter referred to as the Prize). The Prize will comprise flight tickets, visas, accommodation and activities related to Jameson including a visit of the Jameson Distillery, to the exclusion of any other expenses. The Prize is not exchangeable for cash or any other alternatives. By participating to this Competition, participants acknowledge that the Promoter does not make any representation or warranties of any nature whatsoever regarding the Prize. Three (3) travelling date options will be proposed to the winners. In the event where the winners would be unable to use the Prize out of availability, visa issues or traveling restrictions, the second participants in terms of likes and shares will replace them as winners and will be awarded with the Prize. The Promoter will not pay, reimburse or otherwise support any expenses incurred by the participants by virtue of their participation in the Competition. The winners are responsible for paying any associated costs including, but not limited to, any personal or incidental expenses and any VAT, national and/or local tax liabilities incurred in claiming or using the Prize. Article 6 Announcement Announcement of the winners will take place during the St. Patricks event held on the 16th of March 2017. Participants cannot issue any objections or contestations regarding the announcement of the winners. The winners must participate to the St. Patricks event and be present on the announcement to redeem their Prize. By entering the Competition, participants agree that the Promoter shall be entitled to publish their name and Facebook and Instagram profiles in publicity materials relating to the Competition without further reference, payment or other compensation and the participant hereby waive in favor of the Promoter and anyone acting on its behalf, any moral rights they may have in such picture. Article 7 No financial compensation In the event that, for reasons beyond the Promoters reasonable control, the Promoter is unable to award the Prize as described in these Terms and Conditions, the Promoter shall not be required to award any financial compensation or any other prize of any nature. Article 8 Personal Information The Promoter may collect and process participants personal information outside of Lebanon in order to conduct the Competition. Participants personal information may be shared with the Promoters agents to the extent necessary for the Prize to be delivered to the winners. Each participant acknowledges and confirms that there is no legal obligation to provide personal information to the Promoter. However, refusal to provide personal information will prevent any participation to the Competition. In addition, each participant acknowledges and confirms that such use of information shall not be regarded as breach of privacy and the Promoter and/or anyone acting on its behalf shall not be regarded as being in violation of privacy in this regard. All personal information collected at the occasion of this Competition will be used only for the purposes of this Competition and will not be used for any further promotional or other activity unless participants have expressly consented to it. Participants hereby acknowledge that they can require access to their personal information detained by the Promoter and require rectification or deletion of such information. The Promoter may preserve or disclose participants personal information if the Promoter believes that it is reasonably necessary to comply with a law, a regulation or legal request, to protect the safety of any person, to address fraud, security or technical issues, or to protect the Promoters rights or property. Article 9 Modification or termination of the Competition The Promoter reserves the right to modify, cancel, terminate or suspend the Competition in whole or in part, at its sole reasonable discretion, if it believes the Competition is not capable of being conducted as specified within these Terms and Conditions. This shall include, but shall not be limited to, a virus, a computer bug, an unauthorized human intervention or any other cause that could corrupt or affect the administration, security, impartiality or normal course of the Competition. The Promoter is not responsible for any conditions, circumstances, losses, failures or delays caused by events beyond its control. Article 10 Limitation of liability The Promoter will not be responsible for any damage, loss or injury resulting from participants' entry into the Competition or their acceptance and/or use of the Prize, or for technical, hardware or software failures, losses, faulty or unavailable network connections or difficulties of any kind that may limit or prohibit their ability to participate to the Competition. The Promoter will not be responsible for any lost, damaged, defaced, incomplete, illegible or otherwise unreadable entries. Proof of posting of any entries is not proof of receipt by the Promoter. It is the responsibility of the participant to fill in with the required details fully and accurately, and the Promoter, and/or anyone acting on its behalf, reserves the right to, at its sole reasonable discretion, disqualify a participant who fails to do so. Article 11 Breach of applicable law or Terms and Conditions Any participant, who enters or attempts to enter the Competition in a manner, which, in the Promoters reasonable determination, is contrary to any applicable law and/or these Terms and Conditions, or is unjust to other entrants by its nature including, without limitation, tampering with the operation of the Competition, cheating, hacking, deceiving or acting in any other unfair ways such as intending to annoy, abuse, threaten or harass any other entrants or the Promoter may be rejected, blocked and/or disqualified from the Competition at the Promoters sole reasonable discretion without prior notice. Furthermore, where such actions have significantly impaired the Competition, the Promoter may, at its sole discretion and without prior notice, add further stages to the Competition as it seems reasonably necessary in order to resolve any problems arising as a result of such actions. Article 12 Facebook - Instagram This Competition is in no way sponsored, endorsed or administered by, or associated with, Facebook and/or Instagram. Participants understand and agree that they are providing their information to the Promoter and not to Facebook and/or Instagram. By entering this Competition, each participant releases Facebook and/or Instagram from any action or claim arising out of the Competition. Any questions, comments or complaints regarding this Competition must be directed to the Promoter, not to Facebook and/or Instagram. Article 13 Communication All Promoters decisions in relation to the Competition are final and the Promoter is not requested to enter into any correspondence with participants. No message whether written or electronic, will be sent to non-winning participants. Article 14 Intellectual Property Rights The reproduction, representation or use in any way of all or part of the elements relating directly or indirectly to the Competition shall be strictly prohibited and the participants shall refrain from using the website and its contents in any way which is or may infringe the intellectual property rights of the Promoter and/or other third parties, without their prior written consent. All intellectual property rights of any kind, including, without limitation, trademarks, logos and any other intellectual property rights, whether registered or not, relating to the Competition are and shall remain the property of the Promoter or as the case may be their respective owners. Any unauthorized reproduction or representation of such brands, logotypes and trademarks may constitute acts of counterfeiting and may be punishable by criminal penalties. Article 17 Applicable Law and Jurisdiction These Terms and Conditions are governed by the laws of Lebanon. The competent court of Beirut, Lebanon, shall have exclusive jurisdiction to hear any dispute or claim arising in association with the Competition or these Terms and Conditions.
