QUETTA WATER & SANITATION AUTHORITY QUETTA.

EMPLOYEES SERVICE REGULATIONS, 2007.

NOTIFICATION.

No._____________________ In exercise of the powers conferred by sub-section (2) of


Section 13 of the Quetta Water and Sanitation Authority Act 2004 (Act No. XII of
2004) the Authority with the prior approval of the Govt: is pleased to make the
following regulations, regulating recruitment to post (Grade 1 to 15) in the Quetta
Water and Sanitation Authority and prescribing conditions of service for the persons
appointed thereto namely.

PART-I GENERAL.

1. Short title and commencement.


(i) These Regulations may be called the Quetta Water and Sanitation
Authority. (Grade 16 and above) Service Rules 2007.

(ii) They shall come into force at once.

2. DEFINATIONS. In these Regulations unless the context otherwise requires the


following expressions shall have the meanings hereby respectively assigned to them that is to say.

(i) Authority means the Quetta. Water and Sanitation


Authority established under the WASA Act No. XII of 2004.

(ii) Appendix means the Appendix appended to these Regulations.

(iii) Appointing Authority means the appointing authority specified in column 5


of the appendix.

(iv) Act means the Quetta Water and Sanitation Authority Act 2004
(Act No. XII of 2004)

(v) Managing Director means the Managing Director of Quetta Water and
Sanitation Authority.

(vi) Employee means a person who is in the whole time regular


service drawn a regular monthly salary. It does not include a part time casual or temporary servants
engaged on daily wages or month to month or on contact.

(vii) Initial recruitment means appointment made other than by promotion or


transfer from another Service/Department/Post.

(viii) Board of Directors means the Board of Directors of the Authority


constituted under Section 5 of the Q-WASA Act No. XII of 2004.

(ix) Government means Government of Balochistan.

(x) Administration Department means any Department designated


by the Government of Balochistan.

(xi) Competent Authority means the authorities delegated by the Government of


Balochistan or promulgated by the Government from time to time.

(xii) Disciplinary Proceeding means all the disciplinary/enquiry matters shall


be initiated under Balochistan Province Removal from Service (Special Powers) Ordinance, 2000 or
promulgated by the Government of Balochistan from time to time.

(xiii) Probation means the period for which the Authority, employee remain on
probation prior to his conformation in the post and pay scale.

All words and expressions used in these rules but not defined shall unless the context
otherwise requires have the same meanings as in the Quetta Water and Sanitation Authority Act
2004.

3. Eligibility and Composition of Service.

(a) No person who is married to foreign National shall be eligible for appointment to the
service.
(b) The restrictions in post by sub-rule (1) above may be relaxed by the Government in
accordance with the policy of Government of Pakistan.
(c) The service shall comprise of the post specified in column 2 of the Appendix and such
other posts has may be determined by the authority from time to time.

4. Method of recruitment. Appointment to the service shall be made as specified in the


Appendix to the Rules.

5. Initial Appointment.

(1) Initial appointment to the post shall be made on the basis of written test
and interview by the selection committee after the vacancies have been
advertise in prominent news papers.
(2) A candidate for initial appointment to a post unless after such medical
examination as authorized by Government in found to be in good
mental and bodily healthy and free from any physical defect likely to
interfere with the discharge of his duty.
(3) All candidate for initial appointment to a post must posses the
educational qualification and experience.
(4) All person who immediately before coming in force of these rules were
regular employee of the authority shall deemed to be appointed in their
existing posts under these Rules.
(5) No employee shall engage himself in any business trade, business
occupation during employment in Authority.

PART II.

CADERISATION, APPOINTMENT,PROMOTION AND


TRANSFER ETC.

Selection Committee. The selection committee shall constitute of such members as may be
notified by the Board.

6. There may be one or more cadres for each, or a combined cadre for two or
more, of the following Branches.

1). Administration Department.


2). Finance/Revenue Department.
3). Engineering Department, (Water Supply/QSSP).

7. 1) there shall be selection committees as per schedule B appointed by the Board


of Directors for selection of suitable candidates for initial recruitment or for promotion to different
posts or grades.

Provided that the Board of Directors or other competent authority shall not
be bound to accept the recommendations of the concerned selection committee in any case but the
reasons in all such cases for non acceptance of the advice of the Selection Committee shall be
recorded; provided further that:-

a) If the competent authority other than the Board of Directors do not agree with the
recommendations of the selection committee it may report the case to the Board of
Director whose orders shall be final; and

b) The Board of Director shall not pass any order unless the Selection Committee has
been given an opportunity to justify recommendations.

(II). The Board of Director may, from time to time, make such alteration in the personal of
any selection Committee as it may deem necessary.

8. The Selection Committee shall hold competitive examinations of candidates or


interview them from time to time for selection of suitable personnel as per zonal quota allocated by
the Government of Balochistan, which making their recommendations the Selection Committee, may
also assign position of merit to the candidate so recommended and not less than two candidates shall
be recommended for each vacancy.

(a) The method of initial recruitment and promotion to various posts including the fixing
of quotas as between direct recruits and departmental promotes, and the requisites qualification for
initial recruitment and condition for promotions, shall be as per policy of the Provincial Government
provided that no change in the conditions for promotion shall be made so as to adversely affect the
interests of the existing employees.

(b) In case of initial recruitment competent authority may on the recommendations of the
concerned selection committee routed through Administrative Department, fill in any of the
vacancies by appointment of employee of Government, unified group of functionaries of Local
councils or an autonomous or Semi Autonomous Body.

9. Separate seniority lists for all cadres of the service of the Authority or a combined
seniority list for two or more cadres, maybe prepared under direction of the Board of Directors after
due approval of the Administrative Department for the purpose o regulating promotions to higher
posts or grades, retrenchments, and other allied matters.

10. Employees serving in one Branch of the Authority may be transferred to another
branch on the recommendation of MD to the Administrative Department either on their own request
or in the exigencies of service, provided that, in case of transfer to a Branch in which a separate
seniority list is maintained: -

a) If the employee is transferred at his own request, his seniority in the new
branch will be count from the date of his joining that Branch, and
b) In any other case his seniority in the original branch would not be affected
by such transfer.

PART- III.

GENERAL CONDITIONS OF SERVICE.

11. Qualifications, experience and age limit on initial recruitment.

No person shall be appointed to a post in the service by initial recruitment unless he posses the
qualifications specified for the post in column 3 of the Appendix.

a) No person shall be appointed by the initial recruitment on any post other than a
Technical post, above grade 15 if he is less than 18 years or more than 28 years of
age and on a technical post above grade 15 if he is less than 21 years or more than
30 years of age, subject to the relaxation of the aforesaid upper age limit by the
Government of Balochistan routed Administrative Department in any case, in
public interest, for reasons to be recorded in writing.

b) In the case of a person whose service under the government or an autonomous or


semi Autonomous body or an employee of unified Group of functionaries of
Local Councils has been terminated for want of vacancy, the period of service
rendered by him shall, for the purpose of the upper age limit, excluded from his
age; and
c) Age for the purpose of this regulation shall be reckoned as on the last date fixed
for submission of applications for appointments.

(2). All the posts to be filled in by initial recruitment shall be filled in after advertising the
vacancies in the prominent local Daily Newspapers with prior permission of the Administrative
Department and holding written test and interview.

12. Nationality, Domicile and Character Certificate.

No person shall be appointed to a post unless he produces a Nationality


Certificate showing that he is National of Pakistan a domicile certificate showing his domicile in the
province of Balochistan certificate of character from the principal Academic officer of the Academic
institution last attended by him, and certificate of character from two other responsible persons (not
being his relative) who are well acquainted with his character and antecedence.

13. Medical certificate of fitness.

(1) No person shall be appointed to a post by initial recruitment unless


he produces a medical certificate of fitness from the medical board duly authorized by the Provincial
Government in that behalf.

Provided that the following grades of employees shall not be required to produce such
medical certificate, namely:-

(a) An employee in above grade 11, appointed in a temporary vacancy of


less than six months duration; and

(b) An employee in grades 1 and 11, appointed in temporary vacancy of


less than six moths duration.

(2) (a) The competent authority may require an employee to appear


before the Provincial Medical Board for Medical examination if, in its
opinion the employee is suffering from a disease which renders him
unfit for the proper and efficient discharge of his duties or from a
disease which is communicable and is likely to endanger the health of
other employees.

(g) If the Medical Board concerned after examining the employee, certifies that the
employee requires a period of absence from duty for the purpose of rest and
treatment and that there is reasonable prospect of his recovery, the competent
authority may grant his leave, including extraordinary leave, for such period as the
Medical Board recommends, provided that the same is due and admissible to the
employee, and the competent authority may do so as if the employee had himself
applied for the leave.

(c) (1) If Medical Board after examining the employee certifies that the
employee is permanently incapacitated for service the finding of the
Medical Board shall be communicated to the employee may, within
seven days of the receipt by him of the official intimation of the
findings of the Medical Board, apply to the competent authority for
review of his case. Such an application shall be accompanied by the
fee, the amount of which shall be determined by the Board of Directors.
The competent authority shall then arrange for the convening of a
reviewing Medical Board. If the reviewing Medical Board certifies that
the employee is permanently incapacitated for further service, the
competent authority may require him to retire from service, and may
grant him such amount by way of special contribution to Provident
Fund or Compassionate gratuity as may be admissible to him under
these Regulations.

(ii) in case the reviewing Medical Board Holds that the employee is
fit for Authoritys service, he shall be reinstated forthwith and
the period of his absence will be treated as on duty and the fees
deposited by him for getting his case revised by a Medical
Board will be refunded to him, if, however, the Board certifies
that the employee is not fit but there is reasonable prospect of
his recovery, the case will be regulated under the provisions of
clause (b) of this sub-regulation.

(iii) In case the employee concerned does not apply for a review of
his case within seven days of the receipt by him of the official
intimation of the findings of the Medical Board, the competent
authority may require him to retire from service and may grant
him special contribution to Provident Fund or Compassionate
Gratuity as provided for in sub-clause (1) above.

14. Determination.

Every person appointed by initial recruitment shall, at the time of appointment, declare
the date if his birth with confirmatory documentary evidence, such as a Matriculation Certificate, a
School leaving Certificate of a Municipal Birth Certificate in the absence of any such document, his
age shall be got determined from the authorized Medical Officer.

15. Departmental Examination for appointment.

The Board of Directors from time to time, every appointee to a post shall
have to pass the Departmental Examination, if any required for that post, within the specified period
and in the specified manner with no relaxation whatsoever. .

16. PROBATION.

a) A person appointed to a post whether by initial recruitment or by promotion on


substantive posts shall remain on probation for period of two years.

b) On the expiry of the period of probation employee shall be confirmed if found


suitable or the period of probation may be extended for a further period of one year. On completion
of an extended period of probation, the appointing authority shall either confirm his retention in
service if found fit otherwise terminate him.

17. LIEN.

(1) Except as otherwise provided in these Regulations, an employee in substantive


appointment to any permanent post acquired a lien on that post and cases to hold
any lien previously acquired on any other post.
(2) An employee cannot be appointed substantively to a post on which another
employee holds a lien.
(3) Unless his lien is suspended under Sub-regulation (4) of this regulation (5) hereof
an employee holding substantively a permanent post retains a lien on that post.

(a) while performing the duties of that post;


(b) while on foreign service, or holding a temporary post, or officiating in another
post;
(c) during joining time on transfer to another post; unless he is transferred
substantively to a post on lower pay; in such case his lien is transferred to the new
post from the date on which he is relieved of his duties in the old post;
(d) while on leave; and
(e) while under suspension,
(4) (a) The competent authority shall suspend the lien of an employee on a permanent
post which he holds substantively if he is appointed in a substantive capacity:-

(i) To a tenure post; or


(ii) To a permanent post outside the cadre on which he is born or
(iii) Provisionally to a post on which an another employee would hold a lien
or had his lien not been suspended under this Regulation.
(b) The competent authority may, at its option, suspend the lien of an employee
on a prominent post which he holds substantively, if, he is deputed out of
Pakistan or transferred to foreign service, or in circumstances not covered by
clause (a) of this sub-regulation is transferred, whether in a substantive or
officiating capacity, to post in another cadre, and if in any of these cases there
is reason to believe that he will remain absent from the post on which he hold a
lien, for a period of not less three years.

(c) Notwithstanding anything contained in clauses (a) and (b) of this sub-
regulation an employees lien on tenure post may in no circumstances, be
suspended, but if he is appointed substantively to another permanent post, his
lien on the tenure post must be terminated.

(d) If an employees lien on a post is suspended under clause (a) or clause (b) of
this sub-regulation, the post may be filled substantively and the employee
appointed to hold it substantively shall acquire a lien on it; provided that the
arrangements shall be reversed as soon as the suspended lien of the previous
employee revives.

(e) An employee lien which has been suspended under clause (a) of this sub-
Regulation shall revive as soon as he ceases to hold a lien a post of the nature
specified under sub-clauses (I), (ii) and (iii) of that clause.

(f) An employee lien which has been suspended under clauses (b) of this sub-
regulation shall revive as soon as he ceases to be on deputation out of Pakistan
or on foreign service or to hold a post in another cadre; provided that a
suspended lien shall not revive because the employee takes leave if there is
reason to believe that he will, on return from leave, continue to done
deputation out of Pakistan or on foreign service or to hold a post in another
cadre and the total period of absence on duty will not fall short of three years
or that he will hold substantively a post of the nature specified under sub-
clause (I), (ii) and (iii) of clause (a) of this sub-regulation.

(5) Subject to the provisions of Regulation 24, the competent


authority may transfer to another permanent post in the same cadre the lien of an employee who is
not performing the duties of the post of which the lien relates, even if that lien has been suspended.

(6) (a) An employees lien on a post may in no circumstances terminated, even with
his consent, if the result will be to leave him without a lien or suspended lien
upon a permanent post.

(b) In the case of an employee whose lien on permanent post has been suspended on
his appointment in a substantive capacity permanent post outside the cadre on
which he is borne, the suspended lien may not, except on the written request of
the employee concerned be terminated while the employee remain in the services
of the authority.

(1) Two or more employee cannot be appointed substantively to the


same permanent post at the same time.

(2) An employee cannot be appointed substantively, except as a


temporary measure to two or more permanent posts at the same time.

18. TRANSFER.

(1) All employee of the authority are liable to transfer to any post/ office/section of the
authority or any other office/Authority subject to approval by the Administrative
Department from grade BP-1 to BP-17 and the Government of Balochistan for the
officers in BP-18 and above.

(2) Refused to obey to proceed on transfer from one place to another shall be misconduct
on the part of an employee in that event he shall be liable to disciplinary action.

19. Seniority

(1) A category/Grade-wise Seniority list in various cadres of regular employee in


the service Authority shall be maintain.

(a) In the case of employee appointed by initial recruitment, seniority will be


determine in accordance with the order of merit assigned by the Selection
Committee appointed for that purpose.

Selected for the service in an earlier selection shall rank senior to the person selected
in a latter selection.

(b) In the case of employees appointed by promotion or by selection in the


case of selection posts subject to the provision of sub-regulation (2) of his
Regulation, seniority will be determined with reference to the date of
continuous appointment to that post provided that if the dates of continuous
appointment of two employee is the same, there interest seniority will be
determined on the basis of the position held by them in the next lower
grade. In case of a tie in the next lower grade, the older employee shall

rank senior to the younger employee or employees except in the case of


selection posts where seniority in the higher grade shall be determined on
the basis of merit assigned by the selection committee.

Explanation-I, if a junior employee in a lower grade is promoted to a


higher grade temporary in the public interest, even through continuing later permanently in the
higher grade, it would not adversely affect the interest of his senior in the fixation of his seniority in
the higher grade.

Explanation-II, if a junior officer in a lower grade is promoted to a


higher grade by superseding a senior officer and subsequently that officer is also promoted, the
employee promoted first shall rank senior to the employee promoted subsequently.

(2) seniority in the various cadres, of post of the holder appointed


thereto by initial recruitment vis-avis those appointed otherwise shall be determined as under:-

(a) in case both the officer appointed by initial recruitment an those appointed
otherwise have been appointed against substantive vacancies with
reference to the date of appointed to such vacancy in the case of the officer
appointed by initial recruitment and to the date of continuous appointment
against such vacancy in case of an officer appointed otherwise, provided
that if the two dates are the same; the employee appointed otherwise shall
rank senior to the employee appointed by initial recruitment.

(b) In case the officer appointed by initial recruitment has been appointed
against a substantive vacancy and the officer appointed otherwise been
appointed against a temporary vacancy, the former shall rank senior to the
later in case their dates of appointment are the same.

20. Resignation.

(1) An employee may resign his appointment after giving notice of


his intention to do so or by forfeiting pay in lieu thereof. The period of notice shall be: -

(a) Fifteen days in the case of probationers:


(b) One month on the case of temporary employees; and
(c) In case of 24 hours one month basic pay will be deposited.

(2) The employee shall forfeit his pay for the unexpired period of
notice in case he wants to be relieved of his duties before the expiry of the notice period. The
authority may, however, relieve of his duties at any time.

Provided that the resignation will be effective in case of permanent/regular


employee on its acceptance by the competent authority.

(3) If a permanent/regular employee leaves service before acceptance


of his office, he shall be liable to dismissal from service.

(4) Resignation once accepted shall not be withdrawn.

21. Cessation of service.

The service of an employee may cease in the following circumstances:-

(1) By resignation subject to the provisions of the foregoing regulation


33 of these Regulation.

(2) By retirement or reaching the age of superannuation.

(3) By compulsory retirement due to permanent disability which in the


opinion of the Medical Board renders him unfit for the service.

(4) By removal, dismissal or compulsory retirement from service as a


penalty in according with the Balochistan Province Removal from Service (Special Powers)
Ordinance, 2000 made for the purpose.

PART- IV.

22. Explanation.

Officiating service and service spent on deputation to a corresponding or a


higher post shall be reckoned as period spent on probation.

If the work and conduct of an employee during the period of probation has been found
unsatisfactory, the competent authority may, notwithstanding that the period of probation has not
expire;

(a) If the employee has been appointed by initial recruitment, dispense with his
service without notice; or

(b) If he has been appointed otherwise, revert him to his former post, or, if there be no
such post, dispense with his services.

23. If the work or conduct of an employee, on completion of the period of probation is


found unsatisfactory the competent authority, in case of the category of employee concerned may;

(a) In case the employee has been appointed by initial recruitment,


dispense with his service without notice; or
(b) In case he has been appointed otherwise, revert him to his former post,
and, if there be no such post, dispense with his services; or
(c) Extend the period of probation by an additional period of not more than
one year at a time and not more than two years in all.

24. (1) Subject to the provisions of sub-regulation (2) of this Regulation;

(a) On completion of the period of probation by an employee, if his work


or conduct has not been found unsatisfactory, the competent authority
may pass orders declaring that he has completed his probationary
period satisfactory.

(b) If no such orders have been made by the competent authority by the
day following the completion by the employee of the initial period of
probation, the said period shall be deemed to have been extended by
two years, unless specially terminated earlier by the competent
authority on receipt of a satisfactory performance report regarding the
employee from the concerned officers.

(c) If no order have been made by the date on which the maximum
additional period of probation expires, the employees probationary
shall be deemed to have been terminated with effect from the date on
which the period of probation was last extended or may be deemed to
have been so extended.

(1) (a) No person shall be declared to have completed the probation period
satisfactory, or promoted to a higher post unless he successfully completes
such training and passes such departmental, examination as may be
prescribed by the Authority from time to time.

(a) If the holder of a post fails to complete successfully any training or to


pass any departmental examination prescribed by the Authority within
such period or in such number of attempts as may be prescribed by the
Authority, the competent authority may:-

(1) If in case the employee has been appointed by initial recruitment,


dispense with his services
(2) In case he has been appointed otherwise, revert him to his prior post,
and/or if there be no such post, dispense with his service.

25. The competent authority may for reasons to be recorded in writing relax the
provisions of these Regulations in individual cases of persons already in service in such manner as
may appear to it to be just and equitable, and where it is satisfied that the strict application of the
Regulations would causes under hardship to the individual concerned:

26. Relaxation. Any of the rules may for reason to be recorded in writing be
relaxed in individual cases if the competent authority is satisfied that strict application of these rules
would cause under hardship to the individual concerned.

27. General Rules. In all matters not expressly provided for in these rules
that employee of Authority shall be governed by such rules as have been or may here after be
prescribed by the Government.
