PETITION
COMES NOW, the petitioner, through his undersigned counsel, unto this
Honorable Court, most respectfully states:

1. That the Petitioner VIENTE NEPOMUSINO, is of legal age, married, Filipino

citizen, and a resident of Cityland, Suite 508, Villegas Street, Legaspi Village,
Makati City, where he can be served with summons, notices and other legal
processes of this Honorable Court;

2. That the Petitioner is the twin brother of deceased SINGKWENTA

NEPOMUSINO, who died unmarried and without any issue on May 16, 2016 in
the Makati Medical Center (MMC) as shown by the copy of Death Certificate
hereto attached as ANNEX A and made an integral part hereof;

3. That said decedent, prior to his death, had lived in the house and company of the
Petitioner at least 10 years as shown by the copy of Barangay Certificate hereto
attached as ANNEX B and made an integral part hereof;

4. That the Petitioner has in his possession a document consisting of one

handwritten page which is testamentary in nature, a photostatic copy of which is
hereto attached as ANNEX C and made an integral part hereof. The original
copy thereof to be presented to this Honorable Court at the time of the probate;

5. That said document titled HULING HABILIN, which was dated May 15, 2016
and entirely in the handwriting of the decedent whose signature appears thereon,
has named and constituted the Petitioner an executor and to whom the decedent
solely bequeathed his real property (house and lot) under TCT No.
_______________, a certified true copy of which is hereto attached as ANNEX
D, valued at FIVE MILLION (P5,000,000) PESOS as per copy of Tax
Declaration hereto attached as ANNEX E, containing an area of 89 square
meters, more or less, and situated in Buendia Avenue, Brgy. San Lorenzo, Makati
City;
 6. That the decedent, aside from the Petitioner, is also survived by his younger
sister EMMALYN LLAMANSAREZ, of legal age, married, Filipino citizen, and a
resident of Barangay Baybay, Catarman, Northern Samar, where she may be
served with summons, notices and other legal process of this Honorable Court;

7. That the Petitioner named in HULING HABILIN as an executor thereof is of

sound and disposing mind and legally capacitated, qualified and competent to
assume the appointment as such, and to dispose of the decedents estate by will;

8. That the Petitioner is not aware of any instrument revoking the same and he
believes it to be the decedents last will;

PRAYER
WHEREFORE, premises considered, it is most respectfully prayed that judgment
be rendered declaring the following:

1. That, upon proper notice, publication and hearing, the HULING HABILIN
which constitutes the holographic will of the late SINGKWENTA
NEPOMUSINO be ALLOWED and ADMITTED to probate;

2. That the letters of testamentary be ISSUED in favor of the Petitioner

VIENTE NEPOMUSINO, allowing the disposal or conveyance in his favor
of the ownership of the real property under TCT No. __________, without
filing of any bond;

Such other reliefs and remedies as may be deemed just and equitable under the
premises are likewise prayed for.
