1 NO OPPOSITION HAS BEEN FILED
2 On June 25, 2010, pursuant to Rule 12(b)(1) of the Federal Rules of Civil 3 Procedure, Defendant Barack Obama filed his motion to dismiss on the grounds 4 that this Court lacks subject matter jurisdiction over this case, as Plaintiff lacks 5 standing to bring it and, further, as it presents non-justiciable political questions. 6 Plaintiff was required to file her opposition no later than July 6, 2010. See Local 7 Rule 7-9. As of July 9, 2010, no opposition had been received by this Office. A 8 review of Pacer at the time of filing this reply indicates that no opposition had been 9 docketed. 10 Plaintiff’s failure to file an opposition provides an independent ground for 11 this Court to grant Defendant’s motion. Under the Local Rules, “The failure to 12 file any required paper, or the failure to file it within the deadline, may be deemed 13 consent to the granting or denial of the motion.” Local Rule 7-12. In addition to 14 the reasons set forth in the moving papers, therefore, Plaintiff’s failure to file an 15 opposition constitutes an additional ground for this Court to grant the motion. 16 Accordingly, for the reasons set forth in the moving papers and in this reply 17 brief, this Court is respectfully requested to grant President Obama’s motion to 18 dismiss the complaint in its entirety without leave to amend. 19 Respectfully submitted, 20 DATED: July 9, 2010 ANDRÉ BIROTTE JR.
