Note on RTS and Appeal thereon for challenging legality of entry No.

1850 dated
27/05/1995 under Bombay Land Revenue Code before Dy. Collector, Collector
and Secretary, Revenue Department, Govt. of Gujarat.

1. The legal heirs of Late Mr. Bhagvanbhai Punjabhai filed RTS No. 307/2009 before Dy
Collector, Vadodara challenging the validity of entry no. 1850 dated 27/01/1995 under Rule
108(5) of Gujarat Land Revenue Rules, 1972 against legal heirs of Late Mr. Maganbhai
Mangalbhai Makwana and Dinesh Remedies Limited (DRL) and after consideration of DRL
submission the Dy. Collector dismissed the RTS vide Order dated 23/08/2010 (Copy of the
order is attached: Annexure I)

2. The Legal heirs of Late Mr. Bhagvanbhai Punjabhai filed appeal against the order dated
23/08/2010 passed by the Dy. Collector, Vadodara before the collector Vadodara under
Section 204(8) of the Bombay Land Revenue Code being RTS/R.A./134/2010 which was
as dismissed by the collector, Vadodara vide order dated 03/04/2012 after considering
submission of DRL. (Copy of the order is attached: Annexure ll)

3. The legal heirs of Late Mr. Bhagvanbhai Punjabhai filed appeal along with Stay application
against the order dated 03/04/2012 passed by the Dy. Collector , Vadodara before the
Chief Secretary, Revenue Dept. and the stay application was dismissed by the Chief
Secretary Revenue Dept. Govt. of Gujarat vide order dated 20/10/2012 after consideration
of submission of DRL. (Copy of the order is attached: Annexure-lll)

 The Note on Special civil Suit No. 114/2005 (New No. 91/2006)

1. DRL followed Due process of law, taken Title Clearance Certificate and thereafter,
Purchased the Land bearing old Revenue Survey No. 188/2, Block No. 339P admeasuring
3506 Sq. meters out of total land admeasuring 7254 sq. meters (i.e. less than 50% of Total
Land) Vide Registered Sale Deed on 24/02/2005.

2. Late Mr. Punjabhai Haribhai had Voluntarily relinquished his share from Block No. 339 in
favour of Late Mr. Maganbhai Mangalbhai and as a result thereof the name of Punjabhai
was deleted from revenue record vide entry No. 1850 dated 27/01/1995 which was
certified on 28/03/1995. Copy of the entry No. 1850 dated 27/01/1995 is attached as
Annexure-A

3. The legal heirs of Late Mr. Punjabhai Haribhai filed Special Civil Suit No. 114 in 2005 in
the Court of C. J. (S. D.) Vadodara (i.e. Suit for declaration and injunction) on 08/04/2005
against legal heirs of Late Maganbhai Mangalbhai and DRL and after hearing both the
parties the Honble Court dismissed the interim injunction application vide order dated
05/01/2006. Copy of the Civil Suit alongwith the Order passed the Honble Court dated
05/01/2006 are attached as Annexure B and Annexure C. The Special Civil Suit No.
114/2005 is transferred to Padra Court and registered as Regular civil suit no. 91/2006
which is pending.

4. The legal heirs of Late Mr. Punjabhai Haribhai filed Misc appeal No. 50/2008 in the
Honble District High Court against the order passed on 05/01/2006 in the Civil Suit No
114/2005 by Honble Court C. J (S. D.) Vadodara. No Order is passed so far. Copy of the
Misc appeal No. 50/2008 is attached as Annexure -D

5. The legal heirs of Late Mr. Punjabhai Haribhai also filed Civil Suit No. 139/2008 in the
Court of Civil Judge (S. D.) Padra (i.e. Suit for establishment of Rights & Injunction) on
23/10/2008 under Section 41(H) of Specific Relief Act, against legal heirs of Late Mr.
Maganbhai Mangalbhai and DRL and after consideration of submission of the parties,
Honble Court observed that the present suit Is not maintainable under Section 41(H) of
the Specific Relief Act and also dismissed the interim injunction application vide order
dated 31/08/2009. A copy of the Order is attached as Annexure -E

6. The legal heirs of Late Mr. Punjabhai Haribhai filed Misc Civil Appeal No. 172/2009 in the
District Court, Vadodara against the Order dated 31/08/2009 passed by the Civil Judge (S.
D.) Padra and the same is pending. Copy of the Misc Appeal No. 172/2009 is attached as
Annexure - F
