tija
8 THE COURT: Class C felonies? Mr. Patrick --
9 Mr. Fitzpatrick, do you understand what the charges are
10 against you?
11
12

DEFENDANT FITZPATRICK: I do not.
THE COURT: Okay. Well, then I will read them

b.c
5 In count three -- I will not take any papers
6 handed to me by this defendant here today. Do you
7 understand that, sir? By your silence, I will presume you

tija

b.c
5 County, Tennessee, and before the finding of this
6 indictment, you did unlawfully and knowingly harm or
7 threaten to harm a juror, to wit: Gary Pettway, by an

tija
8 unlawful act, in retaliation for actions taken by Gary
9 Pettway in an official capacity as a juror, in violation of
10 TCA Section 39-16-510, all of which is against the peace
11
12
oli
and dignity of the State of Tennessee.
And in count six, the allegations are that on or
13 about the 2nd day of December, year 2009, on the 1st

of

17 GENERAL STUTTS: Your Honor, we would

18 again tender to the Court information generated by
19 either this defendant or other persons acting on his
ds

21 pending trial that conditions similar to those imposed
ien

23 THE COURT: Are you submitting these as
24 exhibits?
25 GENERAL STUTTS: We are submitting those

6 you'll enter this as exhibit one, please.

9 THE COURT: Mr. Fitzpatrick, for your benefit, I
10 will again -- you make allegations here against me in this

truth, there is Judge Carroll Ross' installment a few
13 weeks ago of Mr. Gary Pettway as foreman to the Monroe
P
14 County Grand Jury for a 27th consecutive year." Your
15 second truth is totally false. I have never appointed a
16 Grand Jury foreman to this county, nor will I ever. That's

17 not one of my responsibilities. I presume all of your

18 other so-called truths are just as inaccurate, but I will
19 tell you again, it would not bother me one bit if I had
ds

20 appointed Mr. Pettway. He has done a good job. I would

21 be proud to say that I had appointed him, but in fact, as a
ien

22 matter of fact, I did not. I have never appointed a Grand

2 THE COURT: Exhibit four submitted by the
3 State is an order of instruction that I signed for the
4 Monroe County Grand Jury so that they would

b.c
5 understand there is no way any county Grand Jury in any
6 state, in any part of this country can consider any
7 federal issue. Anyone who has a smidgen of knowledge

tija
8 of the Constitution ought to know that. I signed this
9 order on April the 1st; it was submitted to the Grand
10 Jury. And specifically, no Grand Jury of Monroe County
11
12
oli
or any other Grand Jury of any county in any state in the
United States of America can consider any evidence on
13 treason of anybody. And once again, anyone who
P
14 professes a smidgen of information about the
15 Constitution ought to know that. That will be exhibit four
16 to this hearing.

19 THE COURT: Exhibit number, the next one --
ds

20 General, this appears, what, to be some bogus citizen's

21 arrest warrant that's been passed around, is that
ien

22 correct?
23 GENERAL STUTTS: It was presented, yes.
24 THE COURT: And an affidavit of complaint.
25 Ms. Cook, your name's on here. It appears Mr.
Fr

3 against the United States?
4 MS. COOK: I don't think so, Your Honor.

b.c
5 DEFENDANT FITZPATRICK: Are you making
6 fun of me? Is that what's going on here? Am I being
7 mocked?

tija
8 THE COURT: If you'll mark this as the next

16 sir. Your attorney can get you copies of anything from
of

17 the file.
18 DEFENDANT FITZPATRICK: I'm representing
19 myself. I'd like copies of everything that you've just
ds

20 handed as an exhibit.
21 THE COURT: The next exhibit appears to be
ien

22 one of the typical harangues on websites about how

23 awful people are here in Monroe County, calling us all
24 good ole boy gestapos; says that we're cowardly and evil
25 people here in Madisonville, Tennessee; says we have a

2 DEFENDANT FITZPATRICK: Where does that

4 THE COURT: I don't know, sir. It appears to be

b.c
5 someone is making references to you here.
6 DEFENDANT FITZPATRICK: Could you please
7 describe the document you're holding?

tija
8 THE COURT: If you will mark that as the next

10 (EXHIBIT NUMBER SIX MARKED AND

DEFENDANT FITZPATRICK: I guess not.
13 THE COURT: (Brief pause) General, what is
P
14 this next thing? It appears to be -- what is this, arrest
15 record --
16 GENERAL STUTTS: The last one is Mr.
of

17 Fitzpatrick's criminal information from the state of

18 Washington. It's to exhibit, Your Honor, that he has in
19 fact in the past taken violent actions against persons
ds

20 who in fact represented him during legal proceedings.

21 Essentially, that's to let the Court know that there is a
ien

22 concern that the State legitimately has with regard to his

23 bond and his freedom in light of the charges of
24 retaliation against a public official, but also the count for
25 civil rights intimidation.
Fr

b.c
5 appears to be out of, what is that, Kitsap County in
6 Washington, is that correct, sir?
7 GENERAL STUTTS: Yes, sir.

tija
8 THE COURT: There are allegations here of
9 civil anti-harassment order, violation of a civil anti-
10 harassment order, interference with the booking
11
12
oli
procedures at the jail, coercion by use of threats, fraud
charges, a victim who, some kind of civil anti-
13 harassment --
P
14 DEFENDANT FITZPATRICK: These are
15 allegations that have nothing to do with what's going on

Yes, sir.
13 THE COURT: Would you tell the Court the

19 THE COURT: Okay. And how much time have
ds

20 you been having to devote to him on a regular basis?

21 A Well, this started last August. I don't, I didn't

23 any other defendant.
24 THE COURT: Okay. Has he brought you

Fr

Direct by Court of Marty Cook Page -13-

1 A Yes, sir.
2 THE COURT: What kind of papers have those

4 A Just numerous statements, motions to -- I

b.c

6 his criminal file. There are all sorts of statements and
7 just miscellaneous things that he files.

tija
8 THE COURT: Has he brought you any papers
9 that have nothing to do with anything going on in this
10 county?
11
12

Well, yes.
THE COURT: Such as?
13 A Well, he's, you know, brought books, lots of
P

15 THE COURT: Concerning what, Ms. Cook?
16 A Concerning the indictment of President Obama,
of

17 Harry Reid, Nancy Pelosi, everybody in the whole world.

18 DEFENDANT FITZPATRICK: That's not true.
19 THE COURT: (Brief pause) Mr. Walter
ds

20 Fitzpatrick, I will sign this order of recusal here today. I

21 will not be able to hear the case. I will say to you the
ien

22 same thing I said earlier to Mr. Huff. You will need to
