Government of the Republic of Moldova

The Moldovan government

The Government provides, under the Constitution, development and foreign


policy of the state and the general management of public administration. The
government is organized and functions in accordance with the Constitution, based
on a government program previously accepted by parliament. It consists of a head
appointed Prime Minister, a Deputy Prime Minister, Deputy Prime Ministers,
Ministers and other members established by organic law.

Government carries out domestic and foreign policy of the state, the general
management of public administration and is accountable to Parliament.

The government formed following members: Prime Minister, Deputy Prime


Minister, Deputy Prime Minister, Ministers and other members established by law.
Members of the government can be only persons holding Moldovan citizenship
and live in the country.

The President, after consulting parliamentary factions nominate a candidate


for prime minister. The candidate for prime minister within 15 days of the
designation requires parliamentary vote of confidence on the activity program and
the entire list of the Government. President, in the vote of confidence of
Parliament, appoints the government. Within three days of the appointment of the
Government, Prime Minister, Deputy Prime Ministers, Ministers and other
Government members submitted individually to the Presidential oath text of which
is set out in article 79 par. (2) Constitution. In the event of government reshuffle or
vacancy of office Moldovan president dismisses and appoints the Prime Minister's
proposal, some members of the Government. The Government shall exercise the
mandate from the day of taking the oath by members before the Presidential
election and before validation for a new parliament.

The government is accountable to Parliament for its work and at least once a
year, take to Parliament a report on its activity. Government members are obliged
to reply to questions from Members on the Government and subordinated bodies as
established. Parliament committees examine government decisions regarding the
Government and subordinated bodies, the Commission the results of the
examination decisions or action taken on them.

Government Meetings are conducted as appropriate, but not less than once
per quarte. The agenda for meetings shall be approved by the Government at the
proposal of the Government Presidium.

Guvernment Presidium

To coordinate internal activities of the Governament and in order to approve


the draft agenda of Government meetings, which formed part of the Government
Presidium Prime Minister and Deputy Prime Ministers. Government Presidium
Meeting is convened by the Prime Minister and are considered deliberative if all
the members of the Presidium. In the absence of a Deputy Prime Minister, he shall
delegate for full participation in meeting another member of the Government. The
resolutionof the Government Presidium are adopted concensus.

The duties incumbent government If vote of no confidence by Parliament, where


the Prime Minister's resignation or the election of a new parliament, the incumbent
Government (outgoing) shall only control the administration of public affairs to the
sworn members of the new Government.

The main tasks of the government in office (outgoing)

The period during which the outgoing government is limited in its right to
ensure the achievement of foreign policy and legislative initiatives involving the
development and approval of new programs of work. alive transposing laws,
regardless of the area covered by them;

general management function and exercise control over the activity of


central specialized bodies;

realize economic and social development programs of the country;

ensure state security and its citizens, fulfilling the functions of administering
public affairs;

undertake any activity leadership and management in matters of the whole


society.

To achieve the tasks set out the Government:

approves decisions and orders the execution of laws;


approves legislative initiatives;
prepare and submit to the Parliament the draft state budget law, Parliament
proposes legislative initiatives: RESIGNATION

The government (in corpore), and each member of the government, has the
right to resign on his own initiative.

Resignation of Prime Minister leads to the resignation of the government in


full composition.

The resignation of the prime minister and the entire government presents
composition of Parliament, which shall act on them.

Resignation of members of the Government presents the Prime Minister and


brought to the knowledge of the President.

In order to ensure scientific support and a maximum correlation with the


legislative framework, projects the most important government laws and
regulations to be approved as established by the Academy of Sciences of Moldova,
as well as other scientific institutions in the field.

The draft decision, accompanying ordinance attached file, which will

317-XV of 18 July 2003 on normative acts of the Government and other authorities
of central and local government. Government Meetings Government meetings are
public, shall be convened as decided by the Prime Minister of Moldova, and
conducted as appropriate, but not less than once per quarter. The decision of the
Prime Minister, meetings may be closed. Government participating in the meetings
of Directors General of Departments under the Government and other persons in
accordance with the law. Persons invited in the manner established by law at a
cabinet meeting, which are not part of the composition of the Government, attend
meetings, usually only during the examination of the issues related to their work.
Government may attend the meetings of parliament deputies, are entitled to attend
and take the word of the Ombudsman, the Ombudsman for Children's Rights,
Deputy Ombudsman. The presence of other people (experts, specialists)
coordinates with Director of the State Chancellery.
