Resumen
Miguel Carbonell analiza detalladamente el sentido estricto del artculo
sexto constitucional que establece la libertad de expresin en Mxico.
Cuestiona y argumenta la direccin del mismo a autoridades adminis-
trativas y judiciales excluyendo al Poder Legislativo. De forma completa
desarrolla las caractersticas de la libertad de expresin, sus lmites y
alcances dentro de la legislacin y jurisprudencia mexicana en materia
de medios de comunicacin, para retomar el caso particular desde la
ptica de la experiencia comparada. Finalmente, deja testimonio de las
diferencias que pudiera tomar el sentido de la libertad de expresin en
Mxico si la legislacin comprendiera de igual manera al Legislativo.
Abstract
Miguel Carbonell provides a detailed analysis of a strict interpretation of
article six of the Mexican Constitutional that codifies freedom of speech
in the country. The author questions and argues the sense of the cons-
titutional article in relation to administrative and judicial authorities, ex-
cluding the legislative branch of government. Carbonell fully develops
the characteristics of freedom of speech, its limits and scope in Mexican
legislation and jurisprudence in relation to the media, from the standpoint
of the comparative experiences in the field. Finally, he explains that the
differences that the meaning of freedom of speech could acquire in
Mexico if the countrys legislation on the issue also extended to the
legislative branch.
