A mitigation plea specifies reasons for the Court to consider imposing a lighter
sentence on you than it ordinarily would. For example, whether you are a first
time offender, family background, educational qualification, medical history,
when you pleaded guilty, cooperation with the police, long-standing behaviour,
remorse. This takes place after pleading guilty, and presents an opportunity to
ask for a lighter sentence.
Representations, on the other hand, are made by your lawyer on your behalf to
the Prosecution at any stage of proceedings. They contain statements which will
be considered by the Prosecution. If they agree, the Prosecution may withdraw or
amend charges or take them into consideration for sentencing purposes. They
cannot be made after you have entered an unconditional plea of guilt. The judge
also does not know of the contents of the representations.
