(3) Unless otherwise provided by law or in this chapter, the hearing before a referee and

13 Disorderly conduct. Whoever, in a public or private place, engages in violent, abusive,

indecent, profane, boisterous, unreasonably loud or otherwise disorderly conduct under
14 circumstances in which the conduct tends to cause or provoke a disturbance is guilty of a
Class B misdemeanor.

An attorney was properly convicted under this section for refusing to leave a ward in a mental
16 hospital until he had seen a client after having made statements in the presence of patients that
caused some to become agitated. State v. Elson, 60 Wis. 2d 54, 208 N.W.2d 363 (1973).

Milwaukee 63.01. - Disorderly conduct.

(1) No person shall engage in violent, abusive, indecent, profane, boisterous, unreasonably
19 loud, or otherwise disorderly conduct under circumstances in which such conduct tends to
cause or provoke a disturbance within the county.

(2) Any person violating the provision of this section of the Code shall, for each offense, forfeit
21 a penalty not to exceed two hundred fifty dollars ($250.00); the cash deposit thereof shall be
one hundred dollars ($100.00) and the penalty assessment shall be fifteen dollars ($15.00), and
22 in default of payments thereof, shall be imprisoned in the county jail or the house of correction
of the county for a period not to exceed ninety (90) days in the discretion of the court.

FACTS

1. On or about 22 March, 2017 Referee James J. Winiarski ruled, over a bellowing Objection
25 by Attorney Mark W. Rattan, that I had not violated any Law or Rule of the Case with the

1 single exception of the one (1) time a mechanical malfunction failed to shut down my
camera during a recess.

2. In so doing Referee Winiarski expressly held that I was entitled to take full video/audio and
3 occasional still photographs of the public proceedings. The ruling was crafted after I had
taken three (3) still photographs of Attorney Mark W. Rattan from across the table with a
4 Canon DSLR camera extremely similar to one owned by Referee Winiarski. One such
picture with Attorney Rattan rudely pointing a finger at me appears below:

3. On or about 23 March, 2017 Referee Winiarski and I were engaged in a principled
11 discussion about proper decorum and the limits of the First Amendment when Attorney
Mark W. Rattan alighted from his chair, screamed in a very loud voice that he didnt want
12 those cameras in his face, and marched briskly toward me and/or my camera,
approximately 15 feet around a table at the end of the room.

4. A picture of the 3.5 camera, a Sony AS-100V, may be seen below. It was stationary and
14 mounted on a tripod on the opposite side of the room, approximately 10 feet away from
Attorney Mark W. Rattan.

5. As he approached my area I then alighted from my chair and stated dont touch my
20 camera, whereupon Attorney Mark W. Rattan did indeed grab my camera and my hand
with substantial force in a manner designed to intimidate, vex, harass and annoy me. The
21 first picture on the cover page of this filing was taken as a screen capture as Atttorney
Rattan backed away from the impact.

6. Attorney Mark W. Rattan is approximately 6 tall, 190 pounds. I am 510 165 pounds.
23 Whether or not I could take him in a fight I dont know and I dont care to know because
physical altercation and threatening conduct is not my modus operandi.

7. I do not want cameras in my face, he stated again as he retreated to his side of the room
25 as I reminded him This has already been ruled on, Counselor.

1 8. Referee James J. Winiaski then implored him to deal with this in a mature, appropriate
professional fashion.

9. Whereupon I stated, I have been.

10. The impact tweaked my right pinky finger but I am not certain that it caused any additional
4 injury given that it was already injured from a skiing accident several years ago.
5 11. I am not aware of each and every motivating factor behind the attack on my person and
equipment, but I routinely help homeowners deal with Wells Fargo on second mortgage
6 settlements and know them by my personal experience to be one of the dirtiest companies I
have ever dealt with. They have gone so far as to have a published manual describing how
7 to manufacture documents to create the appearance of Real Party in Interest or Standing to
Foreclose that is at issue in this case as it was and is in the New York Bankruptcy case of
8 Franklin v. Wells Fargo NY Bankruptcy case no 15-CV-1701 before Judge Robert Drain

10 [T]he blank indorsement, upon which Wells Fargo is relying, was forged, wrote
Drain in a stinging rebuke to the bank. Nevertheless it does show a general
11 willingness and practice on Wells Fargos part to create documentary evidence, after-
the-fact, when enforcing its claims, WHICH IS EXTRAORDINARY (emphasis in
12 original).
13 12. But thats not all. I recall two years ago another contracted Wells Fargo attorney Howard
Apgar referred to an elderly woman in a shady foreclosure case as a nigger, and he
14 admitted it during my phone interview.

13. I am sick and tired of these Wells Fargo attorneys believing and acting as if they can just
2 say or do anything whenever a pesky black person challenges their authority and I will
never tolerate it.

14. After I called the police they send out two officers, Peter Graber and Greg Geniesse, one of
4 whom misstated the Law in telling me that they could not charge this white man of
privilege with Assault/Battery or even Disorderly Conduct, which is simply not true given
5 the plain reading of the Statute.
15. I told said Officer that As a black man there is no way in hell I could do what he did and
6 get away with it uncharged or not thrown out of that hearing.
7 16. I asked States Attorney Paul W. Schwarzenbart if he would be representing my interests

when I pursue an ethics charge against Attorney Mark W. Rattan because no journalist in
8 America should ever fear for the safety of his or her equipment or bodily injury, especially
at the hands of an duly-licensed attorney.

17. Attorney Schwarzenbart declined to answer yet it was he who initiated the move to have
10 me ejected by noting that I appeared to be taking a picture when in point of fact I was
merely adjusting my camera in anticipation of asking to take another picture. His
11 interjection interrupted the proceedings more than I would have as I would have waited
until a pause in questioning.

2 stand me either but he at least knows the law and did not interfere with the free exercise of
my Constitutional and Statutorily-granted Rights: I shot him in his Courtroom and I shot
3 him in the elevator, completely without incident after he allowed Anchor Bank to
unlawfully foreclose over the objection and investigation of Congresswoman Tammy

1 ADDENDUM
The Referee is James J. Winiarski Esq. He acted in concert and in violation of several
2 Constitutional and Statutory guidelines with Mark W. Rattan, Esq -- the ill-tempered attorney who
traversed 10' of room to attack me about a still-mounted (tripod) 3.5" Sony Action camera that was
3 "in his face." Rattan did this in direct violation of a specific Court Order because the banks and
their attorneys cannot control truly independent media and they are fearful of it.

The Referee's failure to admonish Attorney Rattan for his threatening and abusive actions
5 that clearly constituted a breach of the peace under state and local code represents an
unlawful Chilling of my First Amendment Rights and Responsibilities as a journalist. This is
6 particularly true given his consistent "warnings" levied at me for no reason, simply for
taking a handful of pictures from time to time. My picture count was low and I kept it that
7 way so as not to offend.
8 Notably, the Record will reveal that Referee Winiarski actually ejected me the moment I
asked him why he had not reprimanded Attorney Rattan and when I indicated that I would
9 take the matter up with the Wisconsin Supreme Court, and that I was done talking. So he
punished me and the Cause of the First Amendment and the Cause of Justice and open
10 government in Ms. Noras case because of my notice of intent to exercise my lawful right of
review, and thats a fact.

These events occurred the way in which they did because of unlawful bias against the
12 explication of banking including robo-signing, forgery and fraud that has run rampant in the
mortgage industry for the past decade.

I was an escrow attorney who started Mortgage Movies Journal 6 years ago to document the fraud
14 and unlawful foreclosures that I helped perpetrate and perpetuate many years earlier. The only
other time I was denied access was in Maryland where they stole the Recorder of Deeds election
15 from another honest person, a black man by the name of La Mar Gunn. He is the area NAACP
president.

Paul W. Schwarzenbart Esq. is the Office of Lawyer Regulation attorney who is prosecuting Wendy
17 Alison Nora Esq, for being a solid advocate for the people and for exposing robo-signing, forgery
