REGULATION ORDINANCE NO. 2012-045


AN ORDINANCE REGULATING THE SECURITY MEASURES IN
PUBLIC AND COMMERCIAL ESTABLISHMENTS, PROVIDING
PENALTIES FOR VIOLATION THEREOF AND FOR OTHER
PURPOSES"

Sponsored by Councilor Joshua C. Alim and unanimously second by the members


present,

WHEREAS, the Jloilo City Government, as a Local Government Unit is mandated by the
Local Government Code to adopt measures that would redound to the benefit and safety of its
constituents;

WHEREAS, the safety and security of the constituents and the people coming in to Iloilo
City are the primodial consideration of the I ilo City Government on top of their comfort and
convenience;

WHEREAS, Iloilo City is a fast improving Local Governrnent Unit and attracting more
investors and tourists both foreign and local. There is, therefore, an imperative need to adopt
measures to strengthen the security and safety procedures in public and commercial
establishments in order to protect them while staying in the City;

WHEREAS, in order to strengthen the security measures in mall establishments, the


Security Agency and Guard Unit (SAGU) under the Philippine National Police (PNP) issued a
SAGO Memorandum Order 08-02 dated September 23, 2010 requiring all the Security Agency
Operators for the mandatory establishment of secured fireann box in mall business
establishment;

WHEREAS> the Philippine National Police (PNP) further issued a Memorandum


Circular dated April 4, 2003 addressed to Security Agency Operators, Managers, and Guard for
the provision of metal detectors security equipment for guards posted in high-density public
areas such as but not limited to shopping malls, transport terminals, recreations, and commercial
establishment including access to utilities and other vital installations;

WHEREAS, one of the restrictions imposed for the holders of the Permit to Carry
Firearms Outside of Residence (PTCFOR) is that: the fireann shall not be brought inside the
places of worship, public drinking and amusement places and all other commercial or public
establishments. However, the restriction is seldom followed;

WHEREAS, there are legitimate gun holders who wanted to comply the restriction
imposed in the PTCFOR but some establishments have no secured firearm deposit box as
mandated by the SAGU Memo Order No. 08-02;

WHEREAS, there is a need to regulate the security measures in public and private
establishment with security guards to strictly require the security agency posted thereat to
provide metal detector to the guards on duty at the entrance and secured firearm deposit
box/vault in their establishment preferably near the entrance of such establishment;

Be it ordained therefore, by the Iloilo City Council that:

Section 1. Title - This ordinance shall be known as "ORDINANCE REGULATING


THE SECURITY MEASURES OF THE PRIVATE AND PUBLIC ESTABLISHMENTS
IN ILOILO CITY"

Section 2. Definition of Terms - The following terms as used in this Ordinance is


defined as follows:

a) Public Establishments - refer to establishments or offices of both national and


local governrnent unit, or any place that cater to public;
b) Private Establishments - refer to establishment owned by private individuals,
partnership or corporations that offer their services and business operations to
the general public.
c) Establishments - as used in this Ordinance, refers to the public and private
establishments.
d) VIP's - as used in this Ordinance is defined as persons holding position in the
Government such as President, Vice President, Senator, Congressman, elected
Local Government Officials, and Foreign Dignitaries.
e) Security Agency - refers to the legitimate agency engaged in Security
Services business duly license and registered before the government
regulating body.

f) Security Guard - refers to the person employed by the Security Agency posted
in the establishment under contract with the concerned establishment.
g) Metal Detector- refers to the electronic device designed to detect hidden metal
object.
h) Secured Firearm Deposit Box - refers to the safety box designed to secure the
fireanns and other weapons.

Section 3. Mandatory Provision of Metal Detector and Secured Firearms/Weapon


Deposit Box - Metal Detector shall be strictly provided for by the Security Agency in the
entrance of private and public establishments where they have contract of Security Services.

In entrances with two (2) lanes provided for male and female customers or clients, one
(1) metal detector shall be provided for each lane. Mall establishments shall designate separate
lane at the entrance for the customers with bags and other hand-carried items subject for
inspection.

Secured firearms and other weapons deposit box shall be likewise provided by the
Security Agency in a place of the establishments after proper coordination with the establishment
concern but preferably the box shall be installed near the entrance of the establishment for the
customers or clients' comfort and convenience. In addition thereto, a box filled with sand be
provided near the deposit box for the unloading of chamber load bullet and magazine.

Section 4. Permissive Share of Responsibility - The establishment and the Security


Agency are not prevented to agree in their contract of security services as to their respective
shares on their provision of metal detector and secured frrearm and weapons deposit box.
However, if there is no such specific provision in the contract, Section 3 of this Ordinance shall
apply. In case of an establishment-owned security, the responsibility on the provision of the
metal detector and fire arm deposit box shall be shouldered solely by the establishment.

Section 5. Responsibility of the Establishment - It shall be the responsibility of the


establishment to make sure that the security agency to which they have contracted shall comply
strictly the provisions of this Ordinance, and mere tolerance is not a justification on the part of
the establishment concerned.

Section 6. Responsibility of the Customers or Clients - Customers or clients shall


submit themselves to the Security Regulation Policy of the Establishment relative to the
compliance of the Ordinance. EXCEPT members of the PNP, AFP. PDEA, NB!, C!DG and
other Law Enforcement Agencies performing official duties and functions in agency prescribed

f uniform. Regular Permit to Carry Firearm Outside Residence (PTCFOR) will not be honored.
The security guard detailed in the entrance shall inspect the authority of a firearm or weapon
holder and report immediately to the nearest PNP Station or any PNP member present in the area
in case of a doubtful or irregular authority for verification. The security guard has the right to
prevent the customer/client entry in the establishment if there is a deliberate refusal to subject
himself or herself to the security measures implemented by the establishment.

Section 7. Churches and other place of worship are likewise covered by the Ordinance.
Individual going to church and other place of worship shall not be allowed to carry their firearm
in consonance with the conditions set forth in PTCFOR.

Section 8. Exemption. This Ordinance shall not apply, in addition to the exemption
mentioned in Section 6 hereof, to the members of the PSG Personnel securing the President of
the Philippines, PNP/PSPG Personnel and Licensed Protection/Security Agents securing VIP's

Section 9. Prohibition of bringing long firearm inside the establishment- long


firearms, regardless of the calibre, shall not be brought and displayed by the Security Guard,
PNP members securing the VIP's inside the establishment except for those guards of banking
and other lending institutions located inside the establishment but only limited to their respective
premises. All firearms of security guards on duty inside the establishments must be free of
chamberload.

Section 10. Penalty - Any violator of this Ordinance, after conviction, shall suffer the
imprisonment of three (3) months to six (6) months and a frne of Five Thousand Pesos
(PS,000.00).

In the case of the Security Agency, the owner shall suffer the penalty plus a revocation of
its business permit; Security Guard on duty who failed to comply the ordinance shall suffer the
penalty of six (6) months to one ( 1) year imprisonment.

In the case of a Corporation or Partnership the manager shall suffer the penalty of
imprisonment above-mentioned and revocation of business permit.

In the case of Public Establishments, the Head of Office shall be responsible for the
penalty.

Section 11. Transitory Provisions - Sixty (60) day period from approval of this
Ordinance is given to all establishments covered by this Ordinance to comply the provision on
fireanns safety box/vault deposit.

Section 12, Repealing Clause - All other Ordinances inconsistent with the provision of
this Ordinance are hereby repealed or modified accordingly.

Section 13. Effectivity - This Ordinance shall take effect after its publication in a
newspaper of general circulation in Iloilo City.
