REGULATION ORDINANCE NO. 2012-027


AN ORDINANCE PRESCRIBING THE PROPER HANDLING IN THE
COLLECTION OF SOLID, LIQUID AND TOXIC WASTES IN ALL
MEDICAL AND OTHER HEALTH CARE
GENERA TORS/ESTABLISHMENTS IN THE CITY OF ILOILO

WHEREAS, with the increase in residential populace, commercial and industrial business
in the city and the establishment of various medical and health care facilities, there is an increase
in generation of medical, health care and septic wastes;

WHEREAS, the need to provide an effective and proper handling in the collection,
transport, storage and disposal thereof is imperative tOr there are lack of proper collection,
treatment and disposal of the said wastes proved to endanger the health of the general populace,
not to mention its devastating effect on the environment~

WHEREAS, the City of Iloilo, finding the need to address the problem on the proper
disposal of such kind of wastes pursuant to existing environmental and sanitation laws and
regulations;

WHEREAS, the City Governn1ent may enter into public~private partnership to realize
and attain the objective in creating the proper handling in the collection of solid, liquid and toxic
waste in all medical and other health care waste generators/establishments in the City of lloilo;

WHEREAS, with the establishment and operation of the 1nedical health care wastes and
septic waste treatment facility, the city deems it appropriate to require the use of the facility in
accordance \Vith the condition hereunder contained.

NOW, 1'HEREFORE, foregoing premises considered, the Sangguniang Panlungsod of


the C:ity oflloilo, in regular session assembled, hereby ordains, that:

A. MEDICAL AND HEALTH CARE WASTES:

Section 1. ~ Health Care Wastes shall include, but limited to, all wastes generated as a
result of the following:

a. Diagnosis, treatment, management and immunization of humans or animals;


b. Research pertaining to the above activities;
c. Producing or testing of biological products; and'
d. Waste originating from minor or scattered sources (i.e. dental clinics, alternative
medicine clinics and other similarly situated sources)

Section 2. - Health Care Waste Ge11erators shall include facilities, institutions, business
establislunents and other similar health care services with activities or work process that generate
health care waste such as:

a. Infirmaries
b. Birthing Homes
c. Clinics
I. Medical
2. Ambulatory
3. Dialysis
4. Health care centers and dispensaries
5. Surgical
6. Alternative Medicine
7. Dental
8. Veterinary
d. llospitals (Primary Care, Secondary Care and Tertiary (~are)
c. Laboratories and Research Centers
1. Medical and Biomedical Laboratories
2. Medical Research Centers
3. Blood Banks and Blood Collection Services
4. Dental Prosthetics Laboratories
5. Nuclear Medicine Laboratories
6. Biotechnology Laboratories
7. Animal Research and Testing

8. Drug Testing Laboratories


9. HIV Testing Laboratories
f. Institutions
1. Drug Rehabilitation Centers
2. Training Centers for Embalmers
3. Med-Tech Inten1 Training Centers

5. Medical Schools
6. Nursing Homes
7. Dental Schools
g. Mortuary and Autopsy Centers
h. Drugs Manufacturers

Section 3. - Henceforth, the aforenamed establishments shall dispose of its medical and
health wastes only to the treatment facility installed and designated by the rloilo City
Goverrunent, otherwise approved by the Department of }lealth.

Section 4. - The aforementioned establishments shall closely coordinate with the


authorized personnel of the treatment facility in the collection, transport, storage and treatment of
said medical and health care wastes. Collection of the said medical and health care wastes by the
designated personnel of the treatment facility must be done daily and the establishments herein
mentioned shall not be allowed to store the same for a period more than twenty four (24) hours.

B. SEPTICWASTE:

Section 5. - Septic waste shall include, but not limited to, all wastes generated as a result
of human excretion and contained in any residential, commercial and industrial septic
containment facilities located within its respective premises in the City of lloilo.

Section 6. - I-Ienceforth, the aforenamed establishments shall dispose of its septic wastes
by its own processes or through another only to the Sewage Treatment Plant, installed and jointly
operated by the City Government and/or to any duly accredited and pe:nnitted septic waste
treatment facility.

Section 7. - Any person, natural or juridical, tn violation of this ordinance shall be


imposed the following penalty:
First Offense - P 3.000.00
Second Offense - P 5,000.00
Third Offense - P 5,000.00 and cancellation of business permit

Section 8. - Repealing Clause. - All other ordinances or parts thereof which are
inconsistent with the provision of this ordinance are hereby repealed, amended and/or modified
accordingly;

Section 9. - Effectivity. - '!'his ordinance shall take efl'ect fifteen (15) days ailer its
publication in a newspaper of local circulation.
