RE: Maryland Public Infonnation Act Request to


Anne Arundel County Police Department

With regard to your request for records dated September 17, 2008, directed to the Anne Arundel
County Police Department, please be advised that it has come to our attention that the Anne Arundel
County Police Department is in possession of another document that would be responsive to your request
dated September 17, 2008.

The document entitled "Enforcement Operation Plan" is a law enforcement investigative and
operation document created by the U.S. Immigration and Customs Enforcement (ICE). Access to this
document is being denied pursuant to § 1O-618(f) of the Maryland Public Information Act and 5 U.S.C. §
552(b)(7)(A), in accordance with the direction of ICE and ICE's previous denial of access to this record
See, 89 Maryland Opinions of the Attorney General 31, 44 (2oo4)(It is appropriate fur an agency to
withhold investigatory materials of another law enforcement agency if that agency itself would have
denied, or did deny, access under the investigatory exemption).

As access to this record has been denied, I am required to advise you that you may seek judicial
review of my response pursuant to § 10-623 of the Act. You also may file an appeal with the Associate
General Counsel (General Law), U.S. Department of Homeland Security, Washington D.C. 20528.

In addition, you previously spoke with Mr. Hodgson about a document you indicated you
received from the Annapolis Police Department related to the "Event Timeline." This document was not
produced by the Anne Arundel County Police Department, because after being received via e'mail it was
deleted in the normal course of business. It is possible that this e-mail may have been retained on a
backup tape that has been preserved related to other litigation, however, to determine this and to obtain a
copy for yon, if it exists, will be costly. We estimate the cost would be approximately $6,350.00
(representing 80 hours x fee of $78/hour for contract technician time and $110 for expedited tape retrieval
fee from Iron Mountain) and that it will take approximately 2 weeks to search and retrieve this document
if it exists. Please let us know if you would like us to pursue this search at your cost as outlined herein.
