Plaintiff Henry Chu (Plaintiff) hereby complains of Suzhou ZhongCheng New Energy
17
Technology Co., Ltd. (Defendant) and alleges as follows:

19 I. JURISDICTION
20 1. This Court has subject matter jurisdiction over this action pursuant to 28 U.S.C.
21
1331 and 1338, as it arises under the patent laws of the United States.
22
2. This Court has personal jurisdiction over the Defendant because Defendant has a
23
24
continuous, systematic, and substantial presence within this judicial district, including by selling
25 and offering for sale infringing products in this judicial district, and by committing acts of patent
26 infringement in this judicial district, including, but not limited to selling infringing automotive
27
air conditioning compressor parts to consumers and/or retailers in this district and selling into the
28

1 stream of commerce knowing such products would be sold in Virginia and this judicial district,

which acts form a substantial part of the events or omissions giving rise to Plaintiffs claims.

3. Venue is proper in this district under 28 U.S.C. 1391(b), 1391(d) and 1400.

II. THE PARTIES
11 laws of China, having its principal place of business at No.2, Tongli Section, Jiangxing E,
18 and has been actively involved in this career for more than 15 years.

8. The United States Patent and Trademark Office duly and lawfully examined and
20
issued multiple United States Design Patents covering Plaintiffs ornamental designs as set forth
21

9 9. Plaintiff is the owner of all right, title and interest to the Design Patents.

10. The Design Patents are valid and subsisting.

11. Defendant uses, sells and/or offers for sale in the United States, and/or imports
12
into the United States of America, automotive air compressor parts that infringe Plaintiffs
13
15 12. Defendant sells and offers to sell products that infringe Plaintiffs Design Patents
16
and patent rights to third-party retailers and wholesalers in the United States of America,
17
including retailers and wholesalers operating in the State of Virginia.

13. On information and belief, Defendant has infringed, and continues to infringe the
20 Design Patents and patent rights within the meaning of 35 U.S.C. 271 at least by using, selling,
21 offering to sell, and/or importing the infringing products in and to the United States without
22
Plaintiffs authorization.

14. Defendants acts complained of herein have caused Plaintiff to suffer irreparable
24
25 injury to his business and career. Plaintiff will continue to suffer substantial loss unless and until
26 Defendant is preliminarily and permanently enjoined from its wrongful actions complained of
27
herein.

3 15. Plaintiff repeats and re-alleges the allegations of paragraphs 1-14 of this
8 continues to, knowingly, intentionally, and willfully directly infringe the Design Patents by
9 using, selling, offering for sale, and/or importing into the United States, automotive air
10
compressor parts having designs that would appear to an ordinary observer to be substantially
11
similar to the claims of the Design Patents, including, for example Defendants automotive air
12
compressor parts shown, identified and described in Exhibit A hereof and incorporated herein
13
15 18. Defendants acts of infringement of the Design Patents and Plaintiffs patent
16
rights were undertaken without permission or license from Plaintiff. Upon information and
17
belief, Defendant had actual knowledge of the Design Patents and of Plaintiffs rights in the
18
19
designs claimed in the Design Patents.
20 19. Plaintiff and his designs are well-known throughout the aftermarket automotive
21 air conditioning parts industry and the accused products of Defendant are identical or virtually
22
identical copies of Plaintiffs designs.

20. Defendants actions constitute willful and intentional infringement of the Design
24
25 Patents and of Plaintiffs rights in the designs claimed in the Design Patents.
26 21. Defendant has infringed the Design Patents with reckless disregard of Plaintiffs
27
patent rights.

1 22. Defendant knew, or it was so obvious that Defendant should have known, that its

actions constituted infringements of the Design Patents.

23. Defendants acts of infringement of the Design Patents were not consistent with
4
5
the standards of commerce for its industry.
6 24. Defendant infringed the Design Patents, for example, by offering for sale and
7 selling the Accused Products to various retailers located throughout the United States, including,
8
but not limited to, Advance Auto Parts retail stores located at 6224 Richmond Highway, 4349
9
Duke Street and 5117 Franconia Road in the City of Alexandria Virginia and to Advance Auto
10
12 25. Defendants acts also constitute indirect infringement of Plaintiffs Design Patents
13
and patent rights pursuant to 35 U.S.C. 271(b) because Defendant has actively and knowingly
14
aided and abetted third parties to directly infringe Plaintiffs Design Patents and patent rights.

26. As a direct and proximate result of Defendants acts of patent infringement,
16
17 Defendant has derived and received gains, profits and advantages in an amount not presently
18 known to Plaintiff.

27. Pursuant to 35 U.S.C. 284, Plaintiff is entitled to damages for Defendants
20
infringing acts and treble damages together with interest and costs as fixed by this Court.
21
22 28. Pursuant to 35 U.S.C. 289, Plaintiff is entitled to Defendants total profits from
23 the sale of the Accused Products and other automotive air conditioning compressor parts that
24
infringe Plaintiffs Design Patents and patent rights.
25
29. Pursuant to 35 U.S.C. 285, Plaintiff is entitled to reasonable attorneys fees for
26
bringing and prosecuting this action.

1 30. Due to the aforesaid infringing acts, Plaintiff has suffered great and irreparable

injury, for which Plaintiff has no adequate remedy at law.

31. Defendant will continue to directly and/or indirectly infringe Plaintiffs Design
4

Patents and patent rights to the great and irreparable injury of Plaintiff, unless enjoined by this
6 Court.
7 WHEREFORE, Plaintiff respectfully prays for judgment in its favor against Defendant
8
for the following relief.

A. An Order adjudging Defendant to have willfully infringed each of
10
17 C. That Defendant accounts for all gains, profits, and advantages derived by
18 Defendants infringement of the Design Patents and Plaintiffs patent rights in violation
19
of 35 U.S.C. 271, and that Defendant pays to Plaintiff all damages suffered by Plaintiff
20
and/or Defendants total profit from such infringement pursuant to 35 U.S.C. 289, but
