REGULATION ORDINANCE NO. 2009-257


AN ORDINANCE CREATING THE ILOILO CITY POLICE
AUXILIARY UNIT, PROVIDING ONE HUNDRED (100) JOB-
HIRE POSITIONS/ITEMS AND APPROPRIATIONS FOR SUCH
PURPOSES

WHEREAS, Section 16 of Republic Act 7160, otherwise known as the Local


Government Code provides that Local Government Units shall ensur.e and maintain peace
and order and preserve the comfort and convenience of their inhabitants.

WHEREAS: National Police Commission Circular No. 2008-18 has prescribed
guidelines governing the deputation/creation of Police Auxiliary Units and has likewise
authorized PNP uniformed personnel to act as supervisors of Police Auxiliary Units.

WHEREAS, Letter of Instructions 22/09 "BAYANIHAN" coming from the


Chief, Philippine National Police acknowledges the need of the PNP of force multipliers
in their effort to effectively maintain peace and order in the community.

WHEREAS, land area and population considered, Iloilo City an actual Police to
Population Ratio of 1:747 as compared to the ideal ration of 1:500 as provided for under
Section 27 of Republic Act 6975.

NOW THEREFORE, be it ordained as it is hereby ordained by the Sangguniang


Panlungsod of the City of Iloilo, by virtue of the powers vested in it by law, in a session
assembled, that:

Section 1. There shall be created a Police Auxiliary Unit who shall be under
the administrative and operational control of the City Mayor.

Section 2. An initial of One Hundred (100) persons shall be hired for such
purpose.

Section 3. Qualifications/Requirements

a. Must be a Filipino Citizen and a resident of Iloilo City

b. First Priority - B.S. Criminology Graduate


Second Priority - Graduate of any Bachelors' Degree
Third Priority- Completed at least 72 units ofB.S. Criminology
Fourth Priority - Completed at least 72 units and any Bachelors' Degree

c. Must not be below 25 years old and must not be over 50 years old

d. Of good moral character

e. Must have no derogatory report or record

f. Must have no pending criminal case in court nor convicted of any crime
involving moral turpitude, illegal drugs, possession of illegal weapons, crime
against women and children, crime involving human rights violations.

g. Barangay, Police, NBI, Court Clearances, Drug Testing Result

Section 4. Scope of Functions

a. Assist the organic personnel of the Iloilo City Police Office in the
maintenance of peace and order and the protection of lives and properties of
the community.
b. Aid the organic personnel of the Iloilo City Police Office in gathering of
intelligence information for proper processing by organic PNP personnel.
c. Provide manpower for clustered barangay PNP complaint centers.
d. ASsi$t in Disaster and Relief Operations.
e. When the situation so demand, may act as a driver to city issued police
vehicles, computer operators and typists in Police Precincts of assignment.
f. When a situation so demand secure a crime scene until such time that is is
processed by qualified PNP personnel.
g. When necessary, effect an arrest pursuant to the provision of Rule 113 of the
Rules of Court.

Section 5. Limitations/Prohibitions

a. Members of the Iloilo City Auxiliary Unit are prohibited from engaging
armed criminal elements. This is the responsibility of regular PNP personnel.
b. While in the performance of their official functions, Members of the
Auxiliary Police Unit are not allowed to carry any weapon (may it be bladed
or firearm); even if on one's persons capacity he is a licensed gun owner or
has Permit to carry Firearms Outside Residence. While on duty he shall be
limited to a night stick or pepper spray.

Section 6. Management and Control

a. The City Mayor shall have direct administrative control over this unit.
b. Operationally, the City Mayor shall deploy members of this Unit to the Iloilo
City Police Office.
c. The City Director of ICPO shall assign members to various Police Precincts as
he deems necessary; and the Precinct Commanders shall exercise direct
supervision pursuant to the provisions of Section 4 and 5 of this Ordinance.

Section 7. Authority to Discipline

The authority to discipline members of the Police Auxiliary Unit is vested upon
the City Mayor. However, the Precinct Commanders and the City Director may
recommend the imposition of thirty (30) days suspension or non-renewal of job
orders on the following grounds:

a. Disloyalty to the Republic of the Philippines


b. Culpable violation of the Constitution and Human Rights
c. Misconduct
d. Abuse of Authority
e. Non-compliance to the provisions of Section 4 of this Ordinance
f. Violation of Section 5 of this Ordinance

Section 8. Recruitment, Selection and Training

a. A Selection Committee shall be created composed of duly authorized


representative from:

I. The City Mayor's Office


2. The Iloilo City Police Office
3. The City Legal Office
4. The Sangguniang Panlungsod Chairman, Committee on Police, Fire,
Penology, Public Safety, Order and Security, Dangerous Drugs and
rehabilitation.

b. Applicants submit all applications and required documents to the Office of


the, City Mayor
c. The City Mayor convenes the Selection Committee so created under this
Ordinance to review all documents.
d. Any misrepresentation of information and/or documents means outright
disqualification.

e. Basic interview on personal information shall be done by the Selection


Committee and shall include matters relative to drug use, criminal history,
education and employment history.
f. Applicant likewise shall undergo a basic written examination so given by
the Selection Committee.
g. The applicant who passes both interview and written examination shall
determine his place on the Volunteer's eligibility list.
h. The applicants scores in the interview and written examination shall
determine his place on the eligibility list.
1. The Selection Committee determines the first One Hundred (100) applicants
in the eligibility lists and endorses the same to the ICPO for background
investigation.
J. List of successful applicants will be indorsed to the City Mayor for hiring.
k. Hired Police Auxiliaries will be indorsed to the ICPO for a Thirty (30) days
training to include:

Seminar/Workshops on fundamental of law enforcement,basic laws to


be enforced
Seminar on Human Rights
Basic Patrolling and Intelligence Gathering
Proper use of night stick and pepper spray and its techniques
Basic arrest and hand-cuffing techniques
Self-defense
Physical conditioning
Morals and value formation
Disaster and relief Operations

Section 9. Equipments and uniforms shall be provided by the City


Government.

Section 10. Appropriations shall be provided for the purpose of the creation.

Section 11. This ordinance shall take effect upon approval.

e. Basic interview on personal information shall be done by the Selection Committee and
shall include matters relative to drug use, criminal history, education and employment
history.

f Applicant likewise shall undergo a basic written examination so given by the Selection
Committee.

g. The applicant who passes both interview and written examinations shall be placed 011 the
Volunteer's Eligibility List.

h. The applicant scores in the interview and written examination shall detennine his place
on the eligibility list.
