Subject: Regarding pay protection Case of Dr.

Reena Thakur, Senior Resident,


(Hospital Administration).

This case pertains to the protection of pay of Dr. Reena Thakur, Senior
Resident, (Hospital Administration).
In this connection it is submitted that an advertisement was released in the
leading newspapers on 22.11.2014 for inviting applications for filling up of vacant posts
of Senior Residents on tenure basis for a maximum period of three years. Dr. Reena
Thakur applied against the post of Senior Resident in the department of Hospital
Administration in response to the post advertised in the newspaper. She also obtained
NOC from her Parent State for doing Senior Residency in GMCH with the directions from
her parent department that after completion of her Senior Residency she will join back in
the department immediately and also submit a bond in this regard. (Flag /A)

On the basis of qualification, experience and the performance shown in the written
test and interview the Selection Committee recommended the name of Dr. Reena
Thakur. Thereafter after obtaining the approval from the competent Authority
appointment order was issued in favour of above said doctor for a maximum period of
three year being tenure post in the pay scale of Rs. 15600-39100 (with initial start of Rs.
18750/- carrying Grade pay of Rs. 6600/- + Allowances under the Residency Scheme
on Central Pattern vide this office order dated 20-01-2015 (Flag `B). She has joined on
27-02-2015 (FN) after acceptance of appointment order issued to her.

It is further submitted that after joining on the post of Senior Resident Dr. Reena
Thakur requested for protection of Pay. Accordingly her case was submitted to the
officers for consideration and after obtaining advice from accounts functionaries her
case was rejected as per the instructions of Residency Scheme which is reproduced as
under :

b) Senior Residency.
iv) The tenure of senior residency will be three years. However the
candidature of a person who is already working as senior resident
in a Central Institution/Hospital may be considered for
appointment as Senior Resident in another Central Institutions /
Hospitals if his application is received through proper channel. In
such cases the pay drawn in the previous post will not be
protected. The total period, however, should not exceed the maximum
period of Senior Residency of three years. (Flag C)

It is pertinent to mention here that earlier Dr. Raman Sharma was also
appointed as Senior Resident on tenure basis in the department of Hospital
Administration from H.P.State Govt. and he has completed his tenure of three years
as Senior Resident from 23.03.2011 to 22.03. 2014. (FlagD).

Further it is intimated that Dr. Reena Thakur has written her


representation directly to the Health Secretary, UT, Chandigarh (Not routed
through Director Principal, GMCH, Chandigarh) thus bypassing the proper
channel. This leads to great misconduct on her part. The huge financial loss as
stated by her has nothing to do with the term & conditions of her appointment orders
as she already accepted the appointment orders and submitted her joining.

Now as per the telephonic conversation on 4.10.16 with Mr. Thakur


Superintendent from F- II Branch, SMER Officer, to the send the case detail of
Dr. Reena Thakur which was dealt by this office.

In view of the above the case is submitted to the officers for information,
for passing appropriate orders in the matter please.
