KU Leuven betreurt conflict rond godsdienstvrijheid!

Inleiding!
!
Het afgelopen anderhalf jaar was een bewogen periode voor ons gezin waarin het thema
verandering centraal stond. We zijn terug verhuisd naar Antwerpen, ons derde kind is
geboren, we hebben ons kandidaat gesteld om een jongen zonder ouders uit Irak te
adopteren en we zijn een eigen zaak gestart in film producties (www.motioninsync.be).!

De meest onverwachte verandering echter was mijn ontslag aan de KU Leuven. De krant
de Standaard stelde dat ik te christelijk was voor de Katholieke Universiteit van Leuven.
Aan de gerechtelijke procedure die ik naar aanleiding van mijn ontslag gestart ben, komt
nu een echter het verhoopte einde. Nl. een akkoord tussen mijzelf en Rik Torfs als rector
van de KU Leuven waarbij we onze meningsverschillen achter ons laten in een
gezamenlijke verklaring. !

Terugblik!
!
Een korte recapitulatie lijkt op zijn plaats. Ik ben een goede 10 jaar geleden een volgeling
van Jezus Christus geworden, zoals de meeste mensen die me zolang al kennen binnen
de universitaire wereld wel weten. Ik heb daar nooit een geheim van gemaakt of dat
verborgen proberen te houden. Het was dan ook voor mijzelf bizar om vast te stellen dat
mijn persoonlijke geloofsovertuiging na bijna 12 jaar dienst aan het HIVA, opeens ter
discussie kwam te staan. !
!
Ik kan mij voorstellen hoe een christelijke overtuiging die gelooft dat er een God bestaat
die nog steeds kan ingrijpen in het hier en nu, voor sommigen onbegrijpelijk kan lijken.
Echter, niemand moet het eens zijn met mijn geloofsovertuiging, maar in een rechtstaat
waar er een recht van vrijheid van meningsuiting en een recht van vrijheid van godsdienst
bestaat, kan dat recht niet zomaar geschonden worden. In het gezamenlijke schrijven
tussen Rik Torfs en mijzelf willen we dat fundamentele principe samen bevestigen.!

Gezamenlijke verklaring!
!
Rik Torfs, rector van de KU Leuven, en Fernando Pauwels, van 16 januari 2001 tot 4
oktober 2012 wetenschappelijk medewerker aan de KU Leuven, hebben beslist de
juridische procedures te beindigen die naar aanleiding van diens ontslag liepen tussen
Fernando Pauwels en de universiteit. Ze betreuren dat er toen tussen hen een conflict
gerezen is.!

Rector Rik Torfs en Fernando Pauwels delen de overtuiging dat vrijheid van meningsuiting
en vrijheid van godsdienst fundamentele rechten zijn, die in het bijzonder binnen een
universitaire gemeenschap gerespecteerd moeten worden. !

Personeelsleden van de KU Leuven hebben het recht in vrijheid hun persoonlijke

geloofsovertuiging te volgen en te beleven en hier, in overeenstemming met artikel 9 van
het Europees Verdrag voor de Rechten van de Mens en met respect voor andere
overtuigingen, over te communiceren. !

De kwaliteit van een beschaving, een samenleving, een universiteit hangt af van de mate
waarin ze in staat is met vrijheid te leven.!
!
Rector Torfs benadrukt dat Fernando een verdienstelijk en gengageerd onderzoeker is,
die tijdens zijn verblijf aan het HIVA heeft bijgedragen tot de uitbouw van nieuwe en
beloftevolle onderzoekslijnen. Hij wenst hem daarvoor te bedanken.!

Reflectie!
!
Ik ben dan ook bijzonder blij dat Rector Torfs betreurt hoe mijn ontslag verlopen is en
daarbij bevestigt dat mijn wetenschappelijke geloofwaardigheid niet in vraag wordt
gesteld. Het eerherstel dat hij mij daardoor biedt, is voor mij van onschatbare waarde. Ook
verheug ik mij erin dat ook wedergeboren christenen naast mensen met andere religieuze
overtuigingen, welkom zijn aan de KU Leuven om hun geloof in vrijheid te beleven.!
!
Op enkele uitzonderingen na was Rik Torfs, toen nog in de hoedanigheid van senator en
buitengewoon hoogleraar aan de KULeuven, zowat de enige intellectueel die publiekelijk
stem heeft gegeven aan zijn verontwaardiging over de schending van een grondwettelijk
recht. Mijn ontslag heeft hier en daar wat stof doen opwaaien, maar dat is snel ook weer
gaan liggen. In tegenstelling tot het ontslag van Barbara Van Dyck, dat aanleiding heeft
gegeven tot een publiek debat en uiteindelijk opnieuw tot haar aanwerving aan de KU
Leuven, bleef het rond mijn ontslag relatief windstil. !
!
Diezelfde wetenschappers die zich in de naam van kritische wetenschapsuitoefening en
vrijheid van meningsuiting achter de zaak van Barbara Van Dyck hebben geschaard,
hebben op hun departementen in de wandelgangen zich misschien wel verontwaardigd
uitgelaten. Maar het stilzwijgen op de publieke fora dat erop gevolgd is, lijkt een illustratie
te zijn van de huidige geseculariseerde samenleving waarin we niet meer weten hoe we
met een gelovige overtuiging die handen en voeten in de praktijk heeft, moeten omgaan. !

Waarom is er geen publiek debat ontstaan? Is het omdat we als geseculariseerde, post-
katholieke samenleving niet meer om kunnen met uitingen van geloofswaarheden? Of is
het omdat we met grondwettelijke rechten zoals het recht op godsdienstvrijheid door onze
verregaande secularisering geen voeling meer hebben? Of is het omdat geloofsuitingen
die vanuit het protestantisme zijn ontsproten, nog steeds argwanend bekeken worden?!
!
Hoe het ook zij, ik hoop dat de fundamentele grondrechten, ook het recht op
godsdienstvrijheid, in dit land gevrijwaard mogen blijven en dat in de toekomst niemand
moet meemaken wat wij hierin als gezin hebben doorgemaakt. !

Tot slot!
!
Tenslotte toch een korte bespiegeling die illustreert hoe ik deze periode heb beleefd als
mens. Ik heb vroeg in mijn christenleven geleerd dat de persoon van Jezus Christus
volgen een uitnodiging is om onze rechten in deze wereld op persoonlijke vergelding,
bitterheid, haat, jaloezie, etc. op te geven en te kiezen voor de hogere weg die Jezus ons

heeft voorgeleefd. Hij heeft ons de intrinsieke waarde van mensen geopenbaard, ook van
diegenen die ons kwaad willen doen. Voor de tijd van Jezus was het geldende principe
oog om oog, tand om tand. Jezus echter toont ons een hogere weg en leert ons om
steeds bereid te zijn te vergeven, de andere wang toe te keren aan hen die ons beledigen,
te bidden voor wie ons haten, goed te doen voor wie ons vervloeken, onze vijanden lief te
hebben en te bidden voor wie ons vervolgen.!
!
Ik heb ook naar de mensen die bij mijn ontslag betrokken waren een dag na mijn ontslag
in een brief geschreven dat ik hen van harte het beste toewens, hen dit niet persoonlijk
kwalijk neem en dat ik ervoor kies om te vergeven en niet bitter of rancuneus te zijn. Het is
mijn overtuiging dat deze houding de wereld tot een betere plaats maakt waarbij
menselijkheid centraal staat. Ik hoop dat we allemaal mogen bemoedigd zijn om het ons
aangedane leed snel te vergeven, want dat maakt van de wereld een mooiere plaats.!

University of Leuven regrets conflict about freedom of

religion!

Introduction!
!
This last year and a half have been a remarkable period for our family in which change
seemed to be the central theme. We moved back to the city of Antwerp, our third child was
born, we submitted our application in order to adopt an orphaned boy from Iraq and we
started our own corporate film production company (www.motioninsync.be). !
!
However the most unexpected change was the fact that I was fired at the Catholic
University of Leuven end of 2012. The newspaper De Standaard stated that I was too
much of a christian for the Catholic University of Leuven. The judicial procedure I started
because of my dismissal now comes to an end. Rik Torfs as Rector of the KU Leuven and
myself have come to an agreement where we leave our differences behind in this joint
declaration.!

Overview!
!
What exactly happened? About 10 years ago, I became a follower of Jesus Christ, as most
people who knew me within the university circles from that time know. I have never kept it
a secret nor have I tried to hide it. It was very awkward to see that my personal religious
conviction became a subject of controversy, after working at HIVA - Catholic University of
Leuven for almost 12 years.!

I can understand how a christian belief that there is a living God who can intervene in the
here and now, can be hard to understand for some. However, no one has to agree with my
religious beliefs, but in a free state where there is the right of freedom of speech and the
right of freedom of religion, those rights cannot be violated as such. In our joint declaration
between Rik Torfs and myself, we want to affirm that fundamental principle together.!

Rik Torfs, rector of the University of Leuven and Fernando Pauwels, senior research
associate of the University of Leuven between the 16th of Januari 2001 and the 4th of
October 2012 have decided to end the judicial procedures as a consequence of
Fernandos dismissal. They regret that a conflict arose between them at that time.!

Rector Rif Torfs and Fernando Pauwels share the conviction that freedom of speech and
freedom of religion are fundamental rights, which especially in a university community
have to be respected.!
!
Personnel members of the University of Leuven have the right to follow and live their
personal religious convictions and in line with article 9 of the European Treaty on Human
Rights and with respect for other convictions, to communicate about these convictions.!
!
The quality of a civilisation, a society, a university depends on the measure it is able to
handle freedom.!
!
Rector Rik Torfs affirms that Fernando is an valuable, committed researcher, who during
his stay at HIVA has contributed to the establishment of new and promising research lines.
For that he wishes to thank him.!

Reflection!
!
I greatly rejoice that Rector Torfs regrets the way in which my dismissal was handled and
confirms that my scientific credibility is not questioned. The rehabilitation he thus provides
me, is of immeasurable value. I also rejoice in the fact that born-again christians, besides
people of other religious convictions, are welcome at the University of Leuven to express
their beliefs.!

With few exceptions, Rik Torfs, in those days still in capacity of senator and professor at
the University of Leuven, was about the only intellectual who publicly voiced his outrage at
the violation of a constitutional right. My dismissal created some controversy here and
there but soon the dust settled without much public outcry. In contrast to the resignation of
Barbara Van Dyck, which has given rise to a broad public debate and ultimately to her
recruitment back at the University of Leuven, not much public debate took place after my
resignation.!
!
The same scientists who in the name of critical science exploration and freedom of religion
backed the case of Barbara Van Dyck, have perhaps expressed their indignation in their
own departments behind closed walls. But the silence on the public forums that followed,
seems to be an illustration of the state of our current secularised society which does not
know how to handle expressions of deeply felt religious convictions anymore. !
!
Why was there no public debate? Is it because we as a secular, post-Catholic society can
no longer handle expressions of true faith? Or is it because we have lost touch with
fundamental rights like the freedom of religion because of the trend of our profound
secularisation? Or is it because expressions of faith that have sprouted from Protestantism
are still frowned upon in post-Catholic Belgium?!
!
Whatever the answer may be, I hope that the fundamental rights, the rights to religious
freedom can be safeguarded in our country and that in the future no one should go
through what we went through as a family.!
!
In closing!
!
Finally in closing, a brief reflection that illustrates how I have experienced this period. Early
on in my christian life, I have learned that following the person of Jesus Christ is an

invitation to give up our rights in this world on personal revenge, bitterness, hatred,
jealousy, etc. and to choose to walk on the higher road that Jesus showed we could walk
on. He has revealed to us the intrinsic value of human beings, even of those who want to
do us harm. Before the time of Jesus, the ruling principle was an eye for an eye, a tooth
for a tooth. But Jesus shows us a higher way, where He teaches us to be prepared to
forgive, to turn the other check to those who offend us, pray for those who hate us, to
bless those who curse us, to love our enemies and to pray for those who persecute us.!
!
The day after my dismissal I wrote a letter to the people involved, sincerely wishing them
the best, telling them that I choose to forgive and not be bitter or resentful. It is my belief
that this attitude makes the world a better place. I hope we can all be encouraged and
inspired to forgive quickly.!
