SUBJECT: Letter from Public Attorney's Office

Dear Atty. Del Rosario:

This refers to your letter regarding the concern of your client Rand Rustom S. Sebastian,
also known as Rand Rustom L. Simar, who was born on September 3, 1992 in Neuss, w.
Germany and whose birth was registered at the Philippine Consulate General, Hamburg.

As mentioned in your letter, Rand Rustom's biological parents were married on February 13,
1992 or months before he was born, but the name of his father, Randy Ramos Sebastian
and the date and place of parents' marriage are not reflected in his birth record. Hence, his
Report of Birth (birth record) requires correction to show the true fact of his status as
legitimate child and to correct the erroneous entry on his name, specifically his middle name
and surname.

In this connection, you are seeking our assistance in determining the proper venue of the
petition for correction of entries to be filed.

Since the subject Report of Birth (ROB) was registered at the Philippine Consular Office in
Hamburg, Germany and the said ROB was already available in our Archive, the venue of the
petition should be filed with the Regional Trial Court (RTC) of Manila. RTC of Batangas has
no jurisdiction over the case because the birth document of Rand Rustom is not registered in
civil registry of Tanauan City, Batangas where the document owner , resides.

In view of the foregoing, the proper venue of the Petition to be filed should be at RTC of
Manila.
