Summary of Government Regulation Number 27 of 2012 re Environment License

The Government Regulation Number 27 of 2012 (Regulation) regarding Environmental License was issued on 23
February 2012 by the government of Indonesia, which outlines the requirement for a business or activity in Indonesia
having an impact on the environment, to obtain an approval on Environmental Impact Assessment (AMDAL) or UKL-
UPL, whichever is applicable, and further obtain an Environment License.

The application for an Environment License should be made in writing to the Minister, Governor, or Regent / Mayor
depending upon the area of the activity, and should be submitted along with the request for AMDAL or UKL-UPL
Assessment.

Required documents for Environment License application:

a. Amdal document or UKL-UPL form;
b. Deed of Incorporation of the business entity;
c. Profile of business / activity.

The Environment License shall be issued by the Minister, Governor, Regent / Mayor, as the case may be, at the
same time during the issuance of the Decree of Amdal worthiness (Amdal approval) or UKL-UPL Recommendation.

Obligation of Environment License holder:

a. Comply with the conditions and obligations set forth in the Environment License, as well as other licenses or
approvals related with environment, which among others are: hazardous waste disposal permit, hazardous
waste storage permit, etc;
b. Prepare and submit the report regarding performance of the conditions and obligations set forth in the
Environment License to the Minister, Governor, or Regent / Mayor, as the case may be, every 6 (six)
months;
c. Provide a Surety Fund for the recovery of the environment function in accordance with the prevailing
regulation.
