Refugee Definition

A person who owing to a well-founded fear of being


persecuted for reasons of race, religion, nationality,
membership of a particular social group or political
opinion, is outside the country of his nationality and is
unable or, owing to such fear, is unwilling to avail himself
of the protection of that country; or who, not having a
nationality and being outside the country of his former
habitual residence as a result of such events, is unable or,
owing to such fear, is unwilling to return to it

NON-REFOULEMENT

"No Contracting State shall expel or return ('refouler') a refugee in


any manner whatsoever to the frontiers of territories where his life
or freedom would be threatened on account of his race, religion,
nationality, membership of a particular social group or political
opinion."

1951 Refugee Convention, Art. 33(1)


NON-REFOULEMENT

Customary International Law?

1. Widespread acceptance

2. Incorporated in international treaties following a tradition going


back to the period of the League of Nations.

3. Incorporated in the 1951 United Nations Refugee Convention and


the 1967 Protocol to which 125 States are now parties (as well as
regional instruments)

The provisions of this Convention shall not apply to any person with respect to whom
there are serious reasons for considering that:

(a) He has committed a crime against peace, a war crime, or a crime against
humanity, as defined in the international instruments drawn up to make
provision in respect of such crimes;

Crimes against humanity

1. For the purpose of this Statute, crime against humanity means any of the
following acts when committed as part of a widespread or systematic attack
directed against any civilian population, with knowledge of the attack:

1. The Court shall have jurisdiction in respect of war crimes in particular


when committed as part of a plan or policy or as part of a large-scale
commission of such crimes.
