MINUTES OF THE COUNCIL MEETING
HELD JUNE 23, 2010
The following items of business, filed with the City Clerk under the Rules of the Council, came
before the Council at its regular meeting held on June 23, 2010.
The CITY CLERK called the roll and the following members were present:
JO EVA GAINES, Chair, Newport School Committee, said she had received information on the
previous day that there would be a substantial cut in the School budget and questioned the fairness of
it without there having been any communication with the School Committee. She went on to discuss
the consequences if the School Budget is reduced.
CHARLES SHOEMAKER, Newport School Committee, pointed out that the Council had agreed in a
meeting held earlier in the year to provide level funding to the schools. He cited various losses in
funding to the schools and predicted deficits in the future. He said this cut in school aid would
undermine the revamping of the math courses at the high school that have been implemented to
reduce the drop-out rate.
PATRICK KELLEY, Newport School Committee, cited the various cost-saving measures the School
Committee has taken over the past five years and asked that this newly proposed reduction be rejected
as it will result in cuts in educational services or cuts in contracts or a suit under the Caruolo Act.
DR. JOHN AMBROGI, Superintendent of Schools, implored the Council not to make any cut in the
School Dept. appropriation. He said severe problems were looming because there will be a loss of $1
million in stimulus funds, a reduction of $156,000 in State Aid, and the School Dept. will be required
to pay tuition of over $300,000 for students attending the Met School. He said the proposed cut will
result in the School Department's facing a $100,000 deficit in FY2011 after depleting its fund
balance.
COUNCILOR COYNE moved that funding for the School Department be reduced by 2.5%, or
$578,568, and the funds be put in the OPEB Trust Fund. Seconded by COUNCILOR WALUK.
COUNCILOR COYNE said that over the last six budgets he has made every effort to support public
education, capital improvements for the schools, etc., and he voted against a motion to cut funds last
year because he was misled in that he understood that the agreement reached with the School

Department to have a $50,000 fund balance would result in the School Department's returning funds
each year to the City in excess of that amount, which it appears they are not doing this year.
He said he was not at all against funding education; however, he was told last year that $1.2 million
of the School surplus would be needed in the current year's budget, but the Schools now have a
surplus of $1.5 million.
COUNCILOR MC LAUGLIN said that last year he had proposed a cut under maintenance of effort
based on declining emollment. He noted that the OPEB liability for the School Department declined
in the past year and, after transferring $1.2 million to the City to be added to the OPED Trust, they
had actually overpaid their contribution by $200,000. He said it was his understanding that the
School Department expects a $980,000 surplus for the current year, but will need to use $735,000 to
fund their FYII budget, thus leaving them a surplus of less than $250,000. He said he did not believe
it was a good time to cut the School Budget and he would not support the motion, although he
believed the Committee needs to rethink some issues, such as the size of the proposed new school.
COUNCILOR WALUK said the new law did not exist three weeks ago when the Council and School
Committee met and was only signed into law on this very day. He said the savings from the proposed
reduction will go to the OPEB liability for the School Department and not the General Fund. He
pointed out that the Council does not have a finalized School Budget as yet; and, although he fully
supports public education, he will support the motion for the reduction.
MAYOR NAPOLITANO responded that just because the law now allows for the cut, it doesn't mean
the Council should do it. She said it was unfair to the School Department and the students to make
this cut at the last minute, and if the schools are to continue to improve there must be sufficient
funding.
VOTE ON THE MOTION TO REDUCE THE SCHOOL BUDGET BY 2.5% FOR FY2011:
RAY SMEDBERG, 129 Coggeshall Avenue, addressed the sewer rate and CSO fixed fee which he
said were being increased because of activity that is being driven by regulatory compliance, i.e., the
Thames St. and Wellington Ave. improvements, and the Long Wharf emergency repairs. He said the

Council has been proactive in addressing the sewer issues, and needs to continue to do so because of
the other long-term improvements that must be addressed.
COUNCILOR WALUK moved the hearing be closed. Seconded by COUNCILOR COYNE and
VOTED UNANIMOUSLY.
COUNCILOR WALUK moved the budget be amended to reflect an increase in the OPEB Trust Fund
to $1.6 million and removal of the $40,000 savings for a shared Tax Assessor position. Seconded by
COUNCILOR DUNCAN and VOTED UNANIMOUSLY.
MAYOR NAPOLITANO expressed concern with not following the recommendation of the
Administration to increase Firefighter Overtime budget by $418,000. She noted that City Manager
had already cut that item by $400,000 in the original budget and, with the Council's removing
funding for the vacant firefighter positions, there will not be sufficient overtime funding.
COUNCILOR MC LAUGHLIN said a fundamental restructuring of the fire Department was needed,
only funding that is necessary should be provided. He said he had been lead to believe that reducing
the firefighter staff will not put the citizens or firefighters in danger. COUNCILOR WALUK
commented that the City has a well staffed and qualified Fire Department and they will need to make
due with their budget.
MAYOR NAPOLITANO responded that overtime costs in the Fire Department are about $100,000
per month and with only $200,000 in the FYI I budget, the overtime account will be depleted by
September. She said it is poor planning and budgeting not to provide the funds that will be needed.
COUNCILOR LEONARD said it was her belief that if the money were there they would spend it;
and, therefore, she would not vote to increase the overtime account.
COUNCILOR WALUK moved that the I % tax rate increase be reduced accordingly to reflect the
reduction of$432,318 in expenditures. Seconded by COUNCILOR COYNE.
COUNCILOR MC LAUGHLIN expressed concern about cuts that had been made in capital
improvements and said the 1% tax rate increase, which he believed was insufficient, could be used to
address some ofthem, including ADA improvements. CITY MANAGER LAVALLEE agreed that it
could be used for infrastructure improvements, noting that there is a timeline for ADA improvements
and Fire Code compliance in city buildings. COUNCILOR DUNCAN responded that he agreed with

Councilor Leonard's sentiments, that if the money is there it will just get spent. COUNCILOR
WALUK noted that there are funds from the road bond for street improvements, and if a real need for
a capital improvement were to arise money from the fund balance could be used.
COUNCILOR MC LAUGHLIN said he was not able to support the budget because of the
considerable cuts. MAYOR NAPOLITANO agreed, saying it would be irresponsible to vote for this
budget because of insufficient funding for the Fire and School Department budgets.
COUNCILOR WALUK moved the ordinance, as amended, be adopted on second reading. Seconded
by COUNCILOR COYNE.
COUNCILOR WALUK said he would not support the proposed sewer rate increase; COUNCILOR
LEONARD agreed and said the City needs to meet with State and Federal officials regarding the
mandates which the taxpayers and ratepayers cannot afford.
COUNCILOR MC LAUGHLIN moved Section 17.80.060 be amended as follows, noting that the
Assistant City Solicitor had advised that the changes would not require re-advertising:

in section 17.80.050 A (1) ofthis ordinance - The Commission shall apply the following

2. Preserving Character Defining Features - The Commission may encourage but shall not
require owners to preserve distinctive features, finishes, construction techniques or examples
of craftsmanship that are present in a Non-Contributing Structures or existing walls, gates,
gateposts andfences as specified in section 17.80.050 A (1) ofthis ordinance which add to
the character of the surrounding district.
"C. For New Construction, Reconstruction and new walls, gates, gateposts andfences as
specified in section 17.80.050 A (1) ofthis ordinance - The Commission shall apply the
following standard of review to New Co;'1st/'lIction or Reemlstrlletion:
I. Compatibility - New Construction, Reconstruction and new walls, gates, gateposts and
fences as specified in section 17.80.050 A (l) ofthis ordinance shall be compatible with the
surrounding historic area in terms of size, scale, siting, massing, set back, materials and detail.
2, Architectural Quality - New Construction, Reconstruction and new walls, gates, gateposts
andfences as specified in section 17.80.050 A (1) ofthis ordinance should be of thoughtful
and considered architectural design.
3. Appearance - New Construction, Reconstruction and new walls, gates, gateposts and
fences as specified in section 17.80.050 A (1) ofthis ordinance may clearly read as such and
need not present a false historic appearance."
COUNCILOR MC LAUGHLIN said there had been some concern that an undue burden was being
placed on owners of walls, gates, gateposts and fences along Bellevue Avenue, but the incorporation
ofthis new language would make it clear that they would not be asked to take extraordinary
measures, but that any new or reconstructed walls, gates, gateposts and fences would be compatible
with the surrounding historic district.

MATTHEW LEYS, ESQ., representing The Preservation Society of Newport County, said that The
Preservation Society has been an economic driver for Newport and Bellevue Avenue is an important
part of that. He commented on the importance of including fences, walls, gates and gateposts along
Bellevue Avenue and said The Preservation Society supports Councilor McLaughlin's proposed
amendments.
JAMES MOORE,S Ocean Lane, Co-chair ofthe Bellevue/Ochre Point Associations, said he was
representing eight Bellevue Avenue property that support the inclusion of the walls, gates, etc., along
Bellevue Avenue in the ordinance, and also support Councilor McLaughlin's amendments. He said it
would be a tragic mistake to not include them in the ordinance.
ROBERT WALKER (no address given) said he supported the amendment because it was balanced
and fair and would not impose a hardship on the property owners. He said the streetscapes of
Newport, particularly Bellevue Avenue, should have oversight protection.
MICHAEL COTTRELL, 7 Red Cross Avenue, said he was an architectural historian writing a book
about several houses in Newport and discussed the importance of many walls, gates, gateposts, and
cited the removal of the historic gateposts at the site of the former Villa Rosa estate on Bellevue
Avenue.
HARLEY TINNEY, Belcourt Castle, Bellevue Avenue, said the wall and gate at Belcourt Castle were
built in 1981 and she would like them protected. She cited the need for an inventory, which should
include certain properties on Bellevue Ave., Ochre Point and Narragansett Ave.
MARK HORAN, 115 Pelham Street, Chair of the Historic District Zoning Ordinance Revision Task
Force, said he was concerned that the changes would undermine adoption ofthe entire ordinance and
asked that the body ofthe ordinance be adopted. He said he was also surprised that the task force was
not asked to participate in developing the language for walls, fences, gates, etc., which he said had
been discussed at task force meetings but the members felt it would be difficult in the absence of an
inventory.
LAWRENCE CUTLER, owner of Vernon Court which abuts Bellevue Avenue, said he supported the
body of the ordinance but not the proposed changes that would include Bellevue Avenue. He cited
his credentials as an urban designer, and discussed the fence which he erected at Vernon Court. He
said any modifications to the fence or its removal would be a problem if Bellevue Avenue is included
in the ordinance.
ROBERT BEAVER, Ruggles Avenue, spoke in support of the amendments. He said, however, that
given the long time it has taken to get this far, he would ask that the Council at least adopt the body of
the ordinance; and if walls, fences, gates, etc., are not approved at this time that issue could come
back at a later time.
RONNIE DICK, 662 Bellevue Ave., commented on the current character of Bellevue Avenue and

said he supports Councilor McLaughlin's proposed amendments.
PETER ROOS, Newport Restoration Foundation, said he supports the inclusion of Bellevue Ave.
fences, walls, etc., but agreed with the comments ofMr. Beaver and the need to get at least the body
of the ordinance adopted.
COUNCILOR LEONARD said she did not believe anyone was opposed to protecting the character of
Bellevue Avenue; however, it was the process that bothered her because she did not believe the
majority of property owners on Bellevue Avenue, from the Hotel Viking to Rough Point were aware
of the discussions to include their fences, walls, gates and gateposts; and while the Planning Board
and Council were lobbied to include them, no one contacted the property owners.
COUNCILOR WALUK said he supported the inclusion ofthe walls, fences, etc., because people
come to Newport to see Bellevue Ave. and the Ocean Drive. He disagreed with Council Leonard's
comments, saying the process of adopting the ordinance has been a very extensive and public process,
and noted that Councilor McLaughlin's proposed amendments would alleviate the burden on the
property owners. COUNCILOR DUNCAN disagreed and said he had a huge problem with the
amendments and would not support the inclusion of Bellevue Ave. walls, fences, gates, etc.
COUNCILOR MC LAUGHLIN said he would like to change his vote from aye to nay, resulting in a
vote of:
MAYOR NAPOLITANO noted that this would allow Councilor McLaughlin to request
reconsideration of his amendment by being on the majority side of the vote.
COUNCILOR WALUK moved the public hearing be closed. Seconded by COUNCILOR COYNE
and VOTED UANIMOUSLY.

MAYOR NAPOLITANO said some trucks are out as early as 5:00 a.m. aod the companies should be
advised they are not to operate before 6:30 a.m., and asked to not make collections until 7:00 a.m. in
areas close to residential neighborhoods. She then moved that the license renewals be approved.

TERENCE FRACASSA, ESQ., representing the applicaot, said the restauraot has been responsible in
adhering to the all laws aod regulations. In response to questions from COUNCILOR MC
LAUGHLIN, he said it cao be difficult to monitor the noise because there are several businesses in
the vicinity of@ The Deck that have outdoor entertainment licenses. COUNCILOR MC
LAUGHLIN responded that the business should be required to monitor the decibels and abide by the
restrictions.

there would a meeting in the near future of the Committee, which represents various RI and MA cities
and towns.
lOA Opposing House Bill 7338, Sub A, that would authorize state-operated casino gaming at Twin
Rivers and/or Newport Grand subject to statewide and local voter approval - S. Coyne, S.
Waluk
COUNCILOR COYNE introduced the resolution and noted that the Governor has vetoed the
legislation.
COUNCILOR COYNE moved the resolution be amended to add that the Governor be congratulated
for vetoing the bill and that the RI General Assembly be requested to not override the veto. Seconded
by COUNCILOR WALUK and VOTED UNANIMOUSLY.
ORDINANCES
lOB. Amending Chapter 10.20.140, entitled, "Parking Boat Trailers," Paragraph B, to reduce
seasonal resident parking stickers at the King Park Parking Lot to $25.00

COUNCILOR WALUK moved the ordinance, as amended, be adopted on second reading. Seconded
by COUNCILOR MC LAUGHLIN.
COUNCILOR WALUK spoke in favor of the inclusion of walls, fences, gates and gateposts on
Bellevue Avenue and said he would like the residents to be given some leniency in dealing them.
COUNCILOR COYNE said he would not support the ordinance unless the Bellevue Avenue walls,
fences, gates and gateposts are excluded. He said a process must be developed to protect them in the
entire Historic District and not just those on Bellevue Avenue, which he said in his opinion would be

spot zoning. He said he encouraged the city administration to develop language, working with the ad
hoc committee, interested parties and residents, for a process whereby residents in the Historic
District could petition to have their walls, fences, gates and gateposts protected.
COUNCILOR COYNE moved Section 17.80.050 (A)(l) be amended to exclude "..or fences, gates,
gateposts and walls on properties that have frontage on or otherwise abut Bellevue Avenue ... " and
Section 17.80.100 to remove" ... except those otherwise specified in this ordinance."
Seconded by COUNCILOR LEONARD.

PAUL DE SIMONE, 15 Maitland Court, discussed the parking problems on his street, noting that
there are several elderly residents who often are unable to find parking spaces. He said consideration
should be given to senior citizens, and also suggested as possible solutions to the overall parking
problem: (1) different classification of stickers (e.g., between property owners and renters); (2)
renters be required to pay for stickers; (3) designating part of a street with a colored line for property
owners. COUNCILOR LEONARD suggested he apply for 24-hour sticker parking; MR. DE
SIMONE responded that it wouldn't help because people from other streets who park on Maitland
Court do have resident stickers. MAYOR NAPOLITANO said the City Manager would review his
suggestions and get back to him.

2. Application for an Annual Entertainment License, Class A & B, New, Mermaids Newport,

PAUL BOARDMAN, applicant, said that he purchased the business four years ago, after having
worked there for 22 years, and had believed that the third floor deck was part ofthe licensed
premises; however, having reviewed all the files with the City Clerk, it appears it is not. He said the
speakers on the outside of the building facing Thames St. had also been in use for a number of years
for the benefit of the public passing by, until he was recently advised by a police officer that an
entertainment license is required..
COUNCILOR COYNE said he had no issue with the request for indoor entertainment, but did with
the speakers on Thames St. since there is no outdoor seating or outdoor licensed premises abutting
Thames St. MR. BOARDMAN said he would remove the speakers, and agreed to amend his
application to request indoor entertainment on the first floor only.
COUNCILOR WALUK moved the hearing be closed. Seconded by COUNCILOR COYNE and
VOTED UNANIMOUSLY.
COUNCILOR WALUK moved the application be amended to limit the license to Class A, indoors,
on the first floor only, with all doors and windows to be closed during entertainment, and the outside
speakers to be removed. Seconded by COUNCILOR COYNE and VOTED UNANIMOUSLY.
3. Communication from the Arts & Cultural Alliance of Newport County, re: BridgeFest,
August 2-5, 2010.
MARY WAHL, a co-chair of the event, said they were now working with the Recreation Department
Director on the venues for concerts in the parks. COUNCILOR LEONARD said parking and
unloading of equipment at Eisenhower and King Parks would also need to be addressed. MAYOR
NAPOLITANO advised that the Alliance should submit an application for a special event license.
COUNCILOR WALUK moved the communication be received and the applicant work with the city
administration in submitting a Special Event license application. Seconded by COUNCILOR
COYNE and VOTED UNANIMIOUSLY.
MAYOR NAPOLITANO moved Paul Bernard be appointed to the Board of Tax Appeals.

RESOLUTIONS
5. Fireworks - S. Waluk
COUNCILOR WALUK introduced the resolution and said residents have expressed concern about
the abundance of fireworks this year since the new State Law was passed allowing hand-held and
ground-based fireworks. He asked that the city administration and city solicitor look into how to
regulate hours in which fireworks may be used and any other ways in which to limit their use.
COUNCILOR LEONARD noted that there was a booth selling fireworks at the Kite Festival at
Brenton Point State Park which didn't seem appropriate.
ALAN SULLIVAN, Russell Avenue, said he questioned why the Council was wasting time on
something regulated by the State. COUNCILOR WALUK responded that, when residents contact
council members about disturbances in their neighborhoods, the Council will look into how to control
the problem. COUNCILOR MC LAUGHLIN said he was concerned because it appears the public
thinks more types of fireworks are allowed than what actually are and some illegal airborne fireworks
are being fired near historic houses.
ORDINANCES
COUNCILOR DUNCAN moved for reconsideration of the vote taken on June 23,2010. Seconded
byWALUK.
ASSISTANT SOLICITOR CHRISTOPHER BEHAN said only the ordinance, as had previously been
amended, before the Council on Juue 23'd could be reconsidered. He said he had submitted to the
Council a revised ordinance and it would be best to advertise it in its entirety for public hearing.
COUNCILOR DUNCAN withdrew his motion for reconsideration of the Juue 23'd ordinance.
Following discussion regarding the newly revised ordinance from Assistant Solicitor Behan, which
includes new provisions related to how walls, fences, gates and gateposts will be treated and how
residents can request inclusion of specific streets in the ordinance in the future, the removal of

reference to Bellevue Avenue, and forwarding the new ordinance to the Planning Board, the motion

The organizers of the Bridgefest event have asked to use 2 city parks for outdoor
entertainment. King Park gazebo has been reserved for the nights and hours they have
indicated from 6 PM -7:30 PM. The normal reservation fee is $50 per 2-hour period for a
resident and $100 for a non-resident. Since these are being offered as free to the public I feel
these fees should be waived, but that they pay for restroom personnel.
There is adequate electrical power at King Park for the performances they have
indicated on August 3 and 5 in the bandstand or at the street pole nearby. We recommend all
speakers face the interior of the park (to the east). Restrooms are normally closed at that time,
but they indicated they will work with Easton's Beach to pay to have the person assigned to
remain on duty with the restrooms until the show is over at 7:30 PM.
It has been determined that at Eisenhower Park, on Aug. 2,4,5, there is not an adequate
power source, either up near the Courthouse or down by the park fountain, unless it was to
power 1 small microphone. So Bridgefest will be required to rent a portable generator, unless
the bands have them already. Any permitting for them is out of our jurisdiction. I believe they
also plan to work with Mike Brennan to reserve 2 parking spaces each night for the band
equipment vehicles. I have no information about restrooms for those evenings.
This office will provide a park reservation permit, once the council votes to approve these
events. They must sign and provide proof of liability l/lswance prior to the City approving.

RESTRICTIONS:
1) If approved as part of Event License, amplified voice and music must
be within ordinance levels. All speakers must face interior of park.
2) Nothing may be attached to trees in the park.
3) Absolutely no vehicles in the park. If approved, parking locations must
be approved by the Park Supervisor.
4) No Alcohol or Tobacco Products served.
5) All trash must be put in plastic bags and removed from park at the end
of the event.
6) All City of Newport Ordinances must be obeyed.
SPECIAL CONDITIONS:
1) Use of all facilities is at your own risk and the city shall be held harmless of
all liability resulting in the use of this park.
2) No vehicles may be parked on the grass without permission of Park
Supervisor.
3) Police, Fire or Parks staff person to be paid by organizer may be required
based on activity requested.
4) Set up of tents and barmers must conform to city requirements and locations
approved by Park Supervisor. All required permitting is responsibility of
organizer. Water usage must be approved by Park Supervisor.
5) Any damage to facility is the responsibility of sponsor to correct.

On September 26th at 3:00 P.M. we would like to hold the Fifteenth Annual
Geoffrey Tremont, Ph.D. Memory Walk fundraiser in Newport to benefit the Alzheimer's Association
Rhode Island Chapter. Thanks to all of the wonderful, dedicated people at Salve
Vice President Regina University and Aquidneck Island our walkathon last year was a huge

Secretarv event to be included for approval at the next City Council meeting.
Maura Travers, Esq.
Salve Regina University will again be providing the walk site and volunteers to
Treasurer
Evan Kantor help us make our walk a success. We are expecting about 400 walkers and 20
volunteers. Our Walk route is attached, starting and ending at the O'Hare
Executive Director Academic Center. We expect the event will be over by 6:00 P.M. Memory Walk
R.M. Stineman
is our single largest fundraiser ofthe year and helps us provide services to the
Board Member Emeritus community like education and training, conferences, support groups, and our
Raymond Bonenfant Helpline. We have also notified the Police Department.

The Miantonomi Park Commission received a request to hold a community outreach event in
Miantonomi Park on Sunday, July 31't. The date has been cleared with the Commission when
another event cancelled out. The Church's event organizers are aware of the amplification rules
and will remove their trash from the site.
The request is being directed for council approval due to past issues with the neighbors of the
park being concerned about the traffic and noise. The Commission did not see any reason not to
allow this event since this is the first year they have held something here. .

This is a 75'h anniversary event for their company. They will start at the Jane Pickens Theatre with a presentation - A
review of their company over the past 75 years. Followed by a reception and dinner at Rosecliff for 350 people. Most
guests are staying at the Hyatt and will be shuttled over in trollies. Some will be driving into town and will park at the
visitor's center. They will be instructed about limited street parking.
4:00-5:00pm - Guests that arrive early will gather in the park across the street from the. Jane Pickens Theatre
5:00pm - Doors open to the theatre for seating
5:30-6:30pm - Show in the Theatre
6:30pm - Trollies pick guest up and bring to Rosecliff (8 trollies will shuttle)
7:00pm -Event at Rosecliff
The request is to have coolers of softdrinks and bottled water (NO ALCOHOL) in the park for those that may arrive early.
They possibly would want to set up a table to meet and greet the guests. OR to put the coolers on?
(If having one or two tables will cause a problem, they could go without the table)
If it should rain they would just have guests wait inside the theatre and would not use the park at all.
We would certainly be responsible to clean up any cans or trash that is produced by this group.
Kathy at the Jane Pickens is securing a Fire Detail for the theatre and a Police Detail to assist with the trollies dropping
off and picking up.

1.1 Mission
Clean Ocean Access (COA) is a grass roots environmental group and has a primary
focus on Public Access, Coastline Cleanliness and Water Quality of the coastline within
the vicinity of Aquidneck Island, Rhode island. The goal of the group is to bring pUblic
awareness to local issues and provide an opportunity for people to get involved so that
we can all work together to protect, preserve and maintain the environment of today,
for tomorrow and future generations to allow for continued enjoyment of ocean
activities.
The specific goals for the 2009 program were (1) to continue to establish a baseline
foundation of water quality at several locations that are widely used by ocean
enthusiasts although not recognized by RIDOH as designed swimming areas, (2) to
provide a baseline for possibly re-opening Kings Park Swim Area, (3) to expand the
program to test the likely sources of Enterococci at Easton's Bay and (4) to bring public
awareness to water quality during "off season" months, a time in which many people
use the water for recreation, so as to achieve the long term goal of year-round water
testing in New England and permanent clean water.

In the fall of 2006 Clean Ocean Access in a partnership with Coastal Vision developed
a water testing program with a primary focus of Easton's Beach and the possible
sources of that result in beach closure. The program was funded by the Rhode Island
Departmentof Health (RIDOH) and the Environmental Protection Agency (EPA). The
result of the program showed that water quality issues persisted even as water
temperature decreases. COA has a large group of year-round ocean enthusiasts and
this finding initiated a long term goal to work towards year-round water testing with the
ultimate vision of permanent clean water along the Aquidneck Island shoreline.
In December of 2006, COA requested funding from the City of Newport to continue the
water testing program into 2007 where COA performs all manpower, logistics,
management. data analysis and the City pays for the laboratory fees directly to RIDOH.
The program results from 2007 showed that water quality issues at Easton's Beach
persists thru the Winter and Spring, some events were strongly correlated with
precipitation events while some events were not directly associated with precipitation
events.
In December of 2007, COA requested funding from the City of Newport to continue
and also enhance the water program into 2008 for weekly year-round testing with a
similar cost structure as 2007. However, in 2008 the program focus expanded to include
several locations that are known for swimming and ocean activities, although not
explicitly recognized as swimming beaches by RIDOH, The results of the 2008 program
indicated that water quality issues occasionally occur throughout the year and that a
direct correlation of precipitation to high readings does not exist in all cases and that
additional and more frequent testing of water quality is required in order to determine
the sources and the best short and long term solutions.
In December of 2008, COA requested funding from the City of Newport to continue the
program into 2009 and to include two additional locations that are highly recognized
as the main contributors of Enterococci to Easton's Bay. interim reports I and II provided

updates during the 2009 year and this report provides an annual report for the 2009
water quality monitoring program.
The same program continues into 2010 and interim reports will be provided in May and
October, followed by the annual report in March of 2011.
All Clean Ocean Access programs and events are planned and executed with
volunteers from the community. The Water Quality Monitoring Program has a director
that provides weekly planning and program oversight for strategic decision making and
interaction with local, state and federal officials. The operations manager provide
weekly operations and logistics management of the entire program making sure the
equipment, supplies, chain of custody, survey sheets are completed in compliance with
necessary protocol established with RIDOH/EPA in 2006. A team of 25 volunteers
provide weekly water sampling, survey and logistical tasks that perform the water
sampling at nine locations along with volunteer courier service to the Rhode Island
Department of Health in Providence. A fleet of volunteers exist on-call to provide
backup support or surgical strike water testing when required.
1.4 Funding
The City of Newport City Council approved funding to support the 2009 Clean Ocean
Access Water Quality Monitoring Program. Without the support of the City, this program
would not be possible. Rhode Island Department of Health bills the City of Newport on a
quarterly basis. The current cost for the program is $25 per sample, with 9 samples taken
52 times per year for a total of $11 ,700.

The 2009 Clean Ocean Access Water Quality monitoring program adopted a new
methodology for the date of each weekly test. different from the 2008 method. In 2008,
each Saturday a prediction was made as to when it would rain and the test was
scheduled for the following day. This resulted in several tests occurring immediately
after and/or during an event. however there were other times that the weather
changed and the event did not occur, and/or the event occurred during a weekend
which is not available for non-seasonal laboratory processing. In 2009 a fixed date
(Thursday) was selected for the sampling. This approach was chosen to minimize the
impact to volunteer personal schedules, especially amidst the consumer-led recession
the flexibility of employment schedules was not seen as much of an option for 2009 as
compared to 2008.
The federal Beaches Environmental Assessment and Coastal Health (BEACH) Act
requires that water is tested for Enterococci. Extensive EPA studies have shown that
Enterococci are the most efficient bacterial indicator of water quality. Enterococcus is
a part of the composition of Fecal Coliform which is a special kind of bacteria that is
found primarily in the intestinal tracts of warm blooded animals. These bacteria are
released into environment via human and animal feces and if ingested while swimming
or absorption via the skin they may cause human disease, infection or rashes.

Rhode Island bathing water standards are monitored by the Rhode Island Department
of Health based on water quality standards set by Rhode Island Department of
Environmental Management and the United states Environmental Protection Agency.
Saltwater bathing waters must not exceed a single sample standard of 104 Enterococci
(colony forming units) per 100 milliliters (mL); this is commonly referred to as a single
sample maximum (SSM) or action standard.
Analysis of water quality over a long time period is better understood using a common
technique used in scientific analysis of large datasets that change in a relative fashion
via the use of a geometric mean. The geometric mean is generally more relevant
because it is usually a more reliable measure of long term water quality. being less
subject to random variation. EPA studies derived the SSM as a percentile indicator of a
distribution of concentrations around the 30-day geometric mean. The SSM values in
the 1986 EPA Ambient Water Quality Criteria for Bacteria were not developed as acute
criteria; rather. they were developed as statistical constructs to allow decision makers to
make informed decisions to open or close beaches based on small data sets. For
beach locations. the Rhode Island standard for results of the Enterococci test is to
compute the geometric mean for at least five samples. The action standard is 35 CFU
per 100mi for a geometric mean.
The current test used by the Rhode Island Department of Health for saltwater bathing
water is the IDEXX EnterolerjlM method. The technician places a small amount of
sampled water into a dish with a reacting agent (Defined Substrate Technology nutrient
indicator). The mixture is poured into a tray and sealed and allowed to incubate for 24
hours. During the incubation period the nutrient indicator fluoresces when metabolized
by Enterococci. After the incubation period the technician counts the fluorescent cells

and refers to the most probable number (MPN) table to determine the reading with a
range of values from less than 10 to a maximum value of 24192 CFU/100ML.

This location is a popular area for ocean activities including kayaking, spear-fishing and
Paipo boarding. The purpose of testing this location is to bring public awareness to the
quality of the water. This location is a southeast facing wave swept rocky exposure in
Open Ocean at the southern tip of Easton's Point at recently adopted CRMC Public
Right of Way (Y-1) and continues the establishment of baseline data for the water
quality of Easton's Point.
This location is a main attraction for the City of Newport. The exact testing location is
halfway between the Rotunda and the Stream mouth on a south facing beach in an
embayment facing the open ocean. The purpose of testing this location is to continue
the dataset of water quality to identify any potential health problems that may still exist
at the area beaches.

This location is a popular area for ocean activities including fishing and boogie
boarding. The purpose of testing this location is to provide public awareness to the
quality of the water. This location is a wave swept exposure on the western point of
Easton's Bay facing the open ocean and helps to provide baseline data for the water
quality of Easton's Bay. Samples were collected at the base of the seawall at the end
of Ruggles Avenue.
This location is a popular swimming spot for Citizens of the City of Newport. The city has
invested time and effort to establish the Public Right of Way to the shoreline. The
purpose of testing this location is to provide public awareness to the quality of the
water. The location is a southeast facing shallow rocky beach open to the ocean. It is
on the western side of Ochre Point separated by a rock ledge from the other sampling
location.

This location is a popular swimming spot for previous generations of the City of Newport.
Unfortunately this beach is no longer open to the public; however the 4;'<.!$I!9 e!t<.!$I1'l
Acc.e.ss dataset appears to suggest that conditions might warrant re-opening the
beach. The purpose of testing at this location is to provide insight into the current water
quality and allow the officials to determine the status of the beach with the hope of re-
opening this site in the near future. The beach is a northward facing rocky beach in a
protected recreational and commercial harbor.
This location is a popular swimming spot for a wide range of citizens of the state of
Rhode Island including a large percentage of the chiidren of the City of Newport. The
pier is located at the southern end of a bulkheaded shore in a protected harbor
adjacent to Storer Park and the causeway to Goat Island. The purpose of testing this
iocation is to help establish Elm Street Pier as a designated swimming area and provide
public awareness to the quality of the water.
This location is a popular swimming spot for a wide range of citizens of the state of
Rhode Island including a large percentage of the children of the City of Newport. The
pier is iocated at the northern edge of a bulkheaded shore in a protected harbor just
south of the eastern terminus of the Pell Bridge. In 2007, Clean Ocean Access met with
the 6th grade class at Thompson Middle School and recorded that well over half of the
students at the assembly had swum at Van Zandt Pier during the summer of 2006. The
purpose of testing this location is to heip establish Van Zandt Pier as a designated
swimming area and provide public awareness to the quality of the water.

This location is one of the likely primary sources of Enterococci affecting Easton's Beach.
The moat collects runoff from a large area of the City of Newport (as the western
source) and also runoff from Middletown industry surrounding Easton's Pond (as the
eastern source). The City of Newport is actively looking into a UV disinfection system to
treat the water prior to flowing into the Ocean so as to kill the Enterococci. The purpose
of testing this location at the strearn rnouth of the moat is to determine the persistence
of Enterococci from this likely source to aide in decision making of how to solve water
pollution problems at Easton's Bay.
This location is one of the likely primary sources of Enterococci affecting Easton's Beach.
The outfall contains storm water runoff that is discharged on the far eastern rocky
coastline of Easton's Bay adjacent to the Atlantic Beach Club Beach via a 36"
diameter steel pipe. The Town of Middletown is actively pursuing upstream solutions to
reduce the Enterococci flowing into the Ocean. The purpose of testing this location is to
determine the persistence of Enterococci from this likely source to aide in decision
making of how to solve water pollution problems at Easton's Bay.
This location is one of the likely primary sources of Enterococci affecting Easton's Beach.
The outfall contains storm water runoff 1000 meters south of the Esplanade North Outfall
that is discharged on the far eastern rocky coastline of Easton's Bay adjacent to the
Atlantic Beach Club Beach via a series of unorganized stream rivulets that only form a
consolidated flow during high precipitation events. The Town of Middletown is actively
pursuing upstream solutions to reduce the Enterococci flowing into the Ocean. The
purpose of testing this location is to determine if Enterococci from this likely source are
persistent so as to aide in decision making of how to solve water pollution problems at
Easton's Bay.

This South outfall base location is one of the likely high impact areas of Enterococci
similar to Easton's Beach. The nearby outfall contains storm water runoff that is
discharged on the far eastern rocky coastline of Easton's Bay adjacent to the Atlantic
Beach Club Beach via a series of unorganized stream rivulets that only form a
consolidated flow during high precipitation events. The Town of Middletown is actively
pursuing upstream solutions to reduce the Enterococci flowing into the Ocean. The
purpose of testing this location is to determine the persistence of Enterococci from this
likely high impact area to aide in decision making of how to solve water pollution
problems at Easton's Bay.
3.1 Overall Sampling Results & Samples above acceptable limit - Distributions
The results from January 15th 2009 to December 30th 2009 provide valuable additional
data towards understanding the water quality issues that face the community of
Aquidneck Island. As shown in figure 1.0 there were occurrences of unacceptable
water quality (greater than or equal to 104 CFU/100ML) during the time period at all
swimming locations, however the ocean locations tend to experience a greater
amount of unacceptable limits.

Weekly water samples occurred on a fixed date; the data set represents a combination
of dry-weather and wet-weather patterns and due to the complex set of sources not
limited to potential SSO events, CSO events, animal waste, illicit connections, seasonal
boaters and human activity, it is difficult to quantitatively determine the source of
Enterococci at these swimming locations.
3.1.2 Overall Sampling Results & Samples above acceptable limit - Percentages
During the time frame from January 15th 2009 to December 30 th 2009 a potential of 53
water samples were possible at each testing location. However, due to a wide variety
of circumstances including weather, employment, access and safety, some sites were
not tested each week. Figure 2.1 shows a percentage of samples above the
acceptable limit at each location with supporting details within table 1.0:

The probable sources of Enterococci at this location are from the combined sources of
the Newport Moat and Middletown Esplanade which are the primary sources that
impact Easton's Bay. However. this is only the 2nd year testing the water quality at
Easton's Point and other sources not limited to boat traffic. illicit connections or wild

animals may be the cause of these elevated readings. It should be noted that these
samples were taken between 6AM and BAM and no humans or animals were seen in
the immediate water during the sampling period. The consistent elevated readings
during July and August warrant continued testing.
During the time frame from January lS'h 2009 to December 30 th 2009 there were 51
water samples taken at Easton's Beach (East) and 10 of them were above the
acceptable limit, most of which occurred during the RIDOH beach season (42% of
samples during the June thru August timeframe were above the acceptable limit) as
shown in figure 4.0:

Clean Ocean Access weekly water testing at Easton's Beach is just one of the data sets
that help to document the water quality at Easton's Beach. This data set along with the
Rhode Island Department of Health summer monitoring program and water quality
monitoring by Easton's Beach management provides a comprehensive data set that
will assist decision makers in determining the best solution(s) for achieving permanent
year-round clean water at Easton's Beach.
During the time frame from January 1st h 2009 to December 30 th 2009 there were 48
water samples taken at Ochre Point and 8 of them were above the acceptable limit as
shown in figure 5.0:

As shown in previous section for Easton's Point and subsequent section for Marine
Beach, the water quality results at Ochre Point is not always correlated (pattern or
persistence); this further illustrates the complex dynamics within Easton's Bay in terms of
sources of Enterococci and overall circulation and dispersion of Enterococci. The
possible causes may be illegal or abandoned sewage pipes or failed drain fields.
Another possible cause is stormwater containing feces of wild animals.

Access) have invested time and effort to establish, protect and preserve the Public
Right of Way to the shoreline at Marine Beach, unfortunately water quality is consistently
unacceptable; as was the case with 2008, and it is suggested that effort is put towards

water samples taken at Kings Park Swim Area and 9 of them were above the
acceptable limit as shown in figure 7.0. The elevated readings on January 15'h may
have been related to excessive melted precipitation runoff via a Wellington Avenue
CSO event and the elevated reading on July 9'h occurred one day after a 2-inch
rainfall on the 7'h and 8'h.

The water quality at Kings Park Swim Area is clean most of the time and with a protocol
similar to that of Easton's Beach it stands to reason that this location should be
considered for re-opening as a swimming location for the community, it is suggested to

also consider DNA testing to determine if the occasional elevated readings are from
human or animal sources prior to making an absolute decision to re-open the swimming
location.

the fall months with inconsistent elevated readings during the year. Harbor circulation
dynamics are complex and a single sample per week doesn't provide a complete

The water itself is a mixture of potential sources including Newport Moat, the Wave
Avenue Pumping station SSO flap, DOT Runoff and possibly ocean influences from
periods of high tide, as well as runoff from the watershed on the eastern flank of Big

Pond. Continued testing with expansion to all potential sources that make up this
complex source is recommended so as to provide input to decision makers for a
permanent strategy of eliminating this source of pollution of Easton's Bay.

water samples taken at Middletown Esplanade North Outfall and 25 were above the
acceptable limit as shown in figure 11.0 which indicates that this remains as a source of
Enterococci for Easton's Bay:

It should be noted that flow at the Esplanade varies from a trickle to class IV rapids
during extreme precipitation events. Caution should be used when correlating Easton's

The Clean Ocean Access 2010 Water Quality Monitoring Program continues with
weekly samples at nine locations. The results from 2008 and 2009 show that several
locations warrant action for determining the source of Enterococci and measures taken
to make sure permanent clean water is achieved so that future generations can
continue to enjoy ocean activities. Clean Ocean Access will submit a request for
continued funding for a 2011 program in November of 2010.
Additional samplings in partnership with RIDOH using supplementai funding from RIDOH
BEACH program may occur to aide in better understanding the water quality and to
aide in determining the best closure protocols for Easton's Beach and also provide a
more complete database that can be used for predictive modeling.
Clean Ocean Access has begun working with RIDOH and their efforts with EPA on ways
the Beach Program can expand public health and be more valuable to the surfing
community. Initial ideas are to implement an official advisory plan for the state of
Rhode Island. The focus would be on notifying the public during sewage discharges,

hurricanes etc. Areas of focus will include non-licensed facilities including some of the
locations currently tested in the 2009 program.

The records department of the NPD recieved a fax concerning a public accident on April 10, 2010, from Ms.
Anna Cavanaugh of Elizabeth NJ.
In her statement Ms. Cavanaugh states that she "tripped over a man-hole cover or part of the sidewalk" on
William St. near St. Mary's Church, just after mass on 4/10/10. Ms. Cavanaugh states that an ambulance and fire
truck responded to the scene, but no NPD officers.
Ms. Cavanaugh states that she recieved a large cut to her forehead that required stiches and a cat scan, bruising of
her face and body and broken glasses.
Ms. Cavanaugh wished a copy of this report be mailed to her at her sisters house (34 Bristol Ave, Flemington, NJ
08822) upon completion and approval.
A copy of Ms. Cavanaugh's statement was scanned into images.
