REGISTRATION OF KASAMBAHlf AND/OR LOCAL
DOMESTIC HELPERS IN THEIR RESPECTIVE BARANGAYS

WHEREAS, it is a declared policy of the state to affirm labor as a primary social

economic force and to protect the right of workers and promote their welfare; and
likewise to value the dignity of every human person and guarantee full respect for human
rights;

WHEREAS, Republic Act 7658 prohibits the employment of children below

fifteen (l 5) years of age and Republic Act 923 l likewise provides for elimination of the
worst forms of child labor and affords stronger protection for the working child;

WHEREAS, International Labor Organi:ration (ILO) Convention 182 declares

that child domestic work is one of the worst forms of child labor in the Philippines and
through this "kasambahay" registration program, the barangays will provide a data-base
that will complete the ILO-IPEC's Philippine Time Bound Programme (PTBP) to
mobilize initiatives of the local government to address this problem;

WHEREAS, the City Government of Iloilo supports the PTBP which is now an
integral part of the National Program Against Child Labor (NPACL) in pursuit of
reducing the worst forms of child labor by 75% by 2015 nationwide;

WHEREAS, the profiling of the target beneficiaries of the PTBP, especially child
domestic workers, will determine the menu of direct services, health/social security
coverage and educational opportunities adoptable to this sector;

WHEREAS, the City Government intervention to develop a range of concerted

actions to the "kasambahay" sector will compliment at the forefront of lobbying for the
adaption of the Magna Carta for the Household Helpers also known as "Batas
Kasambahay" (Senate Bill 751 );

WHEREAS, it is a primordial duty of the Sangguniang Panlungsod to approve

ordinances which shalt ensure the efficient and effective delivery of the basic services
and facilities and, among others, to provide for the care of abused children, and other
needy and disadvantaged persons, particularly children and youth below eighteen (18)
years of age;

WHEREAS, the registration of Kasambahay or local domestic helpers will help

break the invisibility of child domestic workers which is known as the worst form of
child labor;

WHEREAS, the registration of Kasambahay will not only protect child workers
from hazards of human rights violations but also empower the local domestic workers
sector;

WHEREAS, the registration of Kasambahay or local domestic helpers will

likewise protect employers and homeowners from syndicates and household helpers with
criminal records;

WHEREAS, data-basing the children and other local domestic workers is a proper
initiative to address worst forms of child domestic labor and uphold Employer's
Protection.

NOW, THEREFORE, BE IT ORDAINED, AS IT IS HEREBY ORDAINED, by

the Sangguniang Panlungsod of Iloilo, in session duly assembled:

Section 1. All barangays of Iloilo City are hereby required to conduct a massive
registration of Kasambahay and/or local domestic helpers in their respective barangays
with the technical support from the Barangay Secretariat.

Section 2. All household helpers employed are required to register in the barangay
where their workplace is located. Registration may also be done by the employer of the
kasambahay. Illiterate household helpers must be closely assisted. The registration is
free of charge.

Section 3. Definition of Terms. As used in this ordinance, the following terms

shall mean as follows:

a. "Household helper" or "Kasambahay" - refers to any person who

renders domestic/household services and includes maids, cooks,
family drivers, houseboy, gardeners, caregivers, and babysitters or
"yayas'', laundrywoman or "lavanderas'', etc., either on a live-in or
live-out basis and receive payment weekly or monthly for service
rendered.

b. "Child Domestic Worker" - refers to the children below seventeen

(17) years of age engaged on household helpers.

c. "Homeowner" or "Employer" - refers to any person who engages the

service of a house helper.

Section 4. Objectives/Purposes. The registration shall have the following

objectives and purposes:

a. To empower the Kasambahay Sector of the City of Iloilo;

b. To encourage them to come out and avail various government

programs such as social security, PhilHealth and livelihood programs
that may help their families as well;

c. To provide direct services like counseling, education and skills

training for the Kasambahay of the Peoples Organization and Non-
Government Organizations (NGOs).

Section 5. The Liga ng mga Barangay, the Sangguniang Kabataan, PESO, and the
Social Welfare Department of the City of Iloilo are hereby tasked to formulate
Implementing Rules and Regulations immediately upon approval of the said ordinance in
order to effect full compliance of the same.

Section 6. That the masterlist of "kasambahay" and/or domestic workers at the

barangay must be submitted to the Social Welfare Department of the City Government,
which will serve as the data bank, copy furnished the Liga ng mga Barangay Office and
PESO Office.

Section 7. The Punong Barangay shall keep a record of the new address of the
kasambabay, after the employer or the kasambahay has submitted a report of the
termination or transfer of employment.

Section 8. The City Mayor shall undertake the forging of a Memorandum of

Agreement between the City and Peoples Organization (PO's) and/or NonGovernment
Organizations (NGOs) for the provision of funds for its implementation.

Section 9. If any provision of this Ordinance be declared as unconstitutional or

inconsistent with a national law, the remaining parts shall remain valid.

Section 10. Copies of this ordinance shall be furnished to all barangays

throughout the City of Iloilo and shall be published in locally circulated newspapers.

Section 11. This Ordinance shall take effect immediately upon approval.
