AN ORDINANCE PROHIBITING ALL PERSONS/INDMDUALS

IMPOSING PENALTIES FOR VIOLATION THEREOF

WHEREAS, the City Government of Iloilo dreams of enhancing a new image of


Iloilo City through discipline, cleanliness and orderliness;

WHEREAS, appropriate manner of dressing needs extra attention of the City


Government as an orderly act that shall contribute to the atmosphere of decency and high
moral outlook of the people of Iloilo;

WHEREAS, the City of Iloilo firmly believes that all persons must be in proper
attire in public places especially the vendors, helpers and hired laborers in public
markets, which is one of the show windows in the city;

WHEREAS, paragraph B, Article 4 7, Rule IX of the Rules and Regulations


implementing the Local Government Code of 1991 provides that Local Government
Units shall enjoy full autonomy in the exercise of their proprietary functions and in the
management of their economic enterprises, and therefore, the City Government has the
right to regulate the activities, operations and management of all people within the market
premises;

WHEREAS, all public markets operating in Iloilo City are owned by the City
Government and therefore the City can exercise all the rights of an owner as provided by
Article 428 of the Civil Code of the Philippines, which in substance provides that the
owner has the right to enjoy (which includes the right to possess, the right to use, the
right to the fruits) and the right to dispose (which includes the right to consume or
destroy or abuse, the right to encumber or alienate);

WHEREAS, the enjoyment of private rights may be subordinated to the interests


of the greater number in recognition of the time honored principle of salus populi est
suprema lex - the welfare of the people is the supreme law;

WHEREAS, this is in line with Ordinance 399, Series of 1993, specifically the
subject on Market Enterprises which deals with the entire operation of every market in
the City of Iloilo;

NOW, THEREFORE, be it ordained, as it is hereby ordained, by the Sangguniang


Panlungsod of Iloilo that:

Section 1. Title. This ordinance shall be known as "An ordinance prohibiting


all persons/individuals in the city public markets and its premises from exposing
themselves half-naked (shirtless) and imposing penalties for violation thereof'.

Section 2. Definition of Terms

a. Half-naked or shirtless - upper half part of the body is not covered by any
clothing/garments.

b. Within the public market premises -- three (3) meters area fronting and around
the public market building.

Section 3. Prohibited Act. No person/individual inside any of the Public Market


premises in the City of Iloilo shall expose himself (walk, run, stand, jog or the like) half-
naked (shirtless).

Section 4. Penalty Provision. Any person found guilty of violating this


ordinance shall be meted the following penalties:

1 offense - the offender or violator will be warned and shall be required to wear
a garment or shirt to cover the upper half part of his body. The violator's or
offender's name shall be recorded in the police blotter and in the record book of
the vendors' association. In case of defiance to such warning, he will be
prohibited to work/stay in the premises, until he complies with what is required of
him.

For every offense thereafter a fine of Five Hundred Pesos (PS00.00) or


imprisonment of one (1) day is imposed.

Section 5. Payment of the fine imposed shall be made directly to the City
Treasurer's Office and a corresponding official receipt shall be issued to the violator or
offender.

Section 6. Implementing Authority. The Philippine National Police personnel


assigned in the markets, the Market-in-Charge, and the Officers of the Vendors
Association are hereby tasked to implement this ordinance and every violation of this
ordinance shall be recorded in the police blotter and in the vendors association's record
book.

Section 7. Posting and Publication. Upon approval by the City Council of this
ordinance, a copy thereof shall be posted in a bulletin board at the entrance of the Iloilo
City Hall and also at every main entrance or gate of all city public markets for a
minimum period of three (3) consecutive weeks. Such ordinance shall be published in a
newspaper of general circulation.
