2010 AMENDED TRAFFIC RULES, REGULATIONS

AND GUIDELINES

This Set of Traffic Rules and Regulations amend the guidelines contained in several
Circulars, foremost of which is dated 29 February 2008, signed by then President of the
Board, Raul Agustin, and Circulars dated 06 August 2008, 22 September 2008, signed by
Charlie Yu Galan, and 23 January 2010 for purposes of the issuance of car stickers signed
by Lt.C. Wilfrido Suarez, followed by the 12 April 2010 clarificatory circular signed by
Ramon de la Llana. This set of Amendments clarify and provide specific measures to
definitively address the present needs and improve Community well-being Valle Verde 5
Homeowners and Residents.

These Rules and Regulations cover Parking, Vehicle Stickers, Enforcement and
Penalties, Other Matters Related to Specific Situations, General Village Traffic Information,
and Definition of Terms.

1. PARKING – Parking of vehicles is understood to be part of each Homeowner’s/


Resident’s house construction planning to be within one’s property lines. It is a
Homeowner’s/Resident’s responsibility to find an appropriate parking area for his vehicle
whether it be in his garage/carport or driveway where it does not block the smooth flow of
traffic
At times, circumstances necessitate parking also on the streets; therefore rules and
regulations have been found valuable for order, safety and Community relations’ sake.
However, parking in the street should not be construed as unlimited freedom to invade your
neighbor’s frontage.
A Homeowner/Resident should be mindful and avoid intruding in the neighbor’s
frontage and/or area, and neither should it impede the free and easy ingress and egress of the
neighbor.
1.1. Frontages are the responsibility of and may be used by Homeowner/Resident for
overnight parking of cars which cannot be accommodated within his/her garage/car
port/driveway.
1.2. The One Side Parking Guideline will be enforced at all times and a Homeowner/
Resident shall share one car slot of his/her frontage with the Homeowner’s/Resident
opposite his/her property. The Homeowner/Resident who can park his/her vehicle on
his/her frontage shall have the vehicle parking slot nearest his/her driveway. The next
vehicle parking slot at the frontage shall be for the Homeowner/Resident opposite his/her
property. Homeowners/Residents are asked to maximize the use of their garage/car
port/driveway at all times.
1.3. Only one vehicle in excess of the Homeowner’s garage/carport/parking capacity may be
parked either on his/her frontage or on the shared vehicle parking slot of the neighbor
fronting his/her property in accordance with the One-Side Parking schedule. Other excess
vehicles may be parked at Designated Parking areas, on a first-come-first served basis.
1.4. Guest-stickered vehicles may be parked on the appropriate side of the street or
designated parking areas but not overnight.

2. COMMERCIAL VEHICLES

2.1. Commercial vehicles/vans (used for commercial purposes) may be parked along
streets only for as long as it takes to conclude their purpose (e.g. deliveries). They
may park only during daylight hours, (i.e. from 6:00 a.m. to 6:00 p.m.).
2.2. They are not allowed overnight parking on the frontage or any property within
the Village. Should a Homeowner/resident need to have such a vehicle stay overnight,
that such vehicle must be parked within the Homeowner’s carport/ property.
2.3. Drivers of commercial-type vehicles are required to leave their drivers’ licenses
with the Gate Security. Those licenses may be retrieved only when the same vehicles
driven in are driven out of the VV5 by the same drivers. No waiver of this Rule shall be
entertained.

3. PARKING AT PARK COMPLEX


3.1. The parking areas at the VV5 Park Complex, including those at Asparagus Street are
reserved for Residents and their Guests using the Park facilities, such as the Swimming
Pool, Basketball, Tennis Courts, and the Social Halls, Cabanas, and the Chapel.
3.2. For affairs held at the Park facilities, a security guard shall be assigned to
coordinate traffic and space management, the cost of which shall be included in the
rental of the facilities.
3.3 Overnight parking is not allowed at the Park’s Parking Areas for all vehicles.
3.4 No overnight parking shall be allowed at the Park’s parking areas; they are not considered
as Designated Parking Area. However, during affairs at the Social Halls and Cabañas,
Guests vehicles (with and without stickers), shall be allowed parking for the duration of the
affairs/functions.

3.5 Any vehicle found parked overnight at the Park Complex will automatically be tirelocked
and towed when not removed within the specified time limit to remove the violation.

4. PARKING AT TOWNHOUSES
4.1. Parking at Townhouses – The allowable number of car stickers depends on the
parking capacity provided by each Townhouse Homeowners’ Association thus:
San Miguel Court – 2 per Unit;
Fountainbleau – 1 per Unit, 2 for the four end Units;
Luxury – 2 per Unit.
Excess cars to be parked on the streets or at the Designated Parking Areas need the
appropriate higher-priced stickers.
4.2. Celery Drive, the street along the perimeter walls of these Townhouses is
designated as common parking areas for all Residents of the Village and Townhouses on
a first-come-first-served basis. The One-side Parking Rule applies to this Street Parking.

5. STICKERS
5.1. Vehicle stickers are used both for entrance into the Village and for purposes of parking.
Rates stickers may change every year; colors of stickers are usually changed. For this year,
2010, the following are the cost of stickers:
Red stickers P 200.00
Yellow stickers P 1,000.00
Green stickers P 500.00
Red stickers are issued to Homeowners/Residents based on the number of vehicles
that fit their garage/carport/driveway.
Yellow stickers are issued to Homeowners/Residents for vehicles in excess of the
number of vehicles which can fit in the garage/carport/driveway; therefore would need to be
parked at Designated Parking Areas.
Green stickers are issued to guests, friends and relatives of Homeowners/ Residents.
5.2. The higher cost of yellow stickers is to answer for the higher cost of maintaining and
monitoring compliance to rules.
5.3. Vehicles with commercial plates or vehicles used for commercial purposes, except allowed
school buses, shall not be qualified to be stickered (neither with residents nor guest sticker).
5.4. School buses or car pool vehicles, duly sponsored by a Homeowner/Resident (in writing)
are allowed to purchase stickers with the necessary documents, coming from the school and
with the insurance coverage.
5.5. Homeowners may sponsor guests for Guests’/Non-residents’ vehicle stickers at P500.00
per vehicle for up to five (5) guests’ vehicles. The sponsored guests will be the
Homeowner’s responsibility. The Homeowner will be limited to five (5) guests’ vehicle
stickers. Beyond five (5), approval of Administration would be needed.
5.6. Derelict vehicles will not be issued vehicle stickers.

6. PENALTIES
For assurance that Village roads maintain their function of “. . . efficient, safe and
unhampered flow of people and goods . . ,” penalties have been specified thus:

6.1. If a vehicle is found in violation of any of the above rules and regulations provided
herein, a written notice is left on the windshield of the vehicle and/or the owner or his/her
driver informed of the violation.
6.2. After two written warnings. The Homeowner/Resident is contacted to address the
violation.
6.3. If on the 3rd violation, the Homeowner/Resident has not complied, his/her attention or
that of his/her driver or helper will be called; 10 minutes will be given to correct the
violation after which , the vehicle will be tirelocked and it can only be unlocked after a
fee of P500 per violation per day is paid at the Administration Office.
6.4. Should the Homeowner/Resident willfully remove the tirelock himself/herself or cause it
to be removed, the penalty is P2,000.
6.5. Should the violation of any tirelocked vehicle not be rectified within the specified time, it
would be towed at the owner’s expense.

7. OTHER MATTERS

7.1. Homeowners holding parties which are expected to last beyond midnight at their
residences and needing additional guest parking, are requested to inform Administration
Office for parking management at the closest designated parking area (or neighbors’
frontage earlier arranged by the host–resident). For the convenience of the guests, the
resident–host may request, through Administration, the services of a guard to manage the
expected traffic at the resident’s cost.
7.2. Trailers will not be allowed to park at any designated parking areas.
7.3. Fire trucks, ambulances, and emergency vehicles have the right of way on all Village
streets when needed.
7.4. Vehicles are not allowed to be washed and cleaned on the streets at all times.
7.5. The Association shall conduct an education campaign and Drivers’ lectures on the
Rules and Regulations of and policies on parking before they are issued the Village IDs.
They will be issued a temporary ID, valid for 60 days, while awaiting the schedule of the
Drivers’ Seminar.

8. IMPORTANT REMINDERS

8.1. Speed limit within the Village is 25 KPH. Violators will be turned over to the Pasig TPMG.
8.2. Driving without license and/or practice driving on Village roads are strictly prohibited.
8.3. Parking is prohibited at all times at these areas:
8.3.1. Within an intersection
8.3.2. Within six meters at the curbs
8.3.3. On a crosswalk
8.3.4. Within four meters of a fire hydrant
8.3.5. In front of a private driveway
8.3.6. At any place where official signs have been erected for prohibited parking
8.4. Right of way for Police or other emergency vehicles
8.5. Homeowners are responsible for informing their guests of the traffic/parking rules
implemented within the Village.

9. DEFINITION OF TERMS
9.1. Guests are those authorized in writing by Homeowners/Residents.
9.2. Parking capacity is based on two surveys conducted by the Administration Office that
determined the number of vehicles a property can accommodate Homeowners may request a
“reappraisal” of the parking capacity—in which case an ocular inspection shall be conducted-
- “fitting” vehicles inside garage and driveway.
9.3. Designated parking areas are lots with no improvements where vehicle parking is designated
and allowed by the Fifth Valle Verde Homeowners’ Association Board with the permission
of the lot owner. Temporary parking is allowed. No “Unmoving” or abandoned vehicles will
be permitted to park in these areas Vehicles in violation will be towed by Pasig City TMG at
the car owner’s expense.
9.4. Commercial-type vehicles are those bearing Yellow (used as Public Utility vehicles) or
Green Plates but used for commercial purposes.

APPENDIX A

BASES of TRAFFIC and PARKING RULES and REGULATIONS:

1. Boards of Directors of Fifth Valle Verde Homeowners’ Association have always based their
actions and decision on definite principles for the common good of the Community (cf:
Souvenir Book for 30th Anniversary Celebration).
2. The Rules, Regulations and Guidelines of the Association dated November 2003 have
served as fundamental guidelines in the vehicular traffic systems within the Village.
They have been instituted by the Board of Directors as guidelines “. . . to keep and
maintain roads and other public places . . .” within the Village which had become public
domain through a Deed of Donation executed by Ortigas and Company represented by
Joaquin Ramirez, Jr., to the Municipality of Pasig represented by Mayor Emiliano
Caruncho, Jr. with the concurrence of Fifth Valle Verde Homeowners’ Association
represented by Manuel M. Santos on September 3, 981. Donated to the Municipality of
Pasig were: streets, sidewalks, parks, alleys within Valle Verde 5, covered by specific
technical descriptions in the donation.
3. Republic Act No 4136, an act to compile the laws relative to land transportation and
traffic rules, to create a Land Transportation Commission and for other purposes provides
the following definition: “Highways” shall mean every public thoroughfare, public
boulevard, driveway, avenue, park alley and callejon, but shall not include road way owned
by private persons, colleges, universities or other similar institutions.” (Article II, Section 3
(j)).
This definition designates all Village roads, sidewalks and alleys as thoroughfares
with the function of efficient, safe and unhampered flow of people and goods. Measures
needed to promote that function of a “highway” can be worked out and implemented by
local government agencies and/or Village Associations so empowered by the members.
4. The National Building Code, Rule XIX, provides for one parking slot per living unit;
thereby defining the limits of parking outside one’s property.
5. Developments and changing situations within the Community at various times have called
for revisions, redefinitions and refinements of these rules and regulations as well as better
explanations of the rationale behind them. The following more pointedly provide further
refinements, to wit:
5.1. A survey conducted in 2006 found, among others, parking on the streets as one major
irritant and cause of conflicts among neighbors. A Traffic Sub-Committee of the Board of
Directors studied the situations and came up with various measures to accommodate
different conditions, especially the matter of vehicles in excess of parking capacity within
one’s property. These were piloted on heavily congested streets (North Celery, part of
Cabbage, Cucumber, Mustard – August 2007), extended to Spinach later that year.
5.2. Specific guidelines for parking accompanied the One-Way measure, most important
of which were for Homeowners to maximize the use of the garage/car ports/driveways and
for differentiated stickers to be issued for excess vehicles which needed to be parked on the
streets (Approved by the Board at the continuation of the 20 February 2008 meeting on
February 27, 2008; Circular 012: 2008 dated 29 February 2008 signed by Raul Gat Agustin,
President. Designated Parking Areas were identified and, with the consent of lot owners,
these were improved for temporary use of “excess” cars of other Homeowners. Exemption
from payment of the Idle Land Tax imposed by Pasig City served as their incentive.
5.3. The contingencies in mid-2008 called for some revision of the One-Way Scheme which
were proposed and agreed upon at a Dialogue with Homeowners on 30 July 2008. The One-
Way Scheme was replaced by the One Side Parking Measure for the same affected streets.
(Cf: Circular 2008:41 dated 06 August 2008 signed by Charlie Yu Galan as President ). At
the success of the measure and with urgings from Homeowners, the One Side Parking was
implemented Village-wide in February 2010. (Cf: Circular dated 26 January 2010 and
signed by Charlie Yu Galan as President)
Designated Parking areas were further improved and other vacant lot owners were
contacted for their permission for the temporary use of their lots.
5.4. Underlying the Board of Directors resolutions and actions pertaining to Village streets,
sidewalks, parks and alleys is respect for others’ persons, spaces and properties in the
attainment of its Vision “a harmonious, safe and caring Community.”
