1. DEFINITION:

The universal protection system of Human Rights through article 1 of


the Declaration on the Elimination of Violence against Women defines
violence against women as:
"Any act of violence based
on the belonging of the
female sex which has or
may result in physical,
sexual or psychological
harm or suffering to
women, as well as threats
of such acts, coercion or
arbitrary deprivation of

In the community: street, public spaces, among others. It


includes various manifestations of violence, as sexual abuse,
torture, trafficking in persons, forced prostitution, abduction
and sexual harassment in the workplace, educational centers,
health facilities or else where.

Produced or tolerated by State agents: By public officials, such


as police, security personnel, judges, prosecutors, medical
examiners, wherever it occurs.

2. IN THE FIGHT AGAINST VIOLENCE WOMEN ARE


PROTECTED TO:

Women throughout their life cycle: girls, adolescents, young


people, adults and older adults.

The members of the family group:


o Couples: husband or wife, cohabiting
o Ex-partners: ex-husband or ex-wife, ex-partners
o With children in common: those who have procreated
children in common, regardless of whether they live together
or not.
o Ancestors: father and mother, grandmothers or
grandparents, great-grandparents and great-grandmothers.

o Descendants: sons and daughters, grandchildren and


granddaughters, great-grandchildren and great-
granddaughters.
o Consanguineous relatives: brothers and sisters, aunts and
uncles, cousins and cousins, nephews and nieces.
o Relative related relatives: father-in-law and mother-in-law,
brother-in-law and sister-in-law, son-in-law and yerna.
o Other relationships: Stepfather and stepmother.

3. TYPES OF VIOLENCE

3.1. PHYSICAL
VIOLENCE: It is the action
or conduct, that causes
damage to the corporal
integrity or to the health. It
includes abuse due to
negligence, neglect or basic
need deprivation, that have
caused physical damage or
that may cause it,
regardless of the time that
is required for its recovery.

3.2. PSYCHOLOGICAL VIOLENCE: It is the action or conduct,


tending to control or isolate the person against his will, to humiliate
or embarrass it and that can cause psychic damages.

Psychic damage: it is the affectation or some alteration of


the mental functions or person capacities, produced by a fact
or a set of situations of violence, that determines a temporary

or permanent, reversible or irreversible impairment of


previous integral functioning.

3.3. SEXUAL VIOLENCE: They are sexual nature actions that are
committed against a person without his consent or under duress. They
include acts that do not involve penetration or physical contact. They
are also considered as exposure to pornographic material and that they
violate the right of people to voluntarily decide about their sexual or
reproductive life, through threats, coercion, use of force or
intimidation.

3.4. ECONOMIC VIOLENCE: It is the action or omission that is


directed to cause an impairment in the economic or patrimonial
resources of any person, through:
Loss, destruction or retention of objects, instruments of work,
personal documents.
Economic resources limitation to meet their needs or
deprivation of the means to live a dignified life.
Limitation or control of your income.

4. RIGHTS OF WOMEN AND THE FAMILY GROUP

Rights to a life free of violence: Women and family members


have the right to a violence life free, to be valued and educated,
to be free from all discrimination forms, social and cultural
practices based on inferiority concepts.

Right to assistance and protection: Entities should allocate


specialized, logistical and budgetary human resources to detect
violence, care for victims, protect them and restore their rights.

Labor rights: They have the right not to suffer dismissal for
reasons related to acts of violence.

Rights in the education field : A person who is a victim of


violence has the right to change places and study hours without
prejudice to their rights, justification for absences and tardiness,
and specialized care in education.

5. ABOUT THE COMPLAINT AND THE PROCESS

5.1. THE COMPLAINT :

When the Peruvian National Police is aware of cases of violence


against women or members of the family group, in any of its
national police stations, it must bring the facts to the attention
of the family courts or those who perform their functions within
the Twenty-four hours of known the fact, sending the statement
that summarizes the action.

5.2. THE PROCESS:

- Within a maximum period of


seventy-two hours, following
the lodging of the complaint,
the family court or its
equivalent proceeds to
evaluate the case and resolves
in oral hearing the issuance of
the required protective
measures that are necessary .

protect claims for food, visits, tenure, suspension or
extinction of custody, liquidation of patrimonial regime.

its equivalent proceeds to refer the case to the criminal
prosecution for the initiation of criminal proceedings

II. CONCLUSIONS
Violence against women is a violation of human rights, rooted in
historically unequal power relations between men and women,
and systemic discrimination against women that is widespread in
both the public and private spheres.

Although violence against women is universal and present in all


societies and cultures, it takes different forms and is experienced
differently. The forms of violence women experience and the ways
in which they experience them are often shaped by the
intersection of gender with other factors such as race, ethnicity,
class, age, sexual orientation, disability, Nationality, legal status,
religion and culture.

Violence against women is complex and diverse in its


manifestations. That very diversity shows that it is neither
immutable nor inevitable. The conditions conducive to violence
against women are socially produced and, consequently, the
processes by which they are produced can be modified.

The family is the basis of society and marriage is the basis of the
family. Violence against women and the family group affects
families and the violent family translates into a violent society.
Violence in mothers family disintegration separation and divorce
of parents affect children and there is no good individual or family
development.
